Technology And News: How Are Choices Changing The Way Americans Get Their News?, Mary Eilleen Lyon Cleary Oct 2005

Technology And News: How Are Choices Changing The Way Americans Get Their News?, Mary Eilleen Lyon Cleary

Masters Theses

This study examines the on-going research into where Americans get their information about news events. The vehicles that news consumers use drive many markets and news coverage itself. Readers, listeners and viewers are not only choosing a media vehicle; they are also choosing who will advertise on and support those media outlets. Demographics play a role in determining which media vehicles are turned to for everyday news events, crisis information or political events and analysis. Those demographics can in turn influence the events covered by the media. Media outlets will cover what people want to see or hear so advertisers …

Preface--International Legal Dimensions Of Art And Cultural Property, Jeffrey A. Schoenblum Oct 2005

Preface--International Legal Dimensions Of Art And Cultural Property, Jeffrey A. Schoenblum

Vanderbilt Journal of Transnational Law

The market for art and cultural property is international.' Demand is intense and not particularly local in terms of consumer preference. Supply responds to this intense international demand. Like most anything else, art finds its way to whomever is prepared to pay for it. Regulation affects how it arrives at its ultimate destination, but generally does not prevent it from getting there...

The symposium's contributors have sought to address the complex legal and policy issues raised by an explosive global market in art and cultural property. These articles will prove invaluable in the shaping of the international legal response to …

From Navy Seals To The Siege: Getting To Know The Muslim Terrorist, Hollywood Style, Rubina Ramji

Journal of Religion & Film

The commercial film industry creates cultural products that often reflect societal norms. The popularity of these images is based on the fact that they reflect the "anxieties and longings” of their audience: as contemporary cultural "texts,” they are capable of expressing "the pressing concerns” of a moment in history. Film is often informed by the news, and reinforces the images portrayed through these media outlets: they are capable of conveying religious ideology and values in contemporary culture. Popular media such as cinema performs religious functions as public sites for the vocalization and discussion of meaning. Therefore films, as a social …

Law's Ambition And The Reconstruction Of Role Morality In Canada, David M. Tanovich Oct 2005

Law's Ambition And The Reconstruction Of Role Morality In Canada, David M. Tanovich

Dalhousie Law Journal

There is a growing disconnect and alienation between lawyers and the legal profession in Canada. One cause, which is the focus ofthe article, is philosophical in nature. There appears to be a disconnect between the role lawyers want to pursue (i.e., a facilitator of justice) and the role that they perceive the profession demands they play (i.e., a hired gun). The article argues that this perception is a mistaken one. Over the last fifteen years, we have been engaged in a process of role morality reconstruction. Under this reconstructed institutional role, an ethic of client-centred zealous advocacy has slowly begun …

Damages For Mental Distress And Other Intangible Loss In A Commercial Context, Shannon O'Byrne Oct 2005

Damages For Mental Distress And Other Intangible Loss In A Commercial Context, Shannon O'Byrne

Dalhousie Law Journal

As a general rule, contracts law does not permit an award of general damages for mental distress or other intangible loss. There are several rationales for this, including: plaintiffs are to bear their disappointment or upset with mental fortitude; without the rule, courts would be awash in litigation since every breach of contract brings with it some degree of emotional distress; without the rule, plaintiffs may fabricate or exaggerate the degree of their upset; and the rule simply reflects the lack of foreseeability of such loss under Hadley v. Baxendale. Notwithstanding the general rule, courts have awarded mental distress in …

Accountants, Privilege, And The Problem Of Working Papers, Paul Paton Oct 2005

Accountants, Privilege, And The Problem Of Working Papers, Paul Paton

Dalhousie Law Journal

Full and frank disclosure between corporate issuers and their auditors and accounting advisors is critical for maintaining access to the information required for audits and public confidence in the capital markets. While tax authorities in the United States, Australia, New Zealand and the United Kingdom have the power to make broad requests for working papers, in all four jurisdictions, legislation or administrative practice reflects the determination that the best approach for balancing tax and capital markets requirements is for the revenue authorities to seek working papers only in exceptional circumstances. Additionally, limited forms of privilege for accountants have been recognized …

