Hijacked Justice: Domestic Appropriation Of International Norms, Jelena Subotić
Hijacked Justice: Domestic Appropriation Of International Norms, Jelena Subotić
Human Rights & Human Welfare
This paper explores the domestic politics of international norm diffusion, using the global transmission of transitional justice norms as the empirical context of the research. Applying sociological institutionalism as the principal theoretical framework, I argue that the motivation of states to adopt international models of transitional justice has changed over time. The transitional justice norm - that posits that war crimes and massive human rights abuses must be dealt with in a proper legal setting and not through “victors’ justice” or impunity - was institutionalized in large part as the result of a strong domestic demand for transitional justice in …

Reports Of Batson's Death Have Been Greatly Exaggerated: How The Batson Doctrine Enforces A Normative Framework Of Legal Ethics, Laura I. Appleman
Reports Of Batson's Death Have Been Greatly Exaggerated: How The Batson Doctrine Enforces A Normative Framework Of Legal Ethics, Laura I. Appleman
ExpressO
In this article, I aim to explain how the Batson procedure enforces a normative framework of legal ethics, a theory which I hope will be of use to both criminal law professors and scholars of legal ethics. Despite many recent prudential attacks against the Batson procedure and the peremptory challenge, I contend that Batson has a largely unarticulated ethical component, one that invokes a lawyer’s professional responsibility. Accordingly, using legal ethics as a lens through which to interpret Batson sheds new light on the doctrine. Batson’s ethical imperative affects the norms of the legal profession itself. By fostering a non-discrimination …
The Growth Of The Commerce Clause As Mechanism Of Control, Paul R. Rickert
The Growth Of The Commerce Clause As Mechanism Of Control, Paul R. Rickert
Faculty Publications and Presentations
Article 1, Section 8, clause 3 of the United States Constitution states that “Congress shall have the power… To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes”. This short and simple statement has been progressively used, in combination with a few other powers both granted and assumed by various federal actors, to take greater and broader powers over the states and private citizenry. The original judicial understanding of the so-called Commerce Clause (differentiated from original intent) comes from the 1824 case of Gibbons v. Ogden, 22 U.S. 1. Through subsequent cases, the judicial …
