Individual, Neighborhood, And Situational Factors Associated With Violent Victimization And Offending, Jerry K. Daday, Lisa M. Broidy, Cameron S. Crandall, David P. Sklar

Sociology Faculty Publications

The criminological literature presents substantial evidence that victims and offenders in violent crimes share demographic characteristics, engage in similar lifestyles and activities, and reside in socially disorganized neighborhoods. However, research has examined these relationships separately using either victimization or offending data, and prior studies have not examined these relationships by comparing victims and offenders within the same incidents. This limits the effect of examining whether these factors are associated with victimization and offending in similar or distinct ways. Using a law enforcement database of victims (n = 1,248) and offenders (n = 1,735) involved within the same aggravated battery incidents …

An Interdisciplinary Comparison Of Master's Thesis Abstracts, Patricia Belle Chance

Theses Digitization Project

Explores different ways that organizational moves and other discourse elements such as hedging are reflected in graduate student research abstracts for theses, dissertations and research articles. Master's thesis abstracts from five disciplines at California State University, San Bernardino were analyzed. Rhetorical conventions in these texts that reflect the epistemological and social expectations of the writers' academic communities were explored. Results indicate that these abstracts use a variety of hedging patterns and many of the moves that have been described for published research articles.

Civil Aiding And Abetting Liability, Nathan I. Combs Jan 2005

Civil Aiding And Abetting Liability, Nathan I. Combs

Vanderbilt Law Review

Criminal liability for aiding and abetting constitutes an ancient doctrine of criminal law. Commentators describing English law at the beginning of the fourteenth century recognized that "the law of homicide is quite wide enough to comprise . . . those who have 'procured, counseled, commanded or abetted' the felony.. .for it is colloquially said that he sufficiently kills who advises." In 1909, Congress enacted a general aiding and abetting statute applicable to all federal criminal offenses.

Civil liability for aiding and abetting, however, represents a very underdeveloped theory within common law tort. Courts have stated, seemingly in jest, that precedents …

The Effects Of Family Size On The Development Of Delinquency, Tasha Deleeuw Gilbert

Theses Digitization Project

This proposed study used a pre-existing data set, which is a longitudinal study of children born between 1959 to 1962. Theses Digitization Project

This research looks to identify precursors to women becoming involved in trafficking for prostitution and/or sexual services in the United States. The failure to find patterns or trends regarding why women are trafficked or what types of women are trafficked most often, helps dispel some myths regarding the stereotypical victim of trafficking.

The Role Of Prosecutors In Serving Justice After Convictions, Fred C. Zacharias Jan 2005

The Role Of Prosecutors In Serving Justice After Convictions, Fred C. Zacharias

Vanderbilt Law Review

It is an old saw that prosecutors have both an ethical and a legal obligation to "do justice." The contours of that obligation, however, are not well defined. This Article addresses one particularly neglected aspect of the obligation: prosecutors' ethical duty to serve justice after convictions are complete. Prosecutorial justice issues seem to arise less frequently after conviction than at trial. Prosecutorial discretion is at its height in the postconviction context because legislators and professional code drafters have not focused on postconviction issues. Freed from binding legal constraints, prosecutors have avoided deep consideration of how their general obligation to serve …

Combating Social Differences Within Institutions: The Need For A Curriculum Based On Social Awareness In Our Schools, Robert Abrams Jan 2005

Combating Social Differences Within Institutions: The Need For A Curriculum Based On Social Awareness In Our Schools, Robert Abrams

Theses Digitization Project

To combat social, economic and racial inequality in the United States, the author advocates for 'social awareness' education to be built into the curriculum of the public school system. The purpose of the curriculum is to create a society that respects people and recognizes each individual's worth regardless of gender, socio-economic status, race, ethnicity, age, cultural confines, or religious beliefs. The author suggests a course of action on how to institute a social awareness course into the public school curriculum.

Mimosa 2005, Jacksonville State University

JSU Yearbooks

The JSU Yearbook Collection spans the years from 1926 to the present. The publication began in 1926 as the Teacola (some volumes spelled "Teacoala") and continued under this title through 1933. The yearbook appears to have ceased printing after that year; the student newspaper took the name Teacola (later changed to the Collegian and finally the Chanticleer) and began publication in 1934. The yearbook started up again in 1947 under the name Mimosa. The Library holds all volume years that were printed: 1926-1933, 1947-1950, 1952-present.

Rethinking The Involuntary Confession Rule: Toward A Workable Test For Identifying Compelled Self-Incrimination, Mark A. Godsey Jan 2005

Rethinking The Involuntary Confession Rule: Toward A Workable Test For Identifying Compelled Self-Incrimination, Mark A. Godsey

Faculty Articles and Other Publications

For more than a century, the Supreme Court has interpreted the Bill of Rights as prohibiting the police from obtaining involuntary confessions from suspects through the use of coercion. If asked whether this involuntary confession rule is an understandable and workable doctrine, however, a noticeable percentage of judges, prosecutors, police officers, criminal defense attorneys and law professors would answer with an unequivocal no.

Basic questions concerning voluntariness and free will - whether it exists, and if so, when it exists, etc. - have puzzled philosophers for centuries and represent one of history's Gordian knots. Not surprisingly, judges have fared no …