The Big Chill?: Contextual Judgment After R. V Hamilton, Richard Devlin, Matthew Sherrard Oct 2005

The Big Chill?: Contextual Judgment After R. V Hamilton, Richard Devlin, Matthew Sherrard

Dalhousie Law Journal

The tone and thrust of the Ontario Court ofAppeal's decision in R. v. Hamilton will serve to chill efforts by sentencing judges to tailor their responsibilities to accord with the recognized realities of systemic and intersectional inequality in Canadian society The decision presents an unduly conservative response to the judicial function question, and an understandable, if excessively cautious, answer with regard to the application of systemic, intersectional inequality issues in practice. Specifically, the decision underplays the overall remedial goal of section 718 of the Criminal Code by overemphasizing the particularity of Aboriginal peoples, and ignoring the specificity of especially vulnerable …

Uncovering The Presumption Of Factual Innocence In Canadian Law, Mark Herrema Oct 2005

Uncovering The Presumption Of Factual Innocence In Canadian Law, Mark Herrema

Dalhousie Law Journal

The presumption of innocence has long been regarded as a hallmark of our justice system. Rhetoric abounds and finding a more celebrated legal doctrine is difficult. For most in the legalprofession, the presumption of innocence represents the procedural requirement that the Crown prove all elements of an offence. Yet, aside from its procedural and evidentiary protections, does the presumption of innocence offer any protection at the pre-charge phase of the criminal justice process? Specifically, for the majority of Canadians who have never been, or never will be charged with an offence, does the presumption of innocence offer any protection? Regrettably, …

A Quasi-Ptas For Unsplittable Flow On Line Graphs, Nikhil Bansal, Amit Chakrabarti, Amir Epstein, Baruch Schieber Oct 2005

A Quasi-Ptas For Unsplittable Flow On Line Graphs, Nikhil Bansal, Amit Chakrabarti, Amir Epstein, Baruch Schieber

Computer Science Technical Reports

We study the Unsplittable Flow Problem (UFP) on a line graph, focusing on the long-standing open question of whether the problem is APX-hard. We describe a deterministic quasi-polynomial time approximation scheme for UFP on line graphs, thereby ruling out an APX-hardness result, unless NP is contained in DTIME(2^polylog(n)). Our result requires a quasi-polynomial bound on all edge capacities and demands in the input instance. Earlier results on this problem included a polynomial time (2+epsilon)-approximation under the assumption that no demand exceeds any edge capacity (the "no-bottleneck assumption") and a super-constant integrality gap if this assumption did not hold. Unlike most …

Relationships Of Intercropped Maize, Stem Borer Damage To Maize Yield And Land-Use Efficiency In The Humid Forest Of Cameroon, A. Chabi-Olaye, C. Nolte, F. Schulthess, C. Borgemeister Oct 2005

Relationships Of Intercropped Maize, Stem Borer Damage To Maize Yield And Land-Use Efficiency In The Humid Forest Of Cameroon, A. Chabi-Olaye, C. Nolte, F. Schulthess, C. Borgemeister

All Peer-Reviewed Publications

Stem borers are the most important maize pests in the humid forest zone of Cameroon. Field trials were conducted in the long and short rainy seasons of 2002 and 2003 to assess the level of damage and yield reductions caused by stem borers in monocropped maize and in maize intercropped with non-host plants such as cassava, cowpea and soybean. The intercrops were planted in two spatial arrangements, i.e. alternating hills or alternating rows. All intercrops and the maize monocrop were grown with and without insecticide treatment for assessment of maize yield loss due to borer attacks. The land-use efficiency of …

Beaver (Castor Canadensis) Impacts On Herbaceous And Woody Vegetation In Southeastern Georgia, Jessica R. Brzyski Oct 2005

Beaver (Castor Canadensis) Impacts On Herbaceous And Woody Vegetation In Southeastern Georgia, Jessica R. Brzyski

