Organizational Misconduct: Beyond The Principal-Agent Model, Kimberly D. Krawiec Feb 2005

Organizational Misconduct: Beyond The Principal-Agent Model, Kimberly D. Krawiec

ExpressO

This article demonstrates that, at least since the adoption of the Organizational Sentencing Guidelines in 1991, the United States legal regime has been moving away from a system of strict vicarious liability toward a system of duty-based organizational liability. Under this system, organizational liability for agent misconduct is dependant on whether or not the organization has exercised due care to avoid the harm in question, rather than under traditional agency principles of respondeat superior. Courts and agencies typically evaluate the level of care exercised by the organization by inquiring whether the organization had in place internal compliance structures ostensibly designed …

Apparent Soil Electrical Conductivity: Applications For Designing And Evaluating Field-Scale Experiments, C. K. Johnson, Kent M. Eskridge, D. L. Corwin Feb 2005

Apparent Soil Electrical Conductivity: Applications For Designing And Evaluating Field-Scale Experiments, C. K. Johnson, Kent M. Eskridge, D. L. Corwin

School of Natural Resources: Faculty Publications

On-farm field-scale research has become increasingly common with the advent of new technologies. While promoting a realistic systems perspective, field-scale experiments do not lend themselves to the traditional design concepts of replication and blocking. Previously, a farm-scale dryland experiment in northeastern Colorado was conducted to evaluate apparent electrical conductivity (ECa) classification (within-field blocking) as a basis for estimating plot-scale experimental error. Comparison of meansquare (MS) errors for several soil properties and surface residue mass measured at this site, with those from a nearby plot-scale experiment, revealed that ECa-classified within-field variance approximates plot-scale experimental error. In the …

Charismatic Leadership And Conductors: Can Charisma Be Learned?, Douglas J. Miller Feb 2005

Charismatic Leadership And Conductors: Can Charisma Be Learned?, Douglas J. Miller

Theses and Graduate Projects

This study will use a current charismatic leadership model to determine if the unique characteristics of three famous orchestral conductors can lend insight into improving the efficacy of all musical conductors. The charismatic elements of each conductor's leadership will be examined and compared to the charismatic leadership model. The results of this comparison will be used to recommend areas for augmenting the educational curriculum for the development of greater charisma in young conductors.

A Study Investigating The College Choice Process Of Selected Freshmen Minority Undergraduate Students At Rowan University, Philip K. Oware

Theses and Dissertations

The purpose of the study was to investigate the college choice process of selected freshmen minority undergraduate students at Rowan University. Convenience sampling was used to select 66 minority freshmen undergraduate students. Data were collected using a questionnaire consisting of 29 items. Descriptive analysis employed included frequency distribution and calculation of mean and the corresponding dispersion (standard deviation) where applicable. The relationship between each item/statement and the attitude dimension variable according to the responses of all the students was established using Spearman Correlation. Eighty-four percent of the subjects strongly agreed or agreed that the financial aid they received was opportunity …

Infant Mortality And Financial Stability, Rene L. Ashman Feb 2005

Infant Mortality And Financial Stability, Rene L. Ashman

Honors College Class Research Papers

Over four million newborn babies are encased in caskets and laid to rest in the world each year (Lawn 399). The comparison of infant mortality rates in the urban areas of Atlanta, Georgia and White Plains, New York shows the real cause of infant mortality: a lack of prenatal care due to inadequate financial income or assistance. With the establishment of free access to prenatal healthcare through organizations such as Children’s Healthcare of Atlanta, underprivileged mothers incapable of affording their prenatal expenses, can benefit along with their infants. This study represents a start in a move toward preserving the future …

Victims And Perpetrators: An Argument For Comparative Liability In Criminal Law, Vera Bergelson Feb 2005

Victims And Perpetrators: An Argument For Comparative Liability In Criminal Law, Vera Bergelson

Rutgers Law School (Newark) Faculty Papers

This article challenges the legal rule according to which the victim’s conduct is irrelevant to the determination of the perpetrator’s criminal liability. The author attacks this rule from both positive and normative perspectives, and argues that criminal law should incorporate an affirmative defense of comparative liability. This defense would fully or partially exculpate the defendant if the victim by his own acts has lost or reduced his right not to be harmed.

Part I tests the descriptive accuracy of the proposition that the perpetrator’s liability does not depend on the conduct of the victim. Criminological and victimological studies strongly suggest …
