Is Poetry A War Crime? Reckoning For Radovan Karadzic The Poet-Warrior, Jay Surdukowski Jan 2005

Is Poetry A War Crime? Reckoning For Radovan Karadzic The Poet-Warrior, Jay Surdukowski

Michigan Journal of International Law

This Note will suggest that the Office of the Prosecutor of the International Criminal Tribunal for the former Yugoslavia (ICTY) can use Karadzic's texts and affectations to warrior poetry in the pretrial brief and in admitted evidence, if and when Karadzic ultimately appears for trial. The violent nationalism of radio broadcasts, political journals, speeches, interviews, and manifestos have been fair game for the Office of the Prosecutor to make their cases in the last decade in both the Yugoslavia and Rwanda Tribunals. Why should poetry, perhaps the most powerful maker of myth and in the Yugoslavia context, a great mover …

Is Unilateral Humanitarian Intervention Compatible With The U.N. Charter?, Petr Valek Jan 2005

Is Unilateral Humanitarian Intervention Compatible With The U.N. Charter?, Petr Valek

Michigan Journal of International Law

The main topic of this Note is the compatibility of unilateral humanitarian intervention with Article 2(4) of the U.N. Charter (the Charter). Through its interpretation, the author will attempt to discover whether the Grotian idea of unilateral humanitarian intervention can survive in the environment of contemporary international law without its "just war appendix." This Note will separate this idea from its "just war justification" and approach the question of the compatibility of such intervention with the Charter as a legal positivist. In the interpretation of Article 2(4) of the Charter, this Note will try to avoid moral principles. Instead, it …

Instructions In Inequality: Development, Human Rights, Capabilities, And Gender Violence In School, Erika George Jan 2005

Instructions In Inequality: Development, Human Rights, Capabilities, And Gender Violence In School, Erika George

Michigan Journal of International Law

This Article argues that the international community's gender equality targets will not be realized by 2015 because the problems associated with sexual violence against girls in schools are situated at an intersection of contested conceptual divides between human rights (civil and political liberties) and development aims (social and economic needs). Cracks in the conceptual foundations of both the liberal and utilitarian theories of justice and equality, which support traditional human rights advocacy and economic development plans, respectively render each approach inadequate to fully identify and address the grave danger sexual violence and harassment in schools pose to educational equality. In …

The Law And Culture Of The Apology In Korean Dispute Settlement (With Japan And The United States In Mind), Ilhyung Lee Jan 2005

The Law And Culture Of The Apology In Korean Dispute Settlement (With Japan And The United States In Mind), Ilhyung Lee

Michigan Journal of International Law

This Article addresses the apology in civil dispute settlement in Korea, Japan's neighbor across the East Sea, using the U.S.-Japan comparative discussion as a helpful frame of reference. Part I provides the necessary background on the meaning of the apology and the leading commentary along the U.S.-Japan axis, beginning with the work of Wagatsuma and Rosett. Culture appears in this discussion in two regards. First, a question arises as to whether the very meaning of the apology as noted in the commentary reflects the U.S. cultural orientation, or instead has universal application. Second, some argue that cultural norms explain the …

Saving Customary International Law, Andrew T. Guzman Jan 2005

Saving Customary International Law, Andrew T. Guzman

Michigan Journal of International Law

This Article offers a theory of CIL-one that provides a firm and modem theoretical foundation for the analysis of custom. Though this is not the first article to propose a view of CIL through a rational choice lens, it is the first to map out a general theory of CIL based on such a model.

An Experience Sampling And Cross-Cultural Investigation Of The Relation Between Pleasant And Unpleasant Emotion, Christie N. Scollon, Ed Diener, Shigehiro Oishi, Robert Biswas-Diener Jan 2005

An Experience Sampling And Cross-Cultural Investigation Of The Relation Between Pleasant And Unpleasant Emotion, Christie N. Scollon, Ed Diener, Shigehiro Oishi, Robert Biswas-Diener