College of Graduate Studies: Theses & Dissertations

North American beavers are considered ecosystem engineers. Their activities can quickly and drastically alter habitat properties and perhaps permit highly aggressive colonizing plants, notably non-native species, to invade and potentially dominate. This study examined if beavers in southeastern Georgia have an effect on the terrestrial plant community. Sampling areas included beaver modified (N=9) and nearby but relatively non-impacted riparian habitat (N=9) in a matched pairs design. Vegetation surveys were performed in spring and summer. Species richness was calculated for herbs, vines, woody seedlings, and woody vegetation. Richness of herbaceous vegetation was higher at distances closer to shore while richness of …

Estimated Age Effects In Baseball, Ray C. Fair Oct 2005

Estimated Age Effects In Baseball, Ray C. Fair

Cowles Foundation Discussion Papers

Age effects in baseball are estimated in this paper using a nonlinear fixed-effects regression. The sample consists of all players who have played 10 or more “full-time” ’ years in the major leagues between 1921 and 2004. Quadratic improvement is assumed up to a peak-performance age, which is estimated, and then quadratic decline after that, where the two quadratics need not be the same. Each player has his own constant term. The results show that aging effects are larger for pitchers than for batters and larger for baseball than for track and field, running, and swimming events and for chess. …

The Nature And Enforcement Of Investor Rights Under Investment Treaties: Do Investment Treaties Have A Bright Future, Susan Franck Oct 2005

The Nature And Enforcement Of Investor Rights Under Investment Treaties: Do Investment Treaties Have A Bright Future, Susan Franck

Scholarly Articles in Law Reviews & Journals

The number of investment treaties has surged in the past decade. Even now, the United States and Canada are actively engaged in programs designed to facilitate the completion of multilateral treaties such as the Dominican Republic-Central American Free Trade Agreement (CAFTA-DR) and Bilateral Investment Treaties (BITs). These investment treaties act like economic bills of rights, which grant foreign investors substantive protections and procedural rights to facilitate investment. Sovereigns, meanwhile, may benefit from these treaties by obtaining increased foreign direct investment, which may promote the development of their country's infrastructure 6 and offer citizens basic services including access to clean water, …

Explicating Factors That Foster Civic Engagement Among Students, Masami Nishishiba, Hal T. Nelson, Craig Shinn Oct 2005

Explicating Factors That Foster Civic Engagement Among Students, Masami Nishishiba, Hal T. Nelson, Craig Shinn

Center for Public Service Publications and Reports

This paper investigates many facets of civic engagement by analyzing how college undergraduate students conceptualize civic engagement and by examining factors that predict greater student involvement in political, social, and community affairs. We administered a survey to college students at the beginning of fall, winter, and spring terms, 2001-02.We analyzed survey responses using a structural equation modeling (SEM) technique. The analysis examines how expectations of community and political efficacy, attitudes regarding citizen control of government, and attitudes toward diversity relate to the students’ civic engagement behaviors such as monthly volunteer hours, organizational participation, advocacy, voting, direct political action, and action to …

High-Speed Rail Projects In The United States: Identifying The Elements For Success-Part 1, Mti Report 05-01, Allison L. C. De Cerreno, Daniel M. Evans, Howard Permut

Mineta Transportation Institute

For almost half a century, high-speed ground transportation (HSGT) has held the promise of fast, convenient, and environmentally sound travel for distances between 40 and 600 miles. While a number of HSGT systems have been developed and deployed in Asia and Europe, none has come close to being implemented in the United States. Yet this is not for lack of trying. There have been several efforts around the country, most of which have failed, some of which are still in the early stages, and a few of which might come to pass.

The goal of this study was to identify …

Computational Analysis And Validation Of The Hans Head And Neck Support, Kapil Tyagi Oct 2005

Computational Analysis And Validation Of The Hans Head And Neck Support, Kapil Tyagi

Mechanical & Aerospace Engineering Theses & Dissertations

One of the major causes of racing fatalities is basilar skull fracture from excessive head motions and neck loading in a frontal impact. There are many head/neck restraints available in the market but HANS head and neck support has proved to be the most efficient one in sled testing. This paper evaluates and compares the performance of the HANS device in MAthematical DYnamic MOdel (MADYMO) software with the sled testing. The tests were conducted for the frontal impact motions, with a crash pulse of 45 G's.

