Who Needs Freedom Of Religion?, James W. Nickel Jan 2005

Who Needs Freedom Of Religion?, James W. Nickel

University of Colorado Law Review

This article proposes that we view freedom of religion as a specific application area of more general basic liberties such as freedoms of thought, expression, association, assembly, movement, privacy, political participation, and economic activity. Separate enumeration of freedom of religion in national and international bills of rights may be useful, but it is not indispensable. In this respect freedom of religion is more like scientific freedom or artistic freedom than like freedom of expression. Recognizing that separate enumeration of freedom of religion is dispensable has salutary consequences for how we conceive and justify freedom as it applies to religion. First, …

The Intention/Foresight Distinction In The Doctrine Of Double Effect: From Theoretical Impasses And Double-Think To Practical Applications In Bioethics, Mitchell R. Thomas, Iii Jan 2005

The Intention/Foresight Distinction In The Doctrine Of Double Effect: From Theoretical Impasses And Double-Think To Practical Applications In Bioethics, Mitchell R. Thomas, Iii

LSU Master's Theses

The purpose of this paper is to address the doubts that surround the intention/foresight distinction of the Doctrine of Double Effect (DDE). The claim is made by some that this distinction is merely a semantic one or if real, it is morally irrelevant. It will be argued that this is the result of doubts that surround the contributions of theory in applied ethics and the double think that sometimes results from the misuse of the DDE. I will argue that the intention/foresight distinction in the DDE is a real one and can be made on the level of practice, without …

Aquinas And The Knowledge Of God, Casey Edler Jan 2005

Aquinas And The Knowledge Of God, Casey Edler

LSU Master's Theses

This thesis concerns the introduction of mystical knowledge into a debate about God that relies on scientific evidence. The thesis focuses in particular on the relevance of Thomas Aquinas' view of mystical experience. After first presenting Aquinas' theory of rapture as an anticipation of the beatific vision and distinguishing it from other ways of knowing God, I argue that such a theory convincingly renders mystical knowledge inadmissible into a debate about God that relies on scientific evidence, owing to one's inability to either remember or communicate such an experience. As a result, introducing mystical knowledge into the debate causes the …

Monasticism In Anglo-Saxon England: An Analysis Of Selected Hagiography From Northumbria Written In The Years After The Council Of Whitby, Carrie Couvillon Jan 2005

Monasticism In Anglo-Saxon England: An Analysis Of Selected Hagiography From Northumbria Written In The Years After The Council Of Whitby, Carrie Couvillon

LSU Master's Theses

Hagiography, writings about saints, was generally a means of venerating a saint's life. An author of hagiography wrote to advance his own salvation as well as to educate his audience on the proper practice of Christianity. Anglo-Saxon hagiography written in the years after the Council of Whitby in 664, however, also showed more support for the Roman tradition as opposed to Celtic Christianity. In an era when Christians in England were divided both culturally and religiously, unification under a single tradition as the one true representative of the faith was essential. This paper is an analysis of four important hagiographical …

A Property Rights Approach To Sacred Sites Cases: Asserting A Place For Indians As Nonowners, Kristen A. Carpenter Jan 2005

A Property Rights Approach To Sacred Sites Cases: Asserting A Place For Indians As Nonowners, Kristen A. Carpenter

Publications

Although the Free Exercise Clause prohibits governmental interference with religion, American Indians have been unsuccessful in challenging government actions that harm tribal sacred sites located on federal public lands. The First Amendment dimensions of these cases have been well studied by scholars, but this Article contends that it is also important to analyze them through a property law lens. Indeed, the Supreme Court has treated the federal government's ownership of public lands as a basis for denying Indian religious freedoms claims. This Article contends that such holdings rely on an "ownership model" of property law wherein the rights of the …

Developing A Strategy For Growth In The Seventh-Day Adventist Church In Finland Using The Natural Church Development Approach Based On A Case Study In The Turku Seventh-Day Adventist Church, Aimo Helminen Jan 2005

Developing A Strategy For Growth In The Seventh-Day Adventist Church In Finland Using The Natural Church Development Approach Based On A Case Study In The Turku Seventh-Day Adventist Church, Aimo Helminen

Doctor of Ministry Projects

Problem

The growth of the Adventist Church in Finland stagnated in the mid 1980s and after that the membership of the church began to slowly decrease. There is a need to look at the past growth patterns of the church in Finland to discover the reasons for the present decline in membership and develop and implement a strategy for church growth.

Method

Current literature was reviewed, including books and articles on the principles and strategies of church growth. These were studied in the context of the Turku Church in order to determine if the principles in the Natural Church Development …

Restoring Fallen Pastors: A Study On Restoring And Reinstating Clergy Who Have Been Involved In Sexual Misconduct, David Lawrence Bissell Jan 2005

Restoring Fallen Pastors: A Study On Restoring And Reinstating Clergy Who Have Been Involved In Sexual Misconduct, David Lawrence Bissell

Doctor of Ministry Projects

Problem. Research among Evangelicals and Seventh-day Adventists shows that approximately 12 percent of pastors commit adultery while in the ministry. What happens to an Adventist pastor who commits adultery? The North American Division policies are straightforward. An adulterous pastor should lose his credentials and ordination, be disfellowshipped, and never be rehired by any church entity. However, administrative practices are not consistent with church guidelines. Often a fallen pastor is moved to another district without a lapse in the service record. Some are restored to ministry after having had a time out. This apparent discrepancy may be due to eroding standards …

The Process And Adaptation Of The Ministries Of The Wausau Seventh-Day Adventist Church In The Postmodern Matrix To Those Born After 1964, William Shelby Bossert Jan 2005

