Effectiveness Of Hybrid Learning Environments, Omar F. El-Gayar, Terry Dennis Jan 2005

Effectiveness Of Hybrid Learning Environments, Omar F. El-Gayar, Terry Dennis

Research & Publications

Hybrid learning environment (HLE) is a classroom- and computer-based environment that is an open system, allowing synchronous and asynchronous interactions and encounters with other participants. This paper assesses the learning effectiveness of students in HLE for two core MSIS courses at DSU. In conclusion, the results attest to the viability of HLE. In-class and video conferencing students get to benefit from the virtual classroom setting (supporting web-site, asynchronous communication via electronic discussion board and email, and the opportunity to review the recorded class), while Internet students get to benefit by reducing the anxiety and feeling of isolation through the opportunity …

An Agent-Based Approach For Sourcing Business Rules In Supply Chain Management, Jun Liu, Sudha Ram Jan 2005

An Agent-Based Approach For Sourcing Business Rules In Supply Chain Management, Jun Liu, Sudha Ram

Research & Publications

In recent years, business rule management has become an important component of enterprise information systems. Business rules represent guidelines about how an enterprise should conduct its business and provide better service for customers. Business rules are being widely deployed in supply chains to support real-time decision making. The research reported in this paper is aimed at designing a dynamically adaptable data-sourcing service for deploying business rules effectively in supply chain management. Such a data-sourcing service is important since execution of business rules requires data to be retrieved from various data sources spread across the enterprise, including the enterprise data warehouse. …

Public health is a legal term of art referring specifically to delineated powers, duties, rights, and responsibilities. An emerging human rights conception of public health justifies government intervention. Intervention involves public officials taking appropriate measures including environmental regulations pursuant to specific legal authority, after balancing private rights and public interests, to protect the health of the public. This article is a critical analysis of the performance of the actors in maintaining environmental standards in India. Part II is a discussion on the source of environmental law in India. Part III discusses the performance of the legislature. Part IV evaluates the …

This paper describes the application of Carroll’s scenario-based design and claims analysis as a means of refinement to the initial design of a digital library of geographical resources (GeogDL) to prepare Singapore students to take a national examination in geography. GeogDL is built on top of G-Portal, a digital library providing services over geospatial and georeferenced Web content. Beyond improving the initial design of GeogDL, a main contribution of the paper is making explicit the use of Carroll’s strong theory-based but undercapitalized scenario-based design and claims analysis that inspired recommendations for the refinement of GeogDL. The paper concludes with an …

Teaching Enron, Milton C. Regan

What follows is a discussion of several transactions that the Examiner analyzed for the Enron bankruptcy court. These represent only a portion of the many transactions that the Examiner analyzed, but constitute a large number of the transactions with respect to which he focused on the conduct of attorneys. In most of these cases, the Examiner found that Enron's lawyers potentially could be liable to the company under various causes of action. In some instances, the Examiner did not find potential liability. These transactions are included in my discussion, however, because they can be used to explore certain ethical issues …

Developmental Incompetence, Due Process, And Juvenile Justice Policy, Elizabeth S. Scott, Thomas Grisso Jan 2005

Developmental Incompetence, Due Process, And Juvenile Justice Policy, Elizabeth S. Scott, Thomas Grisso

Faculty Scholarship

In 2003, the Florida District Court of Appeal reversed the murder conviction and life sentence imposed on Lionel Tate, who was twelve years old when he killed his six-year-old neighbor. Since Lionel was reported to be the youngest person in modern times to be sent to prison for life, the case had generated considerable debate, and the decision was appealed on several grounds. What persuaded the appellate court that the conviction could not stand, however, was the trial court's rejection of a petition by Lionel's attorney for an evaluation of his client's competence to assist counsel and to make a …

Book Review Of Jean Stefancic & Richard Delgado, How Lawyers Lose Their Way: A Profession Fails Its Creative Minds (2005), Milton C. Regan Jan 2005

Book Review Of Jean Stefancic & Richard Delgado, How Lawyers Lose Their Way: A Profession Fails Its Creative Minds (2005), Milton C. Regan

