The Market For Legal Education And Freedom Of Association: Why The "Solomon Amendment" Is Constitutional And Law Schools Are Not Expressive Associations, Andrew P. Morriss

This term the Supreme Court will confront the constitutionality of the Solomon Amendment, which mandates equal access for military recruiters at universities that accept federal funding. The Third Circuit previously held the statute unconstitutional. This Article argues that the Court should reverse and uphold the statute because the lower court failed to consider the cartelized nature of legal education and so assumed that law schools are "expressive associations" entitled to assert First Amendment claims; the court also failed to give proper deference to Congress's exercise of its Article I power to raise and support armies and over-valued law faculties' interest …

Cleaning Up The Eighth Amendment Mess, Tom Stacy

This article criticizes the Court's interpretation of the Eighth Amendment's Cruel and Unusual Punishment Clause and offers its own understanding. The Court's jurisprudence is plagued by deep inconsistencies concerning the Amendment's text, the Court's own role, and a constitutional requirement of proportionate punishment. In search of ways to redress these fundamental shortcomings, the article explores three alternative interpretations of the Clause: (1) a textualist approach; (2) Justice Scalia's understanding that the Clause forbids only punishments unacceptable for all offenses; and (3) a majoritarian approach that would consistently define cruel and unusual punishment in terms of legislative judgments and penal custom. …

This article provides the broad historical context necessary to understand contemporary developments in federalism doctrine. It shows that dual federalism has a long and varied history and that federalism is a content-neutral principle to which both sides in major political contests have appealed. It seeks to show that the predominant perspective on federalism today - that it is an inherently conservative principle - is the result of historical misperception. More than 8 million ash trees in southeast Michigan have been killed by an infestation of the invasive insect species emerald ash borer (EAB). Since its identification in July 2002, EAB has been found in Ontario (Canada), Ohio, Indiana, and across Michigan. To date, EAB research has concentrated on the entomological classification and no systematic prediction of the pest's diffusion has been made.

Determination Of Stiffness Matrix Of Tapered Roller Bearings For Vibration Models, Jeeva Kumar

The stiffness matrix of tapered roller bearings under radial and axial load conditions was evaluated using an analytical model and an experimental approach. An experimental test system was designed and manufactured to determine the radial stiffness of the bearing under combined axial and radial load conditions. A second fixture was designed to measure the stiffness of the bearing under pure axial load conditions. The stiffness coefficients determined have been compared with those obtained from the analytical model, OEM (Original Equipment Manufacturer) data and ABAQUS model (finite element analysis software).

Being a pregnant female is a temporary condition. A woman with a history of childhood sexual abuse aligns the personhoods of child victim, adult survivor and pregnant female to achieve a successful pregnancy, labor, delivery and postpartum experience. Female survivors desire to be recognized and function as whole being during the perinatal experience. It is estimated that 15 to 32 percent of females prior to the age of eighteen have unwanted sexual contact. Female survivors carry this history of childhood sexual abuse (CSA) with them throughout their lives which may involve childbirth. There are many long-term psychological consequences that can …

Although somewhat later than other major urban areas, Boston has been experiencing fundamental demographic changes. The 2000 Census reported that for the first time non-Hispanic whites constitute a minority of the city’s population. Subsequent Census estimates confirm an even stronger trend toward a rapidly diversifying population.

Immigration has been a major factor in this growth and diversification. A recent report shows that over the last 15 years more than 22,000 new immigrants have annually settled in Massachusetts. The foreign-born as a percentage of the population has grown from 9.4 percent in 1980 to 14.3 percent in 2004.

Wilsons disease is an autosomal recessive disorder of copper metabolism which results from mutations in the gene encoding for Wilson disease protein (WDP). The cytosolic N-terminus of WDP comprises six metal binding domains each containing a conserved metal binding motif, GMXCXXC. The contribution of these metal binding domains to copper homeostasis is poorly understood. We have cloned, expressed and purified residues 485 to 633 corresponding to N-terminal metal-binding domains 5 and 6 of WDP (WD5-6). Two of the 3 disease causing mutations in the N-terminal metal binding domains of WDP occur one in each of these domains and the two …

The Effects Of Feedback On Hourly Pay And Individual Monetary Incentives, Douglas A. Johnson

The effects of performance feedback when individuals received fixed or individual incentive pay were examined. A 2 X 2 factorial design was used with approximately 30 college students in each group. Participants attended six experimental sessions. They entered the cash value of simulated bank checks presented on a computer screen. Monetary incentives increased the number of correctly completed checks (p = .000); however feedback had no effect (p = .825). Time spent working and rate of performance correlated strongly with the number of checks completed correctly, suggesting that both influenced the checks completed correctly. Pitzer's Ion-interaction Model had been widely used in predicting the non-ideal behavior of solution over a wide range of conditions for natural water systems. The model is successful only when there are sufficient parameters available. However, generating these needed parameters requires a great quantity of work and it would be advantageous to be able to predict the Pitzer's parameters for salt systems when there is no data available.
