Economic Efficiency And The Parameters Of Fairness: A Marriage Of Marketplace Morals And The Ethic Of Care, Barbara Ann White Oct 2005

Economic Efficiency And The Parameters Of Fairness: A Marriage Of Marketplace Morals And The Ethic Of Care, Barbara Ann White

All Faculty Scholarship

This article provides resolutions to a number of conundrums that have vexed policy-makers and scholars for some decades. The most significant conclusion is that efficiency and fairness concerns do not conflict but rather mutually support each other in the goal of maximizing social welfare. This is contrary to the more widely-held view by both advocates of law and economic reasoning and those favoring deontological concerns that a trade-off between fairness and efficiency is inevitable. This article demonstrates how the coalescence of the two frameworks, the cultivation of fairness with law and economics' efficiency maximization, yields greater enhancements of social welfare …

"The Day The Earth Stood Still”: 1950'S Sci-Fi, Religion And The Alien Messiah, Matthew Etherden

Journal of Religion & Film

The Day the Earth Stood Still is a unique film for its time. From a secular point of view, it was one of the first to not portray aliens as the enemy. From a spiritual point of view, it has many similarities to the gospel accounts of the public life and teachings of Jesus. This essay will consider the religious significance of this film (both in its historical context and the present), comparing it to similar works and contrasting it with the beliefs of a number of New Age movements. The main character, Klaatu, will then be considered as a …

A Community Of Characters – The Narrative Self In The Films Of Wes Anderson, Brannon M. Hancock Oct 2005

A Community Of Characters – The Narrative Self In The Films Of Wes Anderson, Brannon M. Hancock

Journal of Religion & Film

This essay is a reflection upon the work of writer-director Wes Anderson. Anderson's first three films, Bottle Rocket, Rushmore, and The Royal Tenenbaums, contain common themes which I assert provide fertile ground for theological reflection. This discussion will focus on two aspects of the characters that populate Anderson's mythopoetic world(s) – firstly, the construction of the narrative self; and secondly, the vitality of community which fundamentally precedes authentic personhood.

Knowledge And Mortality In Blade Runner And Genesis 2-3, Kyle Keefer Oct 2005

Knowledge And Mortality In Blade Runner And Genesis 2-3, Kyle Keefer

Journal of Religion & Film

Definition of humanity's limits is a paramount concern for both the Hebrew creation myth of Genesis and the film Blade Runner. The film works as an interpretation of the biblical account by presenting replicants as having gained knowledge without being able to extend their lifespan. In this sense, they have abilities and limits that parallel those of the first man and first woman in Genesis.

Amma N Movies: An Introduction, Maria-Priska Ondrich Oct 2005

Amma N Movies: An Introduction, Maria-Priska Ondrich

Journal of Religion & Film

Although Amma n movies, a special genre of Tamil cinema (Amma n means mother and is a term which addresses village Goddesses all over Tamil Nadu) have originated in the 70´s until nowadays they have not been recognised outside Tamil Nadu. These movies use a special language. It is a necessity to know the vocabulary as in the case of every language. A basic vocabulary is essential to understand the religious symbolism inherent in these films. The following article shall provide the reader a short introduction to the main religious themes of the movie and shall enable her/him to understand …

Revisiting Violence In The Godfather: The Ambiguous Space Of The Victimage Model, Paul Graham Oct 2005

Revisiting Violence In The Godfather: The Ambiguous Space Of The Victimage Model, Paul Graham

Journal of Religion & Film

This article closely revisits and praises the long, contemplative scenes and the fast contrapuntal cutting of the violence displayed in The Godfather to show how the movie's superior editing and filming style help to overturn its own violent message. Thus, the film, however cynically, completes Girard's the victimage model without actually immolating its would-be scapegoat. By inhabiting the deconstructive "space” of the scapegoating motif, the film's bloody scenes undercut themselves and help to enact a message against the violence within the ideologies of the American Dream, capitalist competition, or any other factor that may serve to mitigate Michael Corleone's actions.

He Is The One: The Matrix Trilogy's Postmodern Movie Messiah, Mark D. Stucky Oct 2005

He Is The One: The Matrix Trilogy's Postmodern Movie Messiah, Mark D. Stucky

Journal of Religion & Film

Many films have used Christ figures to enrich their stories. In The Matrix trilogy, however, the Christ figure motif goes beyond superficial plot enhancements and forms the fundamental core of the three-part story. Neo's messianic growth (in self-awareness and power) and his eventual bringing of peace and salvation to humanity form the essential plot of the trilogy. Without the messianic imagery, there could still be a story about the human struggle in the Matrix, of course, but it would be a radically different story than that presented on the screen.

I, Robot: You Gotta Have Heart, Richard C. Trussell Oct 2005

I, Robot: You Gotta Have Heart, Richard C. Trussell

Journal of Religion & Film

I Robot is a rousing sci-fi action story which explores Artificial Intelligence and its consequences. Deep philosophical themes abound, such as existential crisis and identity-defining choice, the nature of personhood, purpose in life, cognition and mental interpretive structures, faith vs. reason, divine command theory, and freedom vs. determinism. It also brims with biblical symbolism, including the fall, messianic figures, the exodus from bondage, theophany, ambiguity of the feminine, sacrificial death and the trinity. Finally it is about personal and collective redemption, making a clear statement about the heart and emotions as the seat of will, faith, and morality.

Shared Care, Elder And Family Member Skills Used To Manage Burden, Margaret Sebern Oct 2005

Shared Care, Elder And Family Member Skills Used To Manage Burden, Margaret Sebern

College of Nursing Faculty Research and Publications

Aim. The aim of this paper is to further develop the construct of Shared Care by comparing and contrasting it to related research, and to show how the construct can be used to guide research and practice.