The Process And Adaptation Of The Ministries Of The Wausau Seventh-Day Adventist Church In The Postmodern Matrix To Those Born After 1964, William Shelby Bossert

Doctor of Ministry Projects

Problem. It was apparent to many of the Wausau Seventh-day Adventist Church members, as well as the pastor, that there was an apparent lack or minimal level of participation of young adults (ages 17-35) in the life of the church. It was the strong desire of the pastor and many of the members of the congregation to be inclusive of young adults, provide ministries for and by them, and to foster an environment for them to he able to grow in a deeper relationship with Jesus. It was evident that the current practice and ministry levels at the church were …

Resurrection Research From 1975 To The Present: What Are Critical Scholars Saying?, Gary R. Habermas Jan 2005

Resurrection Research From 1975 To The Present: What Are Critical Scholars Saying?, Gary R. Habermas

SOR Faculty Publications and Presentations

An overview of resurrection research in Europe and North America during the last 30 years indicates some expected as well as some surprising trends. This study highlights six of these major research areas. The works of two representative scholars, J.D. Crossan and N.T. Wright, provide interpretive angles on these subjects. The article concludes with some comments on what is taken to be the single most crucial development at present, that after Jesus' death his followers had experiences that they thought were appearances of the risen Jesus. These early Christian experiences need to be explained viably.

The "Privilege Of Speech" In A "Pleasantly Authoritarian Country", Hans C. Clausen Jan 2005

The "Privilege Of Speech" In A "Pleasantly Authoritarian Country", Hans C. Clausen

Vanderbilt Journal of Transnational Law

Giving credence to Alexis de Tocqueville's argument that in democratic societies the love of equality is greater than the love of freedom is a recently emerging trend among Western nations to legally proscribe speech critical of homosexuality. Such laws, in various forms, now exist in a large and growing minority of countries in Europe and North America. The goal of these laws is much grander than preventing discrimination against homosexuals; rather, the objective is seemingly to promote the social acceptance of gay and lesbian lifestyles. These laws provide for civil remedies and in some instances even criminal sanctions for speech …

The Kinderhook Plates, The Tucson Artifacts, And Mormon Archeological Zeal, J. Michael Hunter Jan 2005

The Kinderhook Plates, The Tucson Artifacts, And Mormon Archeological Zeal, J. Michael Hunter

Faculty Publications

“The Kinderhook Plates, the Tucson Artifacts, and Mormon Archeological Zeal” discusses Mormon archeological zeal, or the short-sighted enthusiasm shown by members of The Church of Jesus Christ of Latter-day Saints (LDS Church) regarding relics or artifacts that might "prove" the veracity of the Book of Mormon or even of the LDS Church. This article summarizes the history of both the Kinderhook Plates and the Tucson Artifacts within this context, stating that the Kinderhook Plates have been proven fraudulent but that the Tucson Artifacts still provide mystery to researchers. The Kinderhook Plates were created by three conspirators who lived in Kinderhook, …

A Comparison Of Character Education Programs And Their Effects On Academic Achievement, Behavior, And Attendance, Beth Berger Jan 2005

A Comparison Of Character Education Programs And Their Effects On Academic Achievement, Behavior, And Attendance, Beth Berger

Electronic Theses and Dissertations

The purpose of this study was to determine whether significant relationships existed between character education and the number of incidents of crimes and violence, attendance rates, and academic achievement in Florida public schools. Proponents of character education such as Lickona (1991) and Murphy (1998) posited that there was a positive correlation between teaching and practicing the six pillars of character education, and student achievement, and increased attendance. They also posited that there was a negative correlation between character education and incidents of crime and violence. The researcher acquired data in an attempt to determine whether or not the views of …

Considering Individual Religious Freedoms Under Tribal Constitutional Law, Kristen A. Carpenter Jan 2005

Considering Individual Religious Freedoms Under Tribal Constitutional Law, Kristen A. Carpenter

Publications

As American Indian nations revitalize their legal systems, there is renewed interest in "tribal law," that is, the law of each of the Indian nations. Today, there is a particular focus on the subject of "individual rights" under tribal law. In tribal contexts, people are highly interested in the legal institutions and rules that govern their lives, especially as many tribal communities are experiencing a period of great political, social, and economic change. At the national level, the Supreme Court repeatedly expresses concern about whether individuals, especially non-Indians, will be treated fairly in tribal court. For scholars, individual rights under …

Studying The Historical Jesus Through Service, Alicia Batten Jan 2005

Studying The Historical Jesus Through Service, Alicia Batten

Service Learning, General

Service learning pedagogy often assumes a variety of forms when connected with classroom teaching. Through a creative use of service learning pedagogy, the author constructs learning designs that foster student engagement with course content and prompts interrelated connections between the subjects and their own service learning experiences. The author highlights the importance of setting a context for service learning through creating activities linked to learning goals, integrating service learning components with classroom teaching methods, and proactively engaging student apathy, resistance, and faith perspectives through specific assignments that combine experience, analysis, and subject matter. The course described in this essay directly …

Justice And Gender In Ministry: Debating Women's Ordination, Maura A. Ryan Jan 2005

Justice And Gender In Ministry: Debating Women's Ordination, Maura A. Ryan

Journal of Hindu-Christian Studies

Much has been written on the question of ordaining women in the Roman Catholic Church. Catholic scholars of all stripes have debated issues such as the biblical sources for a theology of ordination; the relationship between sacramental and non-sacramental ministries; the limits of papal authority and the development of doctrine; and, more recently, the relationship between the elevation of an all-male, celibate clergy and the failure of Catholic bishops to address reported sexual abuse by priests. This essay focuses on the ethical implications of barring women from the priesthood. Although my references are to Catholic or Christian practices primarily, I …