Georgetown Law Faculty Publications and Other Works

"How Lawyers Lose Their Way" claims that lawyers' unease stems from a distinctive source: their excessive use of and exposure to "formalism" in their work. I think that they are on to something, but the analysis in this book is too underdeveloped to provide much insight into what it is. The authors' use of the term "formalism" risks being so inclusive that it loses explanatory power. In addition, their claim that overreliance on formalism is the chief culprit in lawyers' unhappiness is vulnerable to the charge that lawyers arc suffering the effect of trends in the workplace affecting a wide …

American Medicine And The Politics Of Race, Maxwell Gregg Bloche Jan 2005

American Medicine And The Politics Of Race, Maxwell Gregg Bloche

Georgetown Law Faculty Publications and Other Works

Straw men play a major role in the debate over racial disparity in American medicine. Most have been deployed by the disparities-denying right, but progressives intent on “outing” racism have sent forth their share. This essay flushes out the straw men while attempting to understand the competing moral premises that drive the politics of health care disparity. At bottom, arguments about the scope of disparity and discrimination in medical care are disputes about the appropriate scope of personal responsibility for life circumstances. Further research into the factors that correlate with racial differences in health care can shed light on the …

Obesity And The Struggle Within Ourselves, Maxwell Gregg Bloche Jan 2005

Obesity And The Struggle Within Ourselves, Maxwell Gregg Bloche

Georgetown Law Faculty Publications and Other Works

The author argues that we ought to treat our eating, exercise habits, and girth as personal matters, for the most part, but that law can and should make a contribution, as an ally of our longer-term will against our immediate cravings. Law can be our ally in this fashion without command-and-control intrusion into our private lives. Such intrusion is at odds with our core beliefs and unlikely to produce public health success. It is more likely to provoke popular backlash--one reason why some who stand to gain from our unhealthy dining choices try to cast government efforts to inform these …

Constitutionalization, Girardeau A. Spann Jan 2005

Constitutionalization, Girardeau A. Spann

Georgetown Law Faculty Publications and Other Works

Students of constitutional law tend to suspect pretty early on that the Constitution simply means whatever the Supreme Court says that it means. Rather than fight that intuition, I think it is best to treat the student insight as one of the basic starting assumptions when teaching a course in Constitutional Law. The goal then becomes to help students figure out how best to maneuver and feel comfortable in a legal universe where the Constitution has only contingent meaning.

What the Supreme Court does when it clothes its political policy preferences in the garb of constitutional law can be described …

Judicial Selection: Ideology Versus Character, Lawrence B. Solum Jan 2005

Judicial Selection: Ideology Versus Character, Lawrence B. Solum

Georgetown Law Faculty Publications and Other Works

Part I of Judicial Selection: Ideology versus Character sets the stage for an argument that character and not political ideology should be the primary factor in the selection of judges. Political ideology has played an important role in judicial selection, from John Adams's entrenchment of federalists as judges after the election of 1800 to the Roosevelt's selection of progressives, liberals, and New Dealers, the contemporary era, from the failed nominations of Fortas, Haynsworth, Carswell to the defeat of Robert Bork, the narrow confirmation of Clarence Thomas. But until recently, political ideology has played its role behind the scenes--mostly off the …

Tangled Up In Khaki And Blue: Lethal And Non-Lethal Weapons In Recent Confrontations, David A. Koplow Jan 2005

Tangled Up In Khaki And Blue: Lethal And Non-Lethal Weapons In Recent Confrontations, David A. Koplow

Georgetown Law Faculty Publications and Other Works

Too often, military and law enforcement authorities have found themselves constrained by inadequate weaponry: the tools available to them, in addressing confrontations with entrenched opponents of various sorts, are either too weak (not sufficing to disarm or defeat the enemy) or too strong (generating unacceptable "collateral damage" in harming innocent people or property). An emerging category of "non-lethal weapons" carries promise for resolving this dilemma, proffering deft new capabilities for disabling, dissuading, or defeating opponents without inflicting death or permanent injury.