Background. While researchers have identified negative outcomes for family caregivers caused by providing care, less is known about positive aspects of family care for both members of a family dyad. Understanding family care relationships is important to nurses because family participation in the care of chronically ill elders is necessary to achieve optimal outcomes from nursing interventions. A previous naturalistic inquiry …

Arge-Encoded N-Acetyl-L-Ornithine Deacetylase From Escherichia Coli Contains A Dinuclear Metalloactive Site, Wade C. Mcgregor, Sabina I. Swierczek, Brian Bennett, Richard C. Holz Oct 2005

Arge-Encoded N-Acetyl-L-Ornithine Deacetylase From Escherichia Coli Contains A Dinuclear Metalloactive Site, Wade C. Mcgregor, Sabina I. Swierczek, Brian Bennett, Richard C. Holz

Physics Faculty Research and Publications

The catalytic and structural properties of the argE-encoded N-acetyl-l-ornithine deacetylase (ArgE) from Escherichia coli were investigated. On the basis of kinetic and ITC (isothermal titration calorimetry) data, Zn(II) binds to ArgE with Kd values that differ by ∼20 times. Moreover, ArgE exhibits ∼90% of its full catalytic activity upon addition of one metal ion. Therefore, ArgE behaves similarly to the aminopeptidase from Aeromonas proteolytica (AAP) in that one metal ion is the catalytic metal ion while the second likely plays a structural role. The N-acetyl-l-ornithine (NAO) deacetylase activity of ArgE showed a linear temperature dependence from …

Cigarette Smoking Among Low-Income African Americans: A Serious Public Health Problem, Jorge Delva, Marisol Tellez, Tracy L. Finlayson, Kimberlee A. Gretebeck, Kristine Siefert, David R. Williams, Amid I. Ismail

College of Nursing Faculty Research and Publications

Background

This study examines the current prevalence of cigarette smoking and the number of cigarettes smoked in a community-based sample of 1021 low-income African-American men and women.

Methods

Participants were selected using a two-stage, area probability sample design. Data were collected in 2002–2003 in face-to-face interviews and analyzed in 2005. All data and analyses were weighted to account for the complex sampling design.

Results

Fifty-nine percent of men and 41% of women were current smokers, with younger individuals apparently initiating smoking at an earlier age than older individuals.

Conclusions

The high prevalence of cigarette use provides further evidence that the …

Malpractice Reform As A Health Policy Problem, William M. Sage Oct 2005

Malpractice Reform As A Health Policy Problem, William M. Sage

Faculty Scholarship

Calling malpractice reform a "health policy problem" means that we should analyze it in terms of the quality of health care, access to health care, and the cost of health care-the basic health policy triad with which we all are familiar. We immediately recognize patient safety as a health policy problem because it is obviously about quality. We may believe there is so much slack in the health care system that we can make major improvements in patient safety without excessive cost. But ultimately, there are going to be cost-safety tradeoffs, which are also health policy concerns. We tend not …

Does The Constitution Apply To The Actions Of The United States Anti-Doping Agency?, Dionne L. Koller Oct 2005

Does The Constitution Apply To The Actions Of The United States Anti-Doping Agency?, Dionne L. Koller

All Faculty Scholarship

Since its formation in 2000, the United States Anti-Doping Agency (USADA) has aggressively pursued athletes who are believed to have used performance-enhancing substances and has aggressively prosecuted those who ultimately test positive. To many, this is a long overdue response to the growing problem of doping in sports. But to others, USADA's actions, and the federal government's support of these efforts, has sparked enormous controversy. This article examines USADA and its relationship to the federal government to determine whether USADA's actions could be constrained by the Constitution. While it is clear that USADA has very close ties to the federal …

Integration Of The Shel Model With The Flight Operational Quality Assurance (Foqa) Program, James T. Schultz, Scott Forn, Marian C. Schultz Oct 2005

Integration Of The Shel Model With The Flight Operational Quality Assurance (Foqa) Program, James T. Schultz, Scott Forn, Marian C. Schultz

Publications

The SHEL Model has been used to explore relationships between liveware, environmental, hardware and software factors. This study attempts to integrate Flight Operational Quality Assurance (FOQA) program data with the SHEL model. Aircraft record data that can be used to monitor the human interface within the entire system, plus identify faults and potential failures within the system before a major accident or incident occurs. These data have existed for over four decades, and FOQA offers a way to both analyze and act upon them. The relationships between the SHEL model and FOQA data can help to ensure our nation's skies …

Common Ground: Law Schools In American Life During The New Age Of Faith, David Rudenstine Oct 2005

Common Ground: Law Schools In American Life During The New Age Of Faith, David Rudenstine

Articles

The article argues that law schools and the legal profession play a crucial, though underappreciated, role in maintaining the rule of law, democratic processes, and individual freedoms in American society. It explores the intersection of religion and legal education, particularly how religious faith that mandates specific public laws may conflict with the evidentiary and deliberative underpinnings of legal education. The article concludes that legal education fosters a common ground for deliberation, aligning with the principles of the First Amendment, and highlights the importance of this role in a pluralistic society.

Privatizing Due Process, Paul R. Verkuil Oct 2005

Privatizing Due Process, Paul R. Verkuil

Articles

The article explores the concept of "private due process," arguing that while traditional due process protections under the Constitution require state action, privatization of government functions creates gaps in procedural safeguards. It examines how state laws, federal regulations, and alternative dispute resolution (ADR) mechanisms can fill these gaps and proposes a "Private Administrative Procedure Act" (PAPA) to ensure procedural fairness when government functions are delegated to private entities.
