Differential Immersion Survival By Populations Of Cicindela Hirticollis (Coleoptera: Cicindelidae, Mathew Louis Brust, William Wyatt Hoback, Kerri Farnsworth Skinner, Charles Barry Kinsley

In the past 20 yr, populations of Cicindela hirticollis Say (Coleoptera: Cicindelidae) that inhabit river shorelines have declined dramatically. These habitats have routinely flooded in winter and spring historically, but they have been altered by damming and controlled water releases for irrigation and power generation. We tested the ability of C. hirticollis larvae from two river and one bayshore population to survive immersion in severely hypoxic water. This is the first report of population-level differences among insects in immersion survival and likely relates to exposure to different flooding regimes. It involves issues of place-making and hopes to understand both the processes leading to and consequences following the alteration and eventual elimination of such places within the home. The continuously expanding global free trade in domestic and sex workers intensifies old capitalist-patriarchal forms of extracting women’s emotional, physical, and sexual labor. The patriarchal dream of seizing control of impure, unruly life has now entered its neoliberal stage, exemplified by money begetting money in the virtual sphere of financial speculation, and by biotechnology’s promise to create a world that is no longer in need of impure female mothering bodies. Downstream elements are a newly appreciated class of core promoter elements of RNA polymerase II-transcribed genes. The downstream core element (DCE) was discovered in the human β-globin promoter, and its sequence composition is distinct from that of the downstream promoter element (DPE). We show here that the DCE is a bona fide core promoter element present in a large number of promoters and with high incidence in promoters containing a TATA motif. Database analysis indicates that the DCE is found in diverse promoters, supporting its functional relevance in a variety of promoter contexts. The DCE consists of …

The nocturnal drainage flow of air causes significant uncertainty in ecosystem CO2, H2O, and energy budgets determined with the eddy covariance measurement approach. In this study, we examined the magnitude, nature, and dynamics of the nocturnal drainage flow in a subalpine forest ecosystem with complex terrain. We used an experimental approach involving four towers, each with vertical profiling of wind speed to measure the magnitude of drainage flows and dynamics in their occurrence. We developed an analytical drainage flow model, constrained with measurements of canopy structure and SF6 diffusion, to help us interpret the tower …

After Roper V. Simmons: Keeping Kids Out Of Adult Criminal Court, Ellen Marrus, Irene Merkel Rosenberg

San Diego Law Review

When children kill, as they always have and probably always will, the state must juggle two distinct and oftentimes conflicting concerns: its police power and its parens patriae interest. These concerns are not, however, mutually exclusive. There is a delicate balance that must be maintained. Clearly, the state must incapacitate and punish children who commit serious criminal acts, but, as Simmons says, that does not mean that minors can be executed, nor, as the Authors maintain, be consigned to living death behind bars without any hope of respite. The legal system must somehow be adjusted for children.

Municipal Separate Storm Sewer System (Ms4) Regulation Under The Federal Clean Water Act: The Role Of Water Quality Standards?, John H. Minan

The Clean Water Act, the primary federal statute regulating water pollution, requires municipal storm water discharge permits, under the National Pollutant Discharge Elimination System program, to include provisions controlling discharges from municipal separate storm sewer systems. This article questions whether the Clean Water Act's maximum extent practicable standard is the only statutory standard given the current trend toward compliance with state water quality standards independent of the maximum extent practicable standard, and whether the Clean Water Act superseded the state water quality standards. State water quality standards act as a water quality threshold, which are reviewed often by the states …

This Comment will, first, determine whether the government's unitary waters approach is a viable interpretation of the SWA. Second, it will explore what characteristics should be considered to determine whether two water bodies are"meaningfully distinct." Finally, this Comment will explore the possible consequences of applying the NPDES program to water transfers between two water bodies.

