Dred Scott v. Sanford, Plessy v. Ferguson, Brown v. Board of Education and Grutter v. Bollinger all demonstrate that law alone is not enough to make social change. Instead, lawyers interested in social change must understand the nature of the societies that they attempt to persuade and the language that leads judges to change their ways of thinking. In the early 21st century, the language of persuasion is often the language of social science.

Prosecutors control statutory ranges by selecting charges. In addition, prosecutors decide whether to use or forego special sentencing statutes that carry mandatory minimum penalties higher than the maximum Guidelines sentence that would otherwise apply to the defendant's conduct, as well as statutes that authorize a sentence lower than the minimum Guidelines sentence that would otherwise apply ("safety valve," "substantial assistance," and Rule 35 reductions). By creating these additional provisions and then removing any effective judicial oversight of their application, Congress has expanded the opportunities for prosecutors to decide when to opt out of the national Guidelines and when to abide …

China has speeded up modernization since the reform and open-door policy was introduced in 1978. After accession to the World Trade Organization in 1999, China has been further incorporated into the global track. The national policy of economic development requires a continuing exploitation of natural resources and intensive labor from the rural sector, and over the last few decades, there has been a ceaseless wave of rural women going to the cities and working mainly as assembly-line workers, domestic helpers and sex workers.

Despite the apparent concern with “South Asians” in Hong Kong society in recent years, such as pushing for legislation against racial discrimination and initiating social and educational programmes to help these minorities to better integrate into Hong Kong society, attention to irreducible cultural differences constituting their heterogeneity is still largely lacking.

香港文學是學者近年的研究重點,而隨著香港與上海的「雙城」概念在近 年受到學者的關注,將香港文學跟上海文學作出比較的文章也不少,卻鮮有人 研究香港文學跟上海文學之間的關係。事實上,香港與上海從五四以來就有頗密切的接觸,上海的新文學很容易傳到香港去,並對香港文壇產生影響。尤其 在1949 年後,大量人口從內地遷進香港,上海的文化人才更加直接流入香港,並嘗試在香港繼續發展於內地時的文學工作,包括文學創作、報章和雜誌的編輯工作等。五、六十年代的香港擁有文學發展相對上有利的條件,尤其在比較自由、穩定的政治環境底下,可以容納任何政治背景和立場的文人。因此,不同背景的上海作家來港後,都有機會發展他們的文學工作,甚至為香港帶來有別於五四主流的文學風格和看法。不過,對於上海作家來說,香港跟上海始終是兩個不同的城市,他們帶著各自的經歷和期望到來,必須面對來港後各方面的轉變。他們對都市的看法、對香港的感受,都一一表現在他們的文學作品中。 本文在眾多上海作家裡集中於葉靈鳳、劉以鬯、馬朗和徐訏這四位在香港文學史中成就最為顯著的作家,研究他們的文學歷程、文學作品和報章、雜誌等編輯工作,以了解香港對他們的文學生涯有何影響,他們又如何在香港延續他們在上海時所作的文學工作。

We investigated the role of interleukin-17 (IL-17)/IL-17 receptor (IL-17R)-mediated signaling in the protective immunity against Toxoplasma gondii. IL-17R−/− mice developed a normal adaptive immunity against the parasite. However, increased mortality in the knockout animals can be attributed to a defect in the migration of polymorphonuclear leukocytes to infected sites during early infection.

The goal of this research was to examine the effects, if any, the programs available from an Academic Support Services unit of a small, private, liberal arts college might have on the grade point averages of students admitted on probation over two major semesters. Long-term hot-carrier induced degradation of MOS devices has become more severe as the device size continues to scale down to submicron range. In our work, a simple yet effective method has been developed to provide the degradation laws with a better predictability. The method can be easily augmented into any of the existing degradation laws without requiring additional algorithm. With more accurate extrapolation method, we present a direct and accurate approach to modeling empirically the 0.18-ìm MOS reliability, which can predict the MOS lifetime as a function of drain voltage and channel length. Research has demonstrated the importance of early social interactions in the development of self-talk. It does not appear, however, that existing research has examined the relationship between parents' self-talk and the self-talk that develops in their children. This study examined the relationship between self-talk in parents and their college-age children. Results revealed significant relationships between students' and parents' positive self-talk, but not negative self-talk. Marginal relationships were found for self-talk ratios (ratios of positive and negative self-talk). Maternal communication was found to mediate the relationship between students' and their mothers' positive self-talk. Different trends also were noted between genders. Finally, …

This study examines differences in quality of life measures between heterosexual and homosexual respondents using General Social Survey data from 1996, 1998, 2000, and 2002. Analyses of quality of life are performed in an effort to compare the heterosexual and homosexual population of the United States. The three main areas which are explored in the analysis are physical health, general happiness, and life excitement. Few differences were found in subjective life satisfaction between heterosexuals and homosexuals; however, some control variables differed. Directions for future research regarding homosexuality and quality of life are discussed.

Liquid crystal (LC)-based adaptive optics are important for information processing, optical interconnections, photonics, integrated optics, and optical communications due to their tunable optical properties. In this dissertation, we describe novel liquid crystal photonic devices and their fabrication methods. The devices presented include inhomogeneous polymer-dispersed liquid crystal (PDLC), polymer network liquid crystals (PNLC) and phase-separated composite film (PSCOF). Liquid crystal/polymer composites could exist in different forms depending on the fabrication conditions. We present the Hadley model, a formal descriptive model of input and output for modern computer operating systems. Our model is intentionally inspired by the Open Systems Interconnection model of networking; I/O as a process is defined as a set of translations between a set of computer-sensible forms, or layers, of information. The purpose of this study was twofold: First, to gather perspectives of randomly selected administrators and teachers in two central Florida school districts concerning the participation of teachers in professional development (PD), and secondly, to determine if there was a significant differences in the amount of participation of teachers from different academic departments in these activities. Results indicated that a teacher's assignment to a particular academic department has a relationship to the amount of PD involvement. This thesis describes an improved methodology for embedded software development. MATLAB and Simulink allow engineers to simplify algorithm development and avoid duplication of effort in deploying these algorithms to the end hardware. Special new hardware targeting capabilities of MATLAB and Simulink are described in detail. A motor control system design served to demonstrate the efficacy of this new method. Initial data was collected to help model the motor in Simulink. This allowed for the design of the open and closed loop control systems. Large diameter concrete pipes have been used in many areas of central Florida to carry pressured sewage flow. These pipes have been typically located at six feet below finished roadway elevation, and ranges in diameter from thirty six to sixty inches. The water table is typically located at shallow depth below finished roadway elevation, and generally fluctuates between five to ten feet depending on the relative roadway elevation to mean sea level. In my thesis work, I have used DC8,9PC 1,2-bis(tricosa-10,12-dinoyl)-sn-glycero-3-phosphocholine), a type of chiral lipid to form the vesicles, tubules and ribbons . By using Atomic Force Microscope, I have studied the morphological features of these particular structures. Also, the mechanical properties of lipid tubules have been studied using AFM. The human body compensates well for moderate climatic heat stress, but artificial environments often block or overwhelm physiological defense mechanism. Personal protective equipment (PPE) is one of sources of heat stress. It protects individual from chemical, physical, or biological hazards, but the high thermal insulation and low vapor permeability of PPE may also lead to substantial heat stress.
