Toward A Reform-Minded Model For Securities Law Enforcement, Cristie Ford Jan 2005

Toward A Reform-Minded Model For Securities Law Enforcement, Cristie Ford

All Faculty Publications

This paper examines a significant shift in enforcement practice at the United States Securities and Exchange Commission, originating under the Chairmanship of William Donaldson but likely to continue beyond it. This shift is a response to a crisis of corporate governance, exemplified by recent scandals among various public corporations and financial services institutions, and to the demonstrated inadequacy of SEC enforcement tools to respond to that crisis. While the SEC's new approach, which I call the Reform Undertaking, is incomplete, I argue that if properly implemented it may have the potential to spur institutional reform not only in corporate governance, …

Power, Politics, And The 1997 Restructuring Of Higher Education Governance In Kentucky, Michael Allen Garn Jan 2005

Power, Politics, And The 1997 Restructuring Of Higher Education Governance In Kentucky, Michael Allen Garn

University of Kentucky Doctoral Dissertations

This study describes the policymaking process and policy solutions enacted in the Kentucky Postsecondary Improvement Act of 1997 (or House Bill 1). The study employs both an historical recounting of the story of House Bill 1 and a narrative analysis of opinion-editorials and policymaker interviews to reveal and explain how political power comprised both the perennial problem of Kentuckys higher education policymaking and the tool with which conflicts over power distribution were resolved. The study uses three theoretical frameworks (the Multiple-Streams, Punctuated-Equilibrium, and Political Frame) to explore the rise of restructuring on Kentuckys policymaking agenda, its most contentious issue (separation …

Lawyers, Justice And The Challenge Of Moral Pluralism, Katherine R. Kruse Jan 2005

Lawyers, Justice And The Challenge Of Moral Pluralism, Katherine R. Kruse

Scholarly Works

The debate over whether it serves or undermines the interests of justice for lawyers to temper the zeal of their advocacy based on considerations of morality or justice has largely been polarized between two camps: traditionalists and moralists. Traditionalists defend the amoral role of lawyers, arguing that lawyers should remain moral neutral in their representation of clients. Moralists propose alternative social justice lawyering models, which urge lawyers' morally engagement in their choice of clients, their interpretation of law, and their counseling of clients.

This article revisits the debate by recasting the question at its center. Instead of inquiring what a …

Testing Democracy: The Case Of The 17th Amendment And Constituency Representation, Rhonda Wrzenski Jan 2005

Testing Democracy: The Case Of The 17th Amendment And Constituency Representation, Rhonda Wrzenski

LSU Master's Theses

This paper examines a unique aspect of Congressional history centering on the passage of the 17th amendment in 1913, which shifted the power of U.S. Senate elections from the state legislature to state electorates. This paper examines how the passage of the amendment affected the relationship between characteristics of the state electorate and the roll call behavior of U.S. Senators. Due to the historical nature of the time period, I use Presidential election results by state, party control of the governorship and upper and lower chambers of the state legislature, as well as a number of demographic variables, to estimate …

Vernacular Exposures At The Aillet House: Anthropological Interpretations Of Material Culture And Cultural Change, Kelli Ostrom Jan 2005

Vernacular Exposures At The Aillet House: Anthropological Interpretations Of Material Culture And Cultural Change, Kelli Ostrom

LSU Master's Theses

The thesis project developed from preliminary archaeological testing in 1999 at site 16WBR45, the original location of the Aillet House. The results of the testing were informative as they suggested the placement of the house and attested to casual activity on the porch. However, the results certainly did not answer the need for a more discerning interpretation of the historic house museum known as the Aillet House, currently on display at the West Baton Rouge Parish Museum. I collaborated with the museum in 2004 to bring to their current interpretive program anthropological insights gained from archaeological remains, an architectural survey …

Complexifying The Poetic: Toward A Poiesis Of Curriculum, Donna Lynn Trueit Jan 2005

Complexifying The Poetic: Toward A Poiesis Of Curriculum, Donna Lynn Trueit

LSU Doctoral Dissertations

Inspired by philosopher Richard Rorty’s assertion that we need poetic imagination to move beyond modernity, this pragmatist inquiry seeks to understand the poetic, not as it is rationally defined, but rather as a historically situated discursive practice. In western cultures modernist discursive practices are characterized by rationalist reasoning. Traced to Aristotelian re- interpretations of mimesis (this is that), which structure modernist forms of representation, mimesis operates on a principle of equivalency between the specific and the universal, based on Euclidean, geometric reasoning. Likewise, mimesis underlies poetic representation as an imaginative expression of an objective reality, ideally, a form that moves …

Listeria monocytogenes has been recognized as a human pathogen since 1929. This pathogen is found in many foods and listeriosis infections affect approximately 2,500 people in the United States each year, according to the Centers for Disease Control and Prevention. Of those infected with L. monocytogenes approximately 500 die as a result of the illness. Listeria monocytogenes is a bacterium, commonly found in water, soil, plant material, animals and human. Today, different methods are used by food manufacturers, to reduce the risk of Listeria monocytogenes, such as antimicrobial agents, heating, irradiation, and fermentation. The ability of the bacteria to grow …

Wavelet Sets With And Without Groups And Multiresolution Analysis, Mihaela Dobrescu Jan 2005

Wavelet Sets With And Without Groups And Multiresolution Analysis, Mihaela Dobrescu

LSU Doctoral Dissertations

In this dissertation we study a special kind of wavelets, the so-called minimally supported frequency wavelets and the associated wavelet sets. Most of the examples of wavelet sets are for dilation sets which are groups. In this work we construct wavelet sets for which the dilation set, D, is of the form D=MN, where the product is direct, and so D is not necessarily group. In the second part of this dissertation we construct multiwavelets associated with MRA's and we generalize the rotations in the dilation sets to Coxeter groups.

