Beyond Bandaids: A Proposal For Reconfiguring Federal Sentencing After Booker, Frank O. Bowman Iii Jan 2005

Beyond Bandaids: A Proposal For Reconfiguring Federal Sentencing After Booker, Frank O. Bowman Iii

Faculty Publications

This Article proposes a simplified sentencing table consisting of nine base sentencing ranges, each subdivided into three sub-ranges. The base sentencing range would be determined by combining offense facts found by a jury or admitted in a plea with the defendant's criminal history. A defendant's placement in the sub-ranges would be determined by post-conviction judicial findings of sentencing factors. No upward departures from the base sentencing range would be permissible, but defendants might be sentenced below the low end of the base sentencing range as a result of an acceptance of responsibility credit or due to a downward departure motion. …

Federalism And The Politics Of Sentencing, Rachel E. Barkow Jan 2005

Federalism And The Politics Of Sentencing, Rachel E. Barkow

Faculty Articles

The politics of sentencing over the past three decades have been one- sided. Voices in favor of tougher sentences dominate the legislative debate at the state and federal levels. Those advocating on behalf of sentencing reform or alternatives to incarceration garner little attention. Although there are various options for improving deliberation in light of this political imbalance, one mechanism appears to be having an impact in many jurisdictions: a focus on the direct costs of incarceration. There is evidence from the states that tight budgets and a corresponding concern with the rising costs of existing incarceration policies have prompted greater …

Ohio's Sex Offender Residency Restriction Law: Does It Protect The Health And Safety Of The State's Children Or Falsely Make People Believe So, Margaret Troia Jan 2005

Ohio's Sex Offender Residency Restriction Law: Does It Protect The Health And Safety Of The State's Children Or Falsely Make People Believe So, Margaret Troia

Journal of Law and Health

The fact of the matter is that residency laws often force all registered sex offenders to pay the price for a few high-profile cases and the public's fear and beliefs regarding sex offenders is often misguided and not well-founded. Sex offender residency laws may actually increase recidivism rates while placing unjustified burdens on sex offenders and their family members. Furthermore, because these laws target stranger perpetrators, they do not prevent the majority of sex crimes committed by acquaintances or family members of the victim. This results in parents being lulled into a false sense of security that their children are …

Violation Of Latino Civil Rights Resulting From Ins And Local Police's Use Of Race, Culture And Class Profiling: The Case Of The Chandler Roundup In Arizona, Mary Romero, Marwah Serag

Cleveland State Law Review

The case of the Chandler Roundup provides a unique window into law enforcement practices including the planning, staging and procedures employed in removing undocumented immigrants from a specific urban space. We begin with an overview of the Chandler Roundup and community protests resulting from the five-day immigration raid. This section provides a general outline of the five day raid, including incidents leading up to the joint operation, official investigations conducted and lawsuits filed. The basis of the lawsuits filed was that "individuals were stopped and interrogated by the Chandler Police Department based exclusively on the fact that their physical characteristics …

The Legal Presumption Of Reason: Noble Truth, Useful Fiction, Ignoble Lie, Ngaire Naffine Jan 2005

The Legal Presumption Of Reason: Noble Truth, Useful Fiction, Ignoble Lie, Ngaire Naffine

Cleveland State Law Review

In criminal law theory and doctrine there appear to be several competing assumptions about the sort of people that we are. My task in this paper is, first, to expound and compare what I see as the three prevailing theories of our rational natures to be found in criminal law theory, doctrine and procedure. Second, I will consider the relation between these theories of our rational natures and the actual practices of the criminal courts. And third, in the course of so doing, I will consider the beneficiaries and casualties of this criminal law theory and practical justice.

Differentiating Types Of Domestic Violence: Implications For Child Custody, Nancy Ver Steegh

Faculty Scholarship

This article examines child custody determinations through the lens of a domestic violence typology. The resulting analysis (1) reconciles competing viewpoints and contradictory evidence about domestic violence; (2) matches families with appropriate child custody court procedures and services such as parent education, mediation, supervised visitation and parent coordination; and (3) exposes serious deficiencies in current domestic violence childcustody statutes.

Crime Prevention Through Environmental Design: Crime Free Multi Housing In Arlington, Texas, David Joseph Jusiewicz Jan 2005

Crime Prevention Through Environmental Design: Crime Free Multi Housing In Arlington, Texas, David Joseph Jusiewicz

Criminology & Criminal Justice Theses - Archive

The purpose of this study is to measure and compare calls for service at the apartment communities participating in the Crime Free Multi-Housing Program in the belief that a reduction in calls for service should translate to a reduction in crime. The review of the existing data is a cross-sectional, pre/post study of secondary data using calls for service. This method is preferred as it will represent the actual number of calls handled at each surveyed apartment community. Therefore, the conclusions provided with this data are not based on a complex statistical manipulation rather it provides a snap shot and …
