A Process Of Restoration For Clergy Guilty Of Sexual Misconduct, Carol Hutchinson May 2005

A Process Of Restoration For Clergy Guilty Of Sexual Misconduct, Carol Hutchinson

Faculty Publications - George Fox Digital

Sexual misconduct on the part of clergy is not a new phenomenon. Nevertheless the Church in general lacks a concept of restoration that provides spiritual and emotional healing of an offender within the context of the redemptive community of faith. This dissertation is intended to demonstrate how Scripture, church history, theology and psychology support restoration of fallen clergy. The dissertation will go on then to describe what a process of restoration would include.

The dissertation begins and ends with case studies. Both cases deal with actual events though names and some details have been changed. The first case demonstrates some …

Reliability And Validity Of The Dallas Threat Of Violence Risk Assessment, Russell B. Van Dyke May 2005

Reliability And Validity Of The Dallas Threat Of Violence Risk Assessment, Russell B. Van Dyke

All-Inclusive List of Electronic Theses and Dissertations

Several high-profile, multiple-victim school shootings between 1996 and 1999 dramatically shook the public's perception of the safety of our schools. In response to public concern, the Dallas Independent School District (DISD) developed a district-wide policy for responding to threats of violence and implemented the Dallas Threat of Violence Risk Assessment (DTVRA). The DTVRA is designed to help school personnel assess the likelihood of a student following through with a threat and to provide guidance for appropriate interventions for students who threaten violence. The purpose of this study was to evaluate the inter-rater reliability and construct-related validity of the DTVRA. Ratings …

Rebooting Cybertort Law, Michael L. Rustad, Thomas H. Koenig May 2005

Rebooting Cybertort Law, Michael L. Rustad, Thomas H. Koenig

Washington Law Review

Cyberspace provides an ideal legal environment for tortfeasors and online criminals because Internet Service Providers (ISPs) have no duty to mitigate harms caused by ongoing torts, crimes, and infringing acts. Courts have stretched Congress's express language in § 230 of the Communications Decency Act from the narrow purpose of immunizing ISPs as publishers to the expanded purpose of shielding them from all tort liability. This Article proposes imposing a limited duty of care on ISPs to remove or block ongoing tortious activities on their services when they have been given actual notice. This reform will harmonize American ISP liability law …

A New Progressivism, Cass R. Sunstein May 2005

A New Progressivism, Cass R. Sunstein

Coase-Sandor Institute for Law & Economics Research Paper Series

Based on an address for a conference on Law and Transformation in South Africa, this paper explores problems with two twentieth-century approaches to government: the way of markets and the way of planning. It urge that the New Progressivism simultaneously offers (1) a distinctive conception of government’s appropriate means, an outgrowth of the late-twentieth-century critique of economic planning, and (2) a distinctive understanding of government’s appropriate ends, an outgrowth of evident failures with market arrangements and largely a product of the mid-twentieth-century critique of laissez faire. It emphasizes the need to replace bans and commands with appropriate incentives, and to …

Fair Housing Enforcement And Changes In Discrimination Between 1989 And 2000: An Exploratory Study, Stephen L. Ross, George C. Galster May 2005

Fair Housing Enforcement And Changes In Discrimination Between 1989 And 2000: An Exploratory Study, Stephen L. Ross, George C. Galster

Economics Working Papers

Using paired testing data from the 1989 and 2000 Housing Discrimination Studies (HDS) and data on fair housing enforcement activities during the 1990s in the corresponding metro areas, we investigate whether 1989-2000 changes in the metropolitan incidence of racial/ethnic discrimination correlate with fair housing enforcement activity during the 1990s. We found that higher amounts of state and local enforcement activity supported by HUD through its FHIP and FHAP programs (especially the amount of dollars awarded by the courts) were consistently associated with greater declines in discrimination against black apartment-seekers and home-seekers. The evidence does not support similar conclusions for housing …

Bias Of The Cox Model Hazard Ratio, Inger Persson, Harry Khamis

Journal of Modern Applied Statistical Methods

The hazard ratio estimated with the Cox model is investigated under proportional and five forms of nonproportional hazards. Results indicate that the highest bias occurs for diverging hazards with early censoring, and for increasing and crossing hazards under a high censoring rate.

The Shadow Of Professor Kingsfield: Contemporary Dilemmas Facing Women Law Professors, Martha Chamallas May 2005

The Shadow Of Professor Kingsfield: Contemporary Dilemmas Facing Women Law Professors, Martha Chamallas

The Ohio State University Moritz College of Law Working Paper Series

This essay discusses the predicament of women law professors in an era when the representation of women on law faculties has reached a “critical mass.” It explores three mechanisms for reproducing gender inequality: (1) self-fulfilling stereotypes, (2) gender-specific comparison groups, and (3) the accumulation of small disadvantages. Chamallas uses stories from her own and colleagues’ experiences to illustrate contemporary forms of bias.