The goal of the tests was to evaluate the performance of HANS without the …

Fourier Transform Analysis Of Terahertz Radiation, Chikaodira N. Okpo Oct 2005

Fourier Transform Analysis Of Terahertz Radiation, Chikaodira N. Okpo

Electrical & Computer Engineering Theses & Dissertations

Advances in terahertz radiation (T-rays) technology have great promise in various technological areas ranging from medical technology, imaging technology and accelerator technology. At Thomas Jefferson Laboratory, the Free Electron Laser division (FEL) produces very powerful beam of laser light by accelerating electrons in bunches along a beamline. This laser light absorbs and releases energy at various wavelengths. The new FEL upgrade led to the production of very bright terahertz (THz) radiation with an average power of 1 00watts which is about 100,000 times brighter than those produced elsewhere. These T-rays have very significant applications in the Laboratory. The most significant …

Magnetization Reversal Of Fe Films On Ag Submicrometer Pyramidal Islands, Chin-Chung Yu, Yeong-Der Yao, Sy_Hwang Liou Oct 2005

Magnetization Reversal Of Fe Films On Ag Submicrometer Pyramidal Islands, Chin-Chung Yu, Yeong-Der Yao, Sy_Hwang Liou

Sy-Hwang Liou Publications

Ag submicrometer pyramidal islands with a (100) truncated top and four (111) sidewalls were successfully fabricated on Si(100) substrates at a deposition temperature of 500/spl deg/C. The magnetization reversal of 30 nm thick Fe films grown on Ag pyramidal islands was studied by magnetic force microscopy. The magnetization reversal of Fe films was first started at the sidewalls of pyramidal islands. Then, the formation and propagation of wall-like structures were observed under a higher external magnetic field, namely 95 Oe. The magnetic domain images indicated that the Fe films grown on the sidewalls of pyramidal islands and the strength of …

Will Travel For Food: Spatial Discounting In Two New World Monkeys, Jeffrey R. Stevens, Alexandra G. Rosati, Kathryn R. Ross, Marc D. Hauser Oct 2005

Will Travel For Food: Spatial Discounting In Two New World Monkeys, Jeffrey R. Stevens, Alexandra G. Rosati, Kathryn R. Ross, Marc D. Hauser

Department of Psychology: Faculty Publications

Nonhuman animals steeply discount the future, showing a preference for small, immediate over large, delayed rewards [1–5]. Currently unclear is whether discounting functions depend on context. Here, we examine the effects of spatial context on discounting in cotton-top tamarins (Saguinus oedipus) and common marmosets (Callithrix jacchus), species known to differ in temporal discounting [5]. We presented subjects with a choice between small, nearby rewards and large, distant rewards. Tamarins traveled farther for the large reward than marmosets, attending to the ratio of reward differences rather than their absolute values. This species difference contrasts with performance on …

Review Of Amphibians And Reptiles Of Montana By J. Kirwin Werner, Bryce A. Maxell, Paul Hendricks, And Dennis L. Flath, Anthony Russell Oct 2005

Review Of Amphibians And Reptiles Of Montana By J. Kirwin Werner, Bryce A. Maxell, Paul Hendricks, And Dennis L. Flath, Anthony Russell

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

This volume documents comprehensively Montana's herpetofauna in a field guide/natural history format. As such, it joins other relatively recently published guides to the herpetofaunas of the northern Great Plains states and provinces that border Montana to provide extensive background information about amphibians and reptiles across this broad region. Assembled by a consortium of authors with a wealth of first-hand experience, the guide is profusely illustrated with color photographs of habitats and animals in the field, almost all of good to excellent quality, though a few are too small or indistinct to illustrate clearly the features being considered. For the most …
