Discourse Of Disobedience: Law, Political Philosophy, And Trials Of Conscientious Objectors, Hadar Aviram
Discourse Of Disobedience: Law, Political Philosophy, And Trials Of Conscientious Objectors, Hadar Aviram
ExpressO
This Article examines the way legal systems respond to social problems through a discursive analysis of a unique and timely issue: conscientious objection to military service based on political and ideological grounds. It explores how legal systems, conducting criminal justice procedures under conditions of warfare and dissent, attempt to maintain balance between addressing the extra-legal challenges presented to them through conscientious objection, and preserving the prevalence of legal inner logic, classification and interpretation.
As opposed to the jurisprudential and philosophical literature about conscientious objection, this Article approaches the issue through an empirical analysis of legal and judicial discourse in a …

Trial Distortion And The End Of Innocence In Federal Criminal Justice, Ronald F. Wright
Trial Distortion And The End Of Innocence In Federal Criminal Justice, Ronald F. Wright
ExpressO
This article starts with a troubling and unnoticed development in federal criminal justice: acquittals have virtually disappeared from the system in the last 15 years, and for all the wrong reasons. It seems likely that prosecutors have increased the “trial penalty” so much that defendants with meaningful defenses feel compelled to plead guilty, undermining the truth-finding function of the criminal process.
The article examines these federal developments in light of a proposed “trial distortion theory.” The theory I develop here evaluates the quality of plea negotiation practices in a jurisdiction by asking whether the system produces outcomes (convictions, acquittals and …
Deterrence And Crime Results, Marcelo Ferrante
Deterrence And Crime Results, Marcelo Ferrante
ExpressO
This article offers a comprehensive study of the merits of the legal practice of punishing accomplished crimes more severely than attempted crimes all other things being equal (Differential Punishment) vis-à-vis the alternative of punishing them with equal sanctions (Equal Punishment). Unlike the overwhelming majority of the literature on the issue—which focuses on which practice better mirrors the offenders’ relative moral deserts—the article evaluates both practices from a consequentialist, deterrence-based point of view. In particular, it shows first that traditional economic theories of the criminal law should yield the conclusion that differential punishment is not superior to equal punishment. The few …
The Deep Structure Of Law And Morality, Robin B. Kar
The Deep Structure Of Law And Morality, Robin B. Kar
ExpressO
This Article argues that morality and law share a deep and pervasive structure, an analogue of what Noam Chomsky calls the “deep structure” of language. This structure arises not to resolve linguistic problems of generativity, but rather from the fact that morality and law engage psychological adaptations with the same natural function: to allow us to resolve social contract problems flexibly. Drawing on and extending a number of contemporary insights from evolutionary psychology and evolutionary game theory, this Article argues that we resolve these problems by employing a particular class of psychological attitudes, which are neither simply belief-like states nor …

Adr: The New Equity, Thomas O. Main
Adr: The New Equity, Thomas O. Main
ExpressO
This article joins an important conversation about the proper role of alternative dispute resolution (“ADR”) in the administration of civil justice. Both ADR and formal adjudication are being reconceptualized as ADR matures into an alternative system, and as ADR methods and methodology are incorporated into formal adjudication. Professor Main invokes the history of Equity, another “alternative” system, to inform our understanding of the forms and limits of ADR. He envisions ADR and formal adjudication as dual systems of dispute resolution, and uses the Equity analogue as a template to develop a theory of ADR.
