Easing The Burden: Mediating Misdemeanor Criminal Complaints, Gabriel H. Teninbaum Oct 2005

Easing The Burden: Mediating Misdemeanor Criminal Complaints, Gabriel H. Teninbaum

ExpressO

Overburdened courts are causing critical breakdowns in the criminal justice system. However, some jurisdictions are developing creative programs to ease the burden on courts. This paper focuses on mediation programs by which courts divert criminal cases away from traditional prosecution and allow a victim-offender mediation to occur as an alternative to trials for alleged criminal acts. The new model is beginning to work: annually more than nine thousand cases are referred out of district courts by district attorneys and judges to dispute settlement centers; over seven thousand or more are resolved prior to possible court involvement, and mediation is helping …

The Transnational Judicial Discourse And Felon Disenfranchisement: Re-Examining The Textual Premise Of Richardson V. Ramirez, Jason G. Morgan-Foster Oct 2005

The Transnational Judicial Discourse And Felon Disenfranchisement: Re-Examining The Textual Premise Of Richardson V. Ramirez, Jason G. Morgan-Foster

ExpressO

This article is simultaneously an international comparative law piece about prisoner disenfranchisement in various countries, a transnational work of legal theory providing a framework for the use of foreign law in domestic constitutional courts, and a domestic analysis of the constitutional underpinnings of felon disenfranchisement.

The article begins with a comprehensive comparative analysis of the recent prisoner disenfranchisement decisions in Canada, South Africa, and Europe. It notes that the over-arching theme of these decisions is to view the acceptability of prisoner disenfranchisement along a continuum, where it becomes more acceptable the more serious the offense committed.

The article then examines …

Stories That Make The Law Free: Literature As A Bridge Between The Law And The Culture In Which It Must Exist, Christine Metteer Lorillard Oct 2005

Stories That Make The Law Free: Literature As A Bridge Between The Law And The Culture In Which It Must Exist, Christine Metteer Lorillard

Texas Wesleyan Law Review

In this paper, I will examine how literature, by telling stories and examining their meaning, allows us to make the law free, by seeing it in its cultural context. I take, as a specific example Barbara Kingsolver's novel, Pigs in Heaven, as it explores the cultural dialectic underlying application of the Indian Child Welfare Act.

The Rose Man Of Sing Sing: A True Tale Of Life, Murder, And Redemption In The Age Of Yellow Journalism, James M. Morris

History

Today, seventy-three years after his death, journalists still tell tales of Charles E. Chapin. As city editor of Pulitzer’s New York Evening World , Chapin was the model of the take-no-prisoners newsroom tyrant: he drove reporters relentlessly—and kept his paper in the center ring of the circus of big-city journalism. From the Harry K. Thaw trial to the sinking of the Titanic , Chapin set the pace for the evening press, the CNN of the pre-electronic world of journalism.

In 1918, at the pinnacle of fame, Chapin’s world collapsed. Facing financial ruin, sunk in depression, he decided to kill himself …

Narrative Jurisprudence And Trans-National Justice, Ian Ward Oct 2005

Narrative Jurisprudence And Trans-National Justice, Ian Ward

Texas Wesleyan Law Review

The purpose of this article is to explore this consonance in greater detail, and then to present two more particular examples of this narrative and poethic "strategy." The first example is given by two attempts to provide some kind of juristic redress for the various atrocities suffered across southeast Europe during the successive Balkan wars of the 1990s. The second approaches the broader, and no less contemporary, experience of trans-national terrorism. In the first instance, the form of narrative, on both occasions, is that of a chronicle-a piece of extended journalism. In the second instance, the narrative is a more …

Imperfect Order: Reflections Of The Law In Two Classic Children’S Novels, Thomas C. Klein Oct 2005

Imperfect Order: Reflections Of The Law In Two Classic Children’S Novels, Thomas C. Klein

Texas Wesleyan Law Review

Man-made law, or "positive" law, and its related legal institutions are represented in children's novels as complicated, sometimes corrupt, and often arbitrary structures that prevent the protagonists from reaching their desired goals or resolving their difficulties. Rather than presenting positive law and its related institutions as a means to resolve conflicts and provide repose to the characters, children's novels present such law and institutions as aggravating or prolonging conflict, and creating uncertainty about how the protagonist will extricate himself or herself from the legal predicament. Children's novels do not offer the child reader any known points of reference in the …

Atticus Finch, Boris A. Max, And The Lawyer's Dilemma, Robert Batey Oct 2005

Atticus Finch, Boris A. Max, And The Lawyer's Dilemma, Robert Batey

Texas Wesleyan Law Review

For as long as I have taught law and literature, I have held strong opinions about two fictional criminal defense attorneys, the world-famous Atticus Finch of the novel and film To Kill a Mockingbird' and the less celebrated Boris A. Max, Bigger Thomas's attorney in Richard Wright's Native Son.' Atticus and Max, both white, courageously defend black men charged with capital crimes by a racist legal system, both are vilified by the public, and both of them see their clients die at the hands of the state. But despite their courage, my opinion of each was that he failed his …

“Apparently, I Am A Pedophile:” Living And Coping As A Child-Lover In The Netherlands, Andrew Extein Oct 2005

“Apparently, I Am A Pedophile:” Living And Coping As A Child-Lover In The Netherlands, Andrew Extein

Independent Study Project (ISP) Collection

The term “pedophile” is among the most loaded and controversial in Western culture. In my study I seek to gain a better understanding of the men that would fall into the category of “pedophile,” a phrase that is more often than not misused and misrepresented by our society. To gain this insight I have interviewed six self-identified child-lovers or pedophiles about their life experiences with these feelings, how they came to realize their feelings, how they came to terms with their feelings, how they express their feelings, and how they cope with their feelings. The paper discusses and defines certain …
