The Shari'a Factor In International Commercial Arbitration, Faisal M. Kutty Dec 2005

The Shari'a Factor In International Commercial Arbitration, Faisal M. Kutty

ExpressO

The world has witnessed a phenomenal growth in commercial disputes transcending national borders due to our increasingly interrelated and globalized world economy. In addition to issues in interpretation of commercial agreements and practices, differences in custom, language, culture and religion will continue to fuel conflicts and disagreements between commercial players. Over the last few decades there have been growing commercial interaction between Western companies and their Middle Eastern counterparts. Given this interaction and the great geo-political and economic importance of this region, it is imperative that Western lawyers and dispute resolution professionals have a reasonable grasp of the general principles …

Small Grains And Field Peas: 2006 Variety Recommendations (2005 Crop Performance Results), Cooperative Extension Service, South Dakota State University

SDSU Extension Circulars

Variety selection is a fundamental element in a sound crop production program. This report contains variety recommendations, descriptions, and yield data for the spring-seeded small grains – hard red spring wheat, oat, and barley, along with the fall-seeded small grain –hard red winter wheat. Key factors in variety selection include yield, yield stability, maturity, straw strength, height, test weight, quality, and disease resistance. Yield is an important factor; however, a variety with good disease resistance, straw strength, and high grain quality may be more profitable in some cases than the highest yielding variety. Disease resistance information is based on reactions …

Human Rights Claims Vs. The State: Is Sovereignty Really Eroding?, Chandra L. Sriram Dec 2005

Human Rights Claims Vs. The State: Is Sovereignty Really Eroding?, Chandra L. Sriram

ExpressO

It is often argued that the increase in agreements, specialized courts, and litigation protecting human rights or responding to past abuses of human rights has begun to erode sovereignty. Contrary to traditional principles of non-interference in internal affairs, it is argued, genuine protection of human rights involves an invasion of the sovereign preserve of the state. While many examples might be adduced in support of this claim, ranging from the ad hoc criminal tribunals for the former Yugoslavia and Rwanda to the European Court of Human Rights, this article examines two types of transnational procedures: civil accountability through the use …

Workplace Flexibility 2010: Facts On Short Term Time Off, Jean Flatley Mcguire, Kaitlyn Kenney Dec 2005

Workplace Flexibility 2010: Facts On Short Term Time Off, Jean Flatley Mcguire, Kaitlyn Kenney

Memos and Fact Sheets

Short Term Time Off (STO) refers to job-protected time away from the workplace (generally 5 days or less) to address anticipated or unexpected issues of limited duration. STO may be scheduled or unscheduled, depending on the underlying need. STO enables workers to address the routine and emergency situations that occur in everybody’s lives.

The need for STO may arise, for example, because a worker or worker’s child is sick or has a routine doctor’s appointment, because a worker has to wait for the plumber or apply for benefits or go to court, or because a worker needs to attend a …

An Analysis Of The Use Of Education Tax Credits At Four Public Community Colleges, Benjamin Rue Silliman Dec 2005

An Analysis Of The Use Of Education Tax Credits At Four Public Community Colleges, Benjamin Rue Silliman

Journal of Student Financial Aid

This study examined the use of education tax credits at four community colleges using data from the Federal Quality Assurance Program in 1998, the first year of the HOPE Scholarship and Lifetime Learning Tax Credit (LLTC). Preliminary estimates indicated that the two tax credits were expected to primarily benefit middle income tax filers with adjusted gross incomes (AGI) falling between $40,000 and $80,000. Also, claimants were not expected to benefit from the Federal Pell Grant program. Of the sample of federal 1998 tax returns examined in this study, only 11.2% claimed a HOPE/LLTC, averaging $859. In addition, the average AGI …

Reinvigorating First Year Criminal Law: Integrating Mental Disability Issues Into The Criminal Law Course, Linda C. Fentiman Dec 2005

Reinvigorating First Year Criminal Law: Integrating Mental Disability Issues Into The Criminal Law Course, Linda C. Fentiman

ExpressO

This article explores how mental disability issues can be incorporated into a traditional criminal law class, in order to enrich student understanding of both mental disability law and criminal law doctrine. The intersection of mental disability with the doctrinal aspects of criminal law can be broken into five major categories: 1) the justifications for punishment; 2) the definition of crime in general, e.g., the requirements of a voluntary act, mens rea, and causation; 3) the definition of particular crimes, such as murder, manslaughter, rape, and burglary; 4) defenses to crime, including mistake of law and of fact, as well as …

History-Adjusted Marginal Structural Models To Estimate Time-Varying Effect Modification , Maya L. Petersen, Steven G. Deeks, Jeffrey N. Martin, Mark J. Van Der Laan Dec 2005

History-Adjusted Marginal Structural Models To Estimate Time-Varying Effect Modification , Maya L. Petersen, Steven G. Deeks, Jeffrey N. Martin, Mark J. Van Der Laan

U.C. Berkeley Division of Biostatistics Working Paper Series

Much of epidemiology and clinical medicine is focused on the estimation of treatments or interventions administered over time. In such settings of longitudinal treatment, time-dependent confounding is often an important source of bias. Marginal structural models are a powerful tool for estimating the causal effect of a treatment using observational data, particularly when time-dependent confounding is present. Recent statistical work presented a generalization of marginal structural models, called history-adjusted marginal structural models. Unlike standard marginal structural models, history-adjusted marginal structural models can be used to estimate modification of treatment effects by time-varying covariates. Estimation of time-dependent causal effect modification is …
