The Medieval Holocaust: The Approach Of The Plague And The Destruction Of Jews In Germany, 1348-1349, Albert Winkler

When the Black Death approached the German Empire in 1348, civic authorities in Germany tried to prevent the disease from striking their cities. No one knew what the Plague was, but there were unfounded rumors that the contagion was caused by Jews who were poisoning the water sources. Civic authorities soon tortured Jews for confessions, and the largest single persecution of Jews in Germany before the 1940s broke out. Jews were attacked in more than three hundred communities, their wealth was plundered, and many thousands were burned to death. Every day, hundreds of thousands of people pass through airport security checkpoints, border crossing stations, or other security screening measures. Security professionals must sift through countless interactions and ferret out high-risk individuals who represent a danger to other citizens. During each interaction, the security professional must decide whether the individual is being forthright or deceptive. This task is difficult because of the limits of human vigilance and perception and the small percentage of individuals who actually harbor hostile intent. When Congress banned the immigration of Chinese prostitutes with the Page Law of 1875, it was the first restrictive federal immigration statute. Yet most scholarship treats the passage of the Page Law as a relatively unimportant event, viewing the later Chinese Exclusion Act as the crucial landmark in the federalization of immigration law. This Article argues that the Page Law was not a minor statute targeting a narrow class of criminals, but rather an attempt to prevent Chinese women in general from immigrating to the United States. Over the last twenty years, national governments, patent owners, farmers, plant breeders, researchers, and a diverse array of non-governmental organizations (NGOs) have engaged in a vigorous debate over how to conserve and utilize the world's plant genetic diversity. On one side of this debate are advocates of a pure global commons regime, which would allow researchers, breeders, and farmers free and unfettered access to all plant genetic resources (PGRs), including those held in international seed banks, in national collections, and in situ on public lands. Productivity has been one of the central topics in the field of word-formation in recent decades. Heretofore, productivity has been mainly, if not solely, discussed in formal terms, such as which affixes can be used with which stems, the productivity of rival affixes, etc. Such a formal approach leaves out the speakers’ needs for creating new words. Accounting for speakers’ word-formation needs requires a re-evaluation of the notion of creativity. The Interaction Of The Bilingual’S Two Phonetic Systems: Differences In Early And Late Korean-English Bilinguals, Wendy Baker

One of the basic questions of bilingual research is to what extent the bilingual’s two phonetic systems influence each other, a question that has occupied a prominent place in bilingual research almost from the outset of the field (see, for example, Weinreich, 1953). Recent studies in bilingual first language acquisition (BFLA) demonstrate that, at least in simultaneous bilingual acquisition, infants exposed to two languages are developing what appear to be two phonetic/phonological systems from the beginning (Johnson and Wilson, 2002; Kehoe, 2002; Bosch and Sebastian-Galles, 2001, Vihman, 2002), although their two systems may differ from monolinguals of either language (Mack, …

As the Portland-Vancouver economy emerges from recession, regional residents must come to terms with the realities of a restructured economy. The familiar sectors and industries upon which we based success in the past likely will no longer sustain us, at least to the degree they once did. We are simultaneously witnessing the rebuilding of an economy while suffering the symptoms of radical change. The author argues that we ought to treat our eating, exercise habits, and girth as personal matters, for the most part, but that law can and should make a contribution, as an ally of our longer-term will against our immediate cravings. Law can be our ally in this fashion without command-and-control intrusion into our private lives. Such intrusion is at odds with our core beliefs and unlikely to produce public health success. It is more likely to provoke popular backlash--one reason why some who stand to gain from our unhealthy dining choices try to cast government efforts to inform these …

Although much has been written on the history of the priest-penitent privilege, this Article will show that such writing tends toward an unconscious, but strong, anglocentric tilt. It seems that no scholar has tried to locate and interpret all the Irish and American sources that inspired this initially hibernocentric, later more generally American, postcolonial deviation from the English common law. Since the Second World War, the significance of Philips and its 1828 New York codification have gained widespread recognition, but the scholarly inquiry has never advanced in any truly historical fashion. This article will not address the science and ethics of stem cell research—at least as far as those topics are normally addressed in the existing literature. Instead, this article argues that an even more contentious battle is looming on the horizon, with dire practical consequences: Namely, who will own the revolutionary medical breakthroughs that are supposed to emerge from this research? Along the way, this article will assume that stem cell research will progress in some fashion and that at least some of the purported benefits will materialize.
