Emergencies And Democratic Failure, Eric A. Posner, Adrian Vermeule
Emergencies And Democratic Failure, Eric A. Posner, Adrian Vermeule
Public Law and Legal Theory Working Papers
Critics of emergency measures such as the U.S. government’s response to 9/11 invoke the Carolene Products framework, which directs courts to apply strict scrutiny to laws and executive actions that target political or ethnic minorities. The critics suggest that such laws and actions are usually the product of democratic failure, and are especially likely to be so during emergencies. However, the application of the Carolene Products framework to emergencies is questionable. Democratic failure is no more likely during emergencies than during normal times, and courts are in a worse position to correct democratic failures during emergencies than during normal times. …

Intergenerational Power Exchange Model: Meta-Analysis Of Male Batterers’ Intervention Programs, Suzanne Van Weelde
Dissertations
Domestic violence is an ongoing social problem. Many women have suffered from the abuse of spouses and boyfriends. A number of children have been victims, or witnesses of, this particular form of violence. The consequences of abuse are: preventable crimes, victims and witnesses becoming abusers themselves, escalating health and mental costs. Domestic violence has touched every community within the United States. It is not a social problem that sociological researchers can afford to minimize.
Sociological literature has documented the growth of the social problem of domestic violence. As a result of the awareness of domestic violence as a serious social …

Alchohol And Recognition Of Novel Faces: Does Alcohol Ingestion Increase The Rate Of False Identifications?, Brent M. King
Theses and Dissertations
The present study sought to investigate how alcohol, retention time, and presentation of stimuli lineups impact the rate of correct and incorrect identifications within an eyewitness recognition task. Sixty (60) male participants were divided into 4 different alcohol or placebo conditions. Two of the conditions are such that the participants were blind to what they were being given (alcohol or a placebo fruit drink). The final two conditions were such that the participants were either told falsely that they were receiving alcohol (misled placebo) or truthfully that they were only getting a fruit drink (informed placebo). Participants were shown 6 …

International Law: A Welfarist Approach, Eric A. Posner
International Law: A Welfarist Approach, Eric A. Posner
Coase-Sandor Institute for Law & Economics Research Paper Series
This paper evaluates international law from a welfarist perspective. Global welfarism requires that international law advance the well being of everyone in the world, and scholars influenced by global welfarism and similar cosmopolitan principles have advocated radical restructuring of international law. But global welfarism is subject to several constraints, including (1) heterogeneity of preferences of the world population, which produces the state system; (2) agency costs, which produce imperfect governments; and (3) the problem of collective action. These constraints place limits on what policies motivated by global welfarism can achieve, and explain some broad features of international law that otherwise …

Citizens Contacting The Police: The Dynamics Of Police-Citizen Interactions During Two Voluntary Contacts, Tracie L. Toscano
Student Work
The thesis investigates two types of citizen initiated contacts with the police using data from the Bureau of Justice, “Contacts Between Police And The Public: Findings From The 1999 National Survey.” The two types of contacts examined are citizens asking for assistance from the police and citizens reporting neighborhood problems to the police. It was hypothesized that there are differences between citizens calling the police during these two contacts by demographic variables income, gender, age, and race. The descriptive findings were that people with higher income, females, between the ages of 25-44, and Whites call the police more than citizens …

Characteristics Of Bipolar Disorder In Adult Favorite Weather Drawings, Carrie L. Elder
Characteristics Of Bipolar Disorder In Adult Favorite Weather Drawings, Carrie L. Elder
EVMS School of Health Professions Theses & Dissertations
The purpose of this study was to identify graphic indicators of Bipolar Disorder in Favorite Weather Drawings. The subjects in this study consisted of 9 individuals diagnosed with a Bipolar Disorder and 16 individuals without a Bipolar Disorder diagnosis. The age range was 22 to 64 years. It was hypothesized that Favorite Weather Drawings rendered by individuals diagnosed with Bipolar Disorder would differ in color, expansiveness, line quality, and weather themes from Favorite Weather Drawings rendered by individuals without a diagnosis of Bipolar Disorder. These differences were measured using a Favorite Weather Drawing Checklist and analyzed for resulting patterns.

Discretion And Criminal Law: The Good, The Bad, And The Mundane, George C. Thomas Iii
Discretion And Criminal Law: The Good, The Bad, And The Mundane, George C. Thomas Iii
Rutgers Law School (Newark) Faculty Papers
Most academic papers condemn discretion in the enforcement and prosecution of crime. This essay argues that discretion should be understood to come in three varieties: good discretion, which is beneficial; bad discretion, which is typified by acts motivated by race, sex, or class considerations; and mundane discretion, which is value-neutral. The decision to pursue a drunken driver rather than a speeder, for example, is a good use of discretion while the decision to pursue one speeder rather than another based on race is bad discretion. Most motives that prompt acts of discretion, however, are value-neutral or what I call “mundane” …

Time Travel, Hovercrafts, And The Framers: James Madison Sees The Future And Rewrites The Fourth Amendment, George C. Thomas Iii
Rutgers Law School (Newark) Faculty Papers
The Framers could not have contemplated the interpretational problems that cloud the Fourth Amendment because police, in the modern sense, were unknown to the Framers. Also unknown to the Framers, of course, were wiretaps, drug interdiction searches, thermal imagining, helicopters, and blood tests. We can infer from the history surrounding the Fourth Amendment what the Framers hoped it would accomplish in their time. What if the Framers could have seen the future and known the kind of police techniques that are being used today? What kind of Fourth Amendment would they have written with that knowledge? This article seeks to …