Blind Multiridge Detection And Reconstruction Using Ultrasonic Signals, Rekha Katragadda Jan 2005

Blind Multiridge Detection And Reconstruction Using Ultrasonic Signals, Rekha Katragadda

LSU Master's Theses

Time-frequency signal analysis has been widely applied in the modern radar, acoustic, sonar and ultrasonic signal processing techniques. Recently, the nondestructive testing (NDT) techniques via the ultrasonic instrumentation have shown the striking capability of the quality control for the material fabrication industry. In this thesis, we first provide a general mathematical model for the ultrasonic signals collected by pulse-echo sensors and then design a totally blind, novel, signal processing NDT technique relying on neither a priori signal information nor any manual effort. The signature signal can be blindly extracted by using the automatic optimal frame size selection for further modeling …

A brief discussion on the philosophical foundations of Thomas Hardy’s poetry is also included. The repertoire discussed within are the settings Summer Schemes, …

Toward A Construct Validation Of The Louisiana School Analysis Model Instructional Staff Questionnaire, Nikki Bray Clark Jan 2005

Toward A Construct Validation Of The Louisiana School Analysis Model Instructional Staff Questionnaire, Nikki Bray Clark

LSU Doctoral Dissertations

This study assessed the construct validity of the School Analysis Model (SAM) Instructional Staff Questionnaire. Construct validation was necessary for several reasons. First, it has not been possible to obtain evidence of the latent factor structure of this key component of the School Analysis Model (SAM). A factor analysis using data collected with the questionnaire was conducted to assess and identify the underlying factor structure of the instrument. Second, there is no evidence that the constructs measured by the SAM are associated with attributes of school performance further empirical analysis was done to determine if latent constructs contained within the …

Hospital Chaplaincy Under The Hipaa Privacy Rule: Health Care Or "Just Visiting The Sick?", Stacey A. Tovino

Scholarly Works

Approximately seventy-nine percent of Americans believe that praying can help people recover from illness, injury or disease, and nearly seventy-seven percent of American patients would like spiritual issues discussed as part of their care. Despite Americans' strong beliefs in the health-related benefits of religious and spiritual practices and traditions, the preamble to the federal Department of Health and Human Services' ("HHS") health information privacy rule (the "Privacy Rule") explains that health care "does not include methods of healing that are solely spiritual" (the "preamble"). The preamble concludes that, "clergy or other religious practitioners that provide solely religious healing services are …

The Literary Frontier: Creating An American Nation (1820-1840), Tena Lea Helton

LSU Doctoral Dissertations

From the perspective of the twenty-first century, it might be easy to dismiss frontier literature as a minor historical anomaly, as a descriptor limited to setting, or as an insignificant variation from a country struggling to reach the heights of British fictional “norms.” However, when American literature began to flourish in the 1820s, it was primarily a literature of the frontier. Examining what this frontier quality means for literary elements beyond setting, such as narrative voice, textual structure, and genre, more clearly explains the importance of the frontier to literary nation-building. After all, the literary frontier ranged across literary genres, …

When I Die, I Won't Stay Dead: The Poetry Of Bob Kaufman, Mona Lisa Saloy Jan 2005

When I Die, I Won't Stay Dead: The Poetry Of Bob Kaufman, Mona Lisa Saloy

LSU Doctoral Dissertations

This dissertation begins with the premise that critical attention to the work of Bob Kaufman is long overdue, and that Bob Kaufman is a significant American poet in the African American and Beat traditions. The purpose of this dissertation begins to rectify this need with a study of Bob Kaufman’s verse. My exploration of Kaufman necessitates some pointed attention to the cultural, social, and psychological influences that gave rise to his work, specifically his upbringing in the south, his travels, and the misrepresented times of his life in current biographical entries and some present scholarship. I will also address the …

Virtual Property, Joshua Fairfield Jan 2005

Virtual Property, Joshua Fairfield

Articles by Maurer Faculty

This article explores three new concepts in property law. First, the article defines an emerging property form - virtual property - that is not intellectual property, but that more efficiently governs rivalrous, persistent, and interconnected online resources. Second, the article demonstrates that the threat to high-value uses of internet resources is not the traditional tragedy of the commons that results in overuse. Rather, the naturally layered nature of the internet leads to overlapping rights of exclusion that cause underuse of internet resources: a tragedy of the anticommons. And finally, the article shows that the common law of property can act …

These results suggest that certain species of Culicoides may …

La Grande Force Est Le D'Sir: Guillaume Apollinaire's Rewriting Of Merlin's Mother And The Dame Du Lac In L'Enchanteur Pourrissant, Allison Bateman Roark Jan 2005

La Grande Force Est Le D'Sir: Guillaume Apollinaire's Rewriting Of Merlin's Mother And The Dame Du Lac In L'Enchanteur Pourrissant, Allison Bateman Roark

LSU Doctoral Dissertations

This dissertation analyzes Guillaume Apollinaire's rewriting of Merlin's mother and the Dame du Lac in L'Enchanteur pourrissant as a commentary on writing. I consider Merlin's state in the tomb as an effect of his desire for the Dame du Lac and relate this to the poet's relationship to writing, which is the result of his desire for a unity of expression -- to express what can be designated in the text, but not directly communicated in its totality through language. There is always something missing from any writing, but the very absence of meaning influences poetic production by encouraging attempts …