Research Collection School of Social Sciences

The present study examined whether the relation between pleasant and unpleasant emotion varies across cultures and level of analysis (i.e., within-person vs. between-person). A total of 386 participants included European Americans, Asian Americans, Japanese, Indian, and Hispanic students. Momentary mood was assessed up to 7 times daily for one week. At the between-persons level, pleasant and unpleasant mood were positively correlated among Asian Americans and Japanese, but were uncorrelated among the other groups. Factor correlations at the within-person level were strongly negative in all cultures, suggesting that pleasant and unpleasant feelings are rarely experienced at the same time. Implications for …

Helena Znaniecka Lopata: Remarks To The Asa Section On The History Of Sociology, Mary Jo Deegan Jan 2005

Helena Znaniecka Lopata: Remarks To The Asa Section On The History Of Sociology, Mary Jo Deegan

Department of Sociology: Faculty Publications

THE DEATH of Helena Znaniecka Lopata represents a significant loss to the History of Sociology section because she was a good friend and colleague. Because of her direct family tie to the early years of sociology, especially at the University of Chicago, her passing also signals the end of an important era in the discipline. I knew Helena for over 30 years, and I was asked to reflect briefly on her life and career at our section reception in Atlanta. For those members not at the reception, this is what I said. Helena Lopata was a friend to many of …

Harriet Martineau’S Ambleside As A Sociological Laboratory, Michael R. Hill

Department of Sociology: Faculty Publications

Harriet Martineau was a pioneering experimental sociologist in the best sense. In a wide variety of social venues, Martineau undertook constructive, consequential, and innovative actions specifically designed to explore and demonstrate social capacities and possibilities, often in concert with her Lake District neighbors. For three decades, from 1846 to her death in 1876, Ambleside witnessed the outcomes of numerous investigations and projects that Martineau championed. This presentation identifies several of Martineau’s sociological experiments.

Centennial Bibliography On The History Of American Sociology, Michael R. Hill Jan 2005

Centennial Bibliography On The History Of American Sociology, Michael R. Hill

Department of Sociology: Faculty Publications

THE CENTENNIAL BIBLIOGRAPHY ON THE HISTORY OF AMERICAN SOCIOLOGY is intended as an inclusive clearinghouse for sources, studies, and other references that illuminate the origins and subsequent development of the sociological enterprise in the United States of America.2 As such, this bibliography is necessarily provisional and is envisioned as an on-going project to which further citations may be added as they are discovered and as new works are published. Due to the enormous scope of the project, and the short time frame within which the initial compilation was completed, countless useful and insightful references have been unintentionally omitted. Some portions …

Family Economic Pressure And Adolescent Suicidal Ideation: Application Of The Family Stress Model, Kevin A. Yoder, Dan R. Hoyt Jan 2005

Family Economic Pressure And Adolescent Suicidal Ideation: Application Of The Family Stress Model, Kevin A. Yoder, Dan R. Hoyt

Department of Sociology: Faculty Publications

This study used a sample of 501 families from the Mississippi Delta region to examine the feasibility of the Family Stress Model for understanding adolescent suicidal ideation. The results indicated that family economic pressure was related to parental depressive symptoms, which, in turn, was related to parental hostile behavior and physical abuse. These parental behaviors were related to adolescent self-esteem and depressive symptoms, which, in turn, were related to adolescent suicidal ideation. Therefore, family economic pressure and parental depressive symptoms and behaviors were indirectly related to adolescent suicidal ideation. The results indicate the applicability of the Family Stress Model for …

A Study Of The Applicability Of The Theory Of Inventive Problem Solving On Technology Management Of An E -Business Call Center, Aaron C. Goldsmith

All-Inclusive List of Electronic Theses and Dissertations

The Theory of Inventive Problem Solving (TRIZ) is being used to solve technology and engineering problems. The goal of theDissertation was to conduct a study to determine the applicability of the Theory of Inventive Problem Solving (TRIZ) on the technology management for an e-business call center. The variables selected for the research were the Average Calls per 10,000 Subscribers (ACPS) and the Unburdened Billable Hours (UBH). The applicability was determined through the research hypotheses and research questions constructed for the study. The research null hypotheses were tested using a time-series quasi-experiment to determine if four TRIZ-based solutions introduced into the …