Regression By Data Segments Via Discriminant Analysis, Stan Lipovetsky, Michael Conklin May 2005

Regression By Data Segments Via Discriminant Analysis, Stan Lipovetsky, Michael Conklin

Journal of Modern Applied Statistical Methods

It is known that two-group linear discriminant function can be constructed via binary regression. In this article, it is shown that the opposite relation is also relevant – it is possible to present multiple regression as a linear combination of a main part, based on the pooled variance, and Fisher discriminators by data segments. Presenting regression as an aggregate of the discriminators allows one to decompose coefficients of the model into sum of several vectors related to segments. Using this technique provides an understanding of how the total regression model is composed of the regressions by the segments with possible …

How School Counselors Gain Support To Implement Comprehensive Guidance And Counseling Programs, Jo Ann Grant Edd May 2005

How School Counselors Gain Support To Implement Comprehensive Guidance And Counseling Programs, Jo Ann Grant Edd

Dissertations

The school counseling field is evolving from a focus on ancillary activities to a commitment to comprehensive guidance and counseling programs. Understanding strategies school counselors have used in gaining support from key stakeholders to implement comprehensive guidance and counseling programs can be a valuable addition to the literature of school counseling. The present study investigated how elementary and secondary school counselors gained support when implementing comprehensive guidance and counseling programs based on the National Standards for School Counseling Programs. A qualitative methodology was used in the study. The findings revealed that: (a) counselors studied believed their role in gaining support …

An Examination Of The Media's Framing Of The Illegal Street Racing Issue, Kevin Andrew Igasaki Edd May 2005

An Examination Of The Media's Framing Of The Illegal Street Racing Issue, Kevin Andrew Igasaki Edd

Dissertations

For the last sixty years, the legal community and public policymakers have assumed that illegal street racing has appealed to a single portion of the driving population—young adults driving modified vehicles. However, this assumption has been based solely on anecdotal information and has never been empirically investigated in the literature. To remedy this situation, this mixed methodology study examined whether this narrow framing of the illegal street racing issue was present in two southern California newspapers and two nationally circulated magazines over a three-year time period. Specifically, this study examined the way in which this issue was framed in daily …

Police Alcohol-Related Services Study (Pass), Phase Ii: A Description Of The Beliefs, Perceptions And Attitudes Of Anchorage Police Department Employees, Brad A. Myrstol, Robert H. Langworthy

Reports

The principal aim of the Police Alcohol-related Services Study (PASS) was to expand knowledge about the fiscal, organizational, and cultural impact of citizen alcohol use on the Anchorage Police Department (APD). Phase II of the study employed a voluntary, self-administered questionnaire provided to all members of the APD regardless of rank, sworn status, or operational division. The questionnaire was designed to explore respondents' perceptions of their alcohol-related workload; perceptions of community problems; perceived links between alcohol use and selected social problems; attitudes, perceptions, and beliefs about the policing of alcohol-related incidents and the people involved with them; and personal and …

Racial Profiling: National Legislation Policy Analysis, Latasha Chaffin May 2005

Racial Profiling: National Legislation Policy Analysis, Latasha Chaffin

SPNA Review

Racial profiling was traditionally viewed as an issue that primarily affected African-Americans and Latino Americans. After September 11th the issue of racial profiling has expanded to more directly affect Central and South Asian Americans, Arab Americans, Muslim Americans, members of other communities perceived to originate from the Middle East and immigrants and Americans of foreign descent. These communities are joining with African-American and Latino communities to support national racial profiling legislation on a broader level, not just in traffic stops, but in regulation of all interaction with law enforcement including at airports. The national racial profiling legislation debate presents three …

Selling Mediation: Mimetic, Distancing, And Appellating Practices In The Marketing Of An Emerging Profession, Andrew Woolford, R. S. Ratner May 2005

Selling Mediation: Mimetic, Distancing, And Appellating Practices In The Marketing Of An Emerging Profession, Andrew Woolford, R. S. Ratner

Peace and Conflict Studies

Individuals both within and outside the legal profession have been drawn by the ‘promise’ of mediation. In it they see a means for facilitating communicative exchanges between actors in conflict, which they view as a dramatic improvement on the adversarial practices of the formal legal system. However, despite the appeal of mediation to potential practitioners, there is not yet sufficient consumer demand to sustain the number of people who possess mediation skills. This has resulted in an overcrowded mediation market in which practitioners are forced to market themselves so as to compete for a limited clientele. In this context, the …