Some primitive non-lethal weapons (such as truncheons, tear gas, and water cannon) have long been staples in the inventories …

Private Litigation To Enforce Fiduciary Duties In Mutual Funds: Derivative Suits, Disinterested Directors And The Ideology Of Investor Sovereignty, Donald C. Langevoort Jan 2005

Private Litigation To Enforce Fiduciary Duties In Mutual Funds: Derivative Suits, Disinterested Directors And The Ideology Of Investor Sovereignty, Donald C. Langevoort

Georgetown Law Faculty Publications and Other Works

This article focuses on independent directors and the processes of mutual fund corporate governance. To be clear, I believe (and research shows) that disinterested directors do add value as a form of shareholder protection, and this fact justifies the SEC's efforts to strengthen their role. But they are far from a panacea. While that point alone is almost trite, exploring some of the unique features of mutual fund governance shows why judges and policymakers should not even try to reason by analogy to governance in other kinds of corporations. Yet that is exactly what Burks and its progeny have done. …

Liberalism, Torture, And The Ticking Bomb, David Luban Jan 2005

Liberalism, Torture, And The Ticking Bomb, David Luban

Georgetown Law Faculty Publications and Other Works

Torture used to be incompatible with American values. Our Bill of Rights forbids cruel and unusual punishment, and that has come to include all forms of corporal punishment except prison and death by methods purported to be painless. Americans and our government have historically condemned states that torture; we have granted asylum or refuge to those who fear it. The Senate ratified the Convention Against Torture, Congress enacted antitorture legislation, and judicial opinions spoke of "the dastardly and totally inhuman act of torture.” Then came September 11.

Human Nature, The Laws Of Nature, And The Nature Of Environmental Law, Richard J. Lazarus Jan 2005

Human Nature, The Laws Of Nature, And The Nature Of Environmental Law, Richard J. Lazarus

Georgetown Law Faculty Publications and Other Works

The essay is divided into three parts. Part I considers the ways in which the need for environmental law derives from the tendency of human nature to cause adverse environmental consequences and the ways in which the laws of nature make it more difficult to prevent those consequences absent the imposition of external legal rules. Part II describes how our nation's lawmaking institutions are similarly challenged by the laws of nature. This includes a discussion of how the kinds of laws necessary to bridge the gap between human nature and the laws of nature are systematically difficult for our lawmaking …

The "Monster" In All Of Us: When Victims Become Perpetrators, Abbe Smith Jan 2005

The "Monster" In All Of Us: When Victims Become Perpetrators, Abbe Smith

Georgetown Law Faculty Publications and Other Works

In this Essay, I will discuss the "cycle of violence”, that transforms victims into perpetrators, focusing on the Aileen Wuornos case. I will examine the odd lack of support for Wuomos and others like her as soon as they become perpetrators. I will then talk about men and boys who have been sexually abused and become perpetrators. I will conclude by arguing that the prevailing feminist approach to crime and violence has been too narrowly focused on victims, and has - witting or not - contributed to the nation's extraordinary and exclusive turn to punishment over the past three decades.

Spirits Of Defiance: National Prohibition And Jazz Age Literature, 1920-1933, Kathleen Morgan Drowne Jan 2005

Spirits Of Defiance: National Prohibition And Jazz Age Literature, 1920-1933, Kathleen Morgan Drowne

English and Technical Communication Faculty Research & Creative Works

National Prohibition (1920-1933) ranks as one of the most divisive political controversies of the twentieth century, and its reverberations echoed through nearly every facet of American popular culture. Not surprisingly, many novelists and short story writers added their voices to this contentious public debate by incorporating into their works their interpretations of the wildly controversial federal liquor laws. In Spirits of Defiance, the first book to examine how American writers responded to the far-reaching effects of the Eighteenth Amendment, Kathleen Drowne analyzes the literary portrayals of bootleggers, moonshiners, revenuers, speakeasies, cabarets, and other specifically Prohibition-era characters and settings in a …