Systematic Revision Of The Genus Eupleura H. And A. Adams, 1853 (Gastropoda: Muricidae) In The Neogene To Recent Of Tropical America, Gregory S. Herbert

The systematics of the Neogene to Recent genus Eupleura of tropical America are revised, with descriptions of four new species: Eupleura engerrabunda, from the Late Miocene of Mexico (Atlantic); Eupleura gravidentata, from the Plio-Pleistocene of Colombia (Atlantic); Eupleura paroudia, from the Early or middle Pliocene of Mexico (Atlantic); and Eupleura vokesorum, from the Pliocene of Costa Rica (Pacific) and Ecuador and the Recent tropical eastern Pacific. Two recent taxa, Eupleura plicata and Eupleura limata, are also resurrected, increasing the standing diversity of Eupleura in the eastern Pacific to seven species. Eupleura limata, however, may …

This paper aims to assist those who do qualitative research in the field of marriage and family to reduce the number of rejections received in response to article submissions. Recurring shortcomings identified by reviewers and suggestions made to authors about revising papers are organized using headings traditionally used in a research article—introduction and literature review, method, results, and discussion. Considerations stemming from the fact that data on marriages and families are produced largely through interviews also are addressed.

This study looked at the change in agonistic behaviors of hummingbirds (Family Trochilidae) with the reduction of an established food source at la Estación Biológica de Monteverde (1567m elevation), Costa Rica. There were three treatment periods: three feeders (ten days), one feeder (six days; reduction of food source), and three feeders (four days) between October 23 and November 14, 2005. The agonistic behaviors were the number of agonistic behaviors recorded, as well as the species composition of aggressors versus recipients. Herbivores of the Neotropics are generally highly selective in their foraging behavior. Cebus capucinus (Primates: Cebidae), an omnivore, has been observed tearing apart and chewing on the leaves of bromeliads in the Upper San Luis valley, Costa Rica. This study examines the use of bromeliads by Cebus capucinus. Specifically, I consider the role of plant size, leaf water content and toughness in determining which bromeliads and which leaves C. capucinus selects. Comparing intact to torn bromeliads based on size, this study determined that C. capucinus selects small- and medium-sized plants. Leaves in the intermediate position of the rosette were also …

The locations and densities of epiphytic orchids and bromeliads growing on host trees are influenced greatly by differences in epiphyte requirements for light, moisture and nutrients. Because these factors differ greatly between minimally and highly disturbed habitats, epiphytic composition may also be altered. This study examined changes in epiphytic orchid and bromeliad density between hosts in secondary forest and pasture. Fifteen trees in each habitat type were censused for the abundance of orchids and bromeliads in different parts of the trees. Brave New School: A Constitutional Argument Against State-Mandated Mental Health Assessments In Public Schools, Jennifer H. Gelman

Northern Illinois University Law Review

This comment examines the constitutionality of emotional health assessments in public schools. Despite the Supreme Court's recognition nearly a century ago that parents have a right to control the education of their children, American courts have grown increasingly hostile to parental interests in conflicts between parent and school. The author explores the possibility that the Court's reaffirmation of parental rights in Troxel v. Granville (2003) could be invoked in certain cases to reverse that trend. It is argued, in particular, that parental objections to school involvement in emotional health determinations ought to merit some form of heightened scrutiny.

Field-programmable analog arrays (FPAAs) providea method for rapidly prototyping analog systems. Currently available commercial and academic FPAAs are typically based on operational amplifiers (or other similar analog primitives) with only a few computational elements per chip. While their specific architectures vary, their small sizes and often restrictive interconnect designs leave current FPAAs limited in functionality and flexibility. For FPAAs to enter the realm of large-scale reconfigurable devices such as modern field-programmable gate arrays (FPGAs),new technologies must be explored to provide area-efficient accurately programmable analog circuitry that can be easily integrated into a larger digital/mixed-signal system. Researchers monitored the threatened plant, purple amole (Chlorogalum purpureum var. purpureum) at Fort Hunter Liggett, California, from 1998 to 2004. The objectives of this research were to complete a statistical analysis of these data to evaluate: (1) demographics; (2) trends in population density; and (3) the relationship of purple amole to associated species, biological soil crusts, and disturbance. Overall, purple amole was most likely to flower and have greater seed production when it attained about 8 leaves or widths of 7 to 8 mm for its widest leaf, revealing a clear relationship between plant size and successful reproduction and seed …

This study reports on a search for racial disparities in the value of baseball cards for Black and White members of the National Baseball Hall of Fame (HOF). The study’s sample of 51 players was derived from the population of the 96 players elected to the HOF since 1936 by the Baseball Writers of America. Although the authors found that race produced no statistical difference in Black and White players’ card values, they did observe that players’ career performance plus the availability of a player’s card (scarcity) exerted a significant effect on the value of cards.
