Mitochondrial Dna: Emerging Legal Issues, Edward K. Cheng

Vanderbilt Law School Faculty Publications

This article will briefly survey some of the current and emerging legal issues surrounding mtDNA evidence. Parts I and II discuss basic evidentiary questions, including mtDNA's reliability and admissibility under Daubert as well as the potential problem of jury confusion regarding the probative value of mtDNA. Part III considers the broader potential of mtDNA to supplant microscopic hair analysis, a technique often criticized for its subjectivity and high error rate. Finally, Part IV explores the unique privacy concerns raised by the maternal inheritance of mtDNA, specifically in the context of DNA databanks.

In [3] Jim Cushing and Shandelle Henson published two conjectures (see Section 3) related to the Beverton-Holt difference equation (with growth parameter exceeding one), which said that the B-H equation with periodically varying coefficients (a) will have a globally asymptotically stable periodic solution and (b) the average of the state variable along the periodic orbit will be strictly less than the average of the carrying capacities of the individual maps. They had previously [2] proved both statements for period 2.

This paper primarily explores the importance of the support group for people infected and affected by HIV+/AIDS. At St. Matthew’s Clinic in the rural area of Qoboqobo, I invited women between the ages of 25-49 to freely participate in the focus group discussions. I believe that the health care sector could benefit from these groups, both as formal outreach services and informal support networks. There is a lack of healthcare services in rural areas. Development of protocols for calibrating multibeam sonar by means of the standard-target method is documented. Particular systems used in the development work included three that provide the water-column signals, namely the SIMRAD SM2000/90- and 200-kHz sonars and RESON SeaBat 8101 sonar, with operating frequency of 240 kHz. Two facilities were instrumented specifically for the work: a sea well at the Woods Hole Oceanographic Institution and a large, indoor freshwater tank at the University of New Hampshire. Methods for measuring the transfer characteristics of each sonar, with transducers attached, are described and illustrated with measurement results. The principal results, however, are …

Two oceanographic cruises were conducted during September 2003 and March 2004 in the eastern half of the Cariaco Basin. Specific objectives were to examine the hydrography of the seasonal upwelling plume characteristic of this region, the spatial distribution of particles in the area, and to help determine the source and relative importance of in situ particle production vs. terrigenous particles delivered laterally from the coast.

During September 2003, average surface salinities within the basin were higher (36.6) relative to Caribbean Sea waters outside the basin (35.6). Salinity patterns indicated that the Orinoco and Amazon River plumes did not enter or …

Nurses describe patients as difficult on a regular basis. Nursing research to date has assumed the existence of this phenomenon. Most studies have listed descriptors of the difficult patient and offered interventions for nurses to use to alter patient behavior. Locating of difficulty within the individual and failure to consider the context of the nurse patient encounter is problematic. The practice of locating difficulty in the individual absolves organizations and society of responsibility to work to change factors that contribute to the construction of difficulty. The purpose of this comment is to provide a legal framework which supports the use of assassination as a preemptive instrument against terrorism. In doing so, this comment will: (1) offer a sensible definition for assassination and its relationship to war; (2) examine both the historical and political underpinnings of the current United States policy on assassination; and (3) review sources of international customary and treaty law to extrapolate guidelines for using assassination overseas in the War on Terror.

Under-Intervention Versus Over-Intervention, Elizabeth Bartholet

The article argues that the U.S. child protection system is characterized by under-intervention, failing to adequately protect children from abuse and neglect while also neglecting to provide sufficient support to families. The author advocates for a more interventionist approach, emphasizing both early support for families and the removal of children from dangerous environments when necessary. This stance contrasts with other countries, such as those adhering to the United Nations Convention on the Rights of the Child, which places greater responsibility on the state to protect children. Pancreatic islet transplantation represents an attractive approach for the treatment of diabetes. However, the limited availability of donor islets has largely hampered this approach. In this respect, the use of alternative sources of islets such as the ex vivo expansion and differentiation of functional endocrine cells for treating diabetes has become the major focus of diabetes research. Adult pancreatic stem cells /progenitor cells have yet to be recognized because limited markers exist for their identification. The regulation of expression of some enzymes involved in glucose homeostasis and fat metabolism requires both insulin and glucose to elicit an effect, while the regulation of others requires only one. Glucose-6-phosphate dehydrogenase (G6PDH), an important enzyme involved in glucose homeostasis, has been shown to be transcriptionally regulated by carbohydrate feeding in rat liver, a diet regime that increases the levels of both glucose and insulin. Our lab had previously shown that insulin induces expression of G6PDH, thus we wanted to determine if glucose also induced G6PDH expression and if so, are the glucose and insulin responses mediated through identical …

This dissertation project focused on pre-service elementary teachers' conceptions of the plant processes of photosynthesis and cellular respiration as being connected, occurring at multiple ecological levels, and working within "nested systems." Participants enrolled in a biology course designed for elementary education majors provided their views of the processes through a series of tasks with a peer, a semi-structured interview, and clarified both photosynthesisand plant cellular respiration directly following classroom instruction on the two topics. Gene expression data generated by DNA microarray experiments have provided a vast resource for medical diagnosis and disease understanding. Most prior work in analyzing gene expression data, however, focuses on predictive performance but not so much on deriving human understandable knowledge. This paper presents a systematic approach for learning and extracting rule-based knowledge from gene expression data. A class of predictive self-organizing networks known as Adaptive Resonance Associative Map (ARAM) is used for modelling gene expression data, whose learned knowledge can be transformed into a set of symbolic IF-THEN rules for interpretation. Jacobson v Massachusetts, a 1905 US Supreme Court decision, raised questions about the power of state government to protect the public’s health and the Constitution’s protection of personal liberty. We examined conceptions about state power and personal liberty in Jacobson and later cases that expanded, superseded, or even ignored those ideas.

Public health and constitutional law have evolved to better protect both health and human rights. States’ sovereign power to make laws of all kinds has not changed in the past century. What has changed is the Court’s recognition of the importance of individual liberty and how it limits …
