Lawyers, Democracy, And Dispute Resolution: The Declining Influence Of Lawyer-Statesmen Politicians And Lawyerly Values, Jeffrey W. Stempel Jan 2005

Lawyers, Democracy, And Dispute Resolution: The Declining Influence Of Lawyer-Statesmen Politicians And Lawyerly Values, Jeffrey W. Stempel

Scholarly Works

This Comment reviews the shrinking presence of lawyers in the arena of macrocosmic public policy. It also discusses the declining statesmanship of lawyer-politicians as part of a general decline of lawyer professionalism in the face of social and economic pressures tending to undermine lawyer professionalism. Furthermore, it addresses how the net impact of these factors undermines the potential of lawyers to act as a positive force for public policy dispute resolution.

Comparative Studies Of Sperm Cryopreservation Of Diploid And Tetraploid Pacific Oysters, Qiaoxiang Dong Jan 2005

Comparative Studies Of Sperm Cryopreservation Of Diploid And Tetraploid Pacific Oysters, Qiaoxiang Dong

LSU Doctoral Dissertations

This dissertation addressed comparative studies of sperm cryopreservation of diploid and tetraploid Pacific oysters, Crassostrea gigas, with an emphasis on the development of standardized and optimized protocols. This includes comparative ultrastructural differences between sperm from diploid and tetraploid oysters, methods for the rapid estimation of sperm concentration, optimization of cryopreservation, and evaluation of the mechanisms for sperm agglutination (formation of clumps or elongated "noodles") in thawed samples. Currently, cryopreserved sperm has not been commercialized in any aquatic species, and standardization and optimization could greatly benefit the potential commercialization of its use. In oysters specifically, cryopreserved sperm from tetraploids would facilitate …

The Operational Aesthetic In The Performance Of Professional Wrestling, William P. Lipscomb Iii Jan 2005

The Operational Aesthetic In The Performance Of Professional Wrestling, William P. Lipscomb Iii

LSU Doctoral Dissertations

This study analyzes the relationship between professional wrestling as performance and its fans. For decades, professional wrestling has been characterized as a fraudulent sport of scams and illusion rather than actual and fair competition between athletes. Why then is wrestling so popular? I pursue the question by taking a close look at professional wrestling in four different cultural venues or sites of production: the historical archive, the live wrestling event, the televised event, and the Internet. In each site, I focus on what components define professional wrestling, how they operate, and what appears to be their purpose. Drawing on Neil …

Detection And Evaluation Of Temperature Effects On Cell Proliferation In Somatic Tissues Of The Eastern Oyster, Crassostrea Virginica, By Flow Cytometry, Fernando Jimenez Jan 2005

Detection And Evaluation Of Temperature Effects On Cell Proliferation In Somatic Tissues Of The Eastern Oyster, Crassostrea Virginica, By Flow Cytometry, Fernando Jimenez

LSU Master's Theses

The goal of this thesis was to evaluate temperature effects on cell proliferation of eastern oyster somatic tissues for the development of an oyster cell line. Understanding the in vivo cell proliferation of an organism is essential for the development of cell culture. Cell proliferation can be measured by identifying nuclear cellular proteins involved in growth regulation and cellular transformation. The primary objectives of this study were to: 1) develop an assay to evaluate cell proliferation, 2) develop an assay to analyze nuclear RNA content, and 3) evaluate temperature effects on cell proliferation in somatic tissues. Proliferating cell nuclear antigen …

Weight Concern And Smoking In Children, Darla E. Kendzor Jan 2005

Weight Concern And Smoking In Children, Darla E. Kendzor

LSU Master's Theses

Studies have shown that weight concern is prevalent in children and that many children believe smoking can be used to control appetite and weight. However, little is known about the impact of the combination of these factors on smoking initiation in children. Initial research has indicated that weight concern predicts smoking initiation in adolescents, but these studies have not addressed the role of weight control outcome expectancies. The purpose of this study was to prospectively investigate the relationship between weight concern and smoking initiation, and to evaluate weight control outcome expectancies as a moderator of this relationship in children. Cross-sectional …

Palm Is Expressed In Both Developing And Adult Mouse Lens And Retina., Meryl Castellini, Louise V Wolf, Bharesh K Chauhan, Deni S Galileo, Manfred W Kilimann, Ales Cvekl, Melinda K Duncan

Department of Pathology, Anatomy, and Cell Biology Faculty Papers

BACKGROUND: Paralemmin (Palm) is a prenyl-palmitoyl anchored membrane protein that can drive membrane and process formation in neurons. Earlier studies have shown brain preferred Palm expression, although this protein is a major water insoluble protein in chicken lens fiber cells and the Palm gene may be regulated by Pax6. METHODS: The expression profile of Palm protein in the embryonic, newborn and adult mouse eye as well as dissociated retinal neurons was determined by confocal immunofluorescence. The relative mRNA levels of Palm, Palmdelphin (PalmD) and paralemmin2 (Palm2) in the lens and retina were determined by real time rt-PCR. RESULTS: In the …

Fairness And Farmland Preservation: A Response To Professor Richardson, Mark W. Cordes Jan 2005

Fairness And Farmland Preservation: A Response To Professor Richardson, Mark W. Cordes

Faculty Articles, Papers, and Other Scholarship

In a recent article published in this Journal, Professor Jesse Richardson attempted to refute the arguments proposed by myself and others that support the fairness of downzoning land without compensation to property owners. Central to most farmland preservation efforts is agricultural zoning, which typically involves downzoning farmland to agricultural use, precluding more intensive development. Part IV will briefly comment on the role compensatory programs like PDRs and TDRs should play in effective farmland preservation programs. This is true even if downzoning results in substantial diminution of land values, which means that local governments can pursue farmland preservation by putting the …

Anglian Leadership In Northumbria, 547 A.D. Through 1075 A.D., Jean Anne Hayes Jan 2005

Anglian Leadership In Northumbria, 547 A.D. Through 1075 A.D., Jean Anne Hayes

LSU Doctoral Dissertations

The Anglo-Saxon kingdoms of Britain were founded in warfare beginning in the fifth century. These kingdoms developed alongside the native Romanized Britons, who attempted to reassert their authority in Britain in the wake of the Roman withdrawal. Northumbria, located north of the Humber River, the largest and most northerly of the Anglo-Saxon kingdoms played a vital role in the politics of early medieval Britain. During the seventh century, the Northumbrian kings were recognized as the overkings of the Anglo-Saxon kingdoms, as well as the neighboring British and Pictish kingdoms. Over the course of several centuries, the leaders of Northumbria alternately …

Comparative Analysis Of Conventional And Ici-Self-Cancellation Digital Video Broadcasting Transceivers, Khaled Z. Matarneh Jan 2005

Comparative Analysis Of Conventional And Ici-Self-Cancellation Digital Video Broadcasting Transceivers, Khaled Z. Matarneh

LSU Master's Theses

Digital video broadcasting–terrestrial (DVB-T) is one of the important technologies in the communication area because of its capability of high data-rate multimedia transmission. Orthogonal frequency division multiplexing (OFDM) has been the backbone technique in the current DVB-T systems adopted by Europe and Japan. However, since the OFDM system is very sensitive to the frequency synchronization and phase errors, which will induce the intercarrier interference (ICI), the ongoing research has been dedicated to this ICI problem in the presence of the Doppler frequency drift and the fading channels. A means to deal with the ICI problem is called the ICI self-cancellation …

Export-Led Growth In Honduras And The Central American Region, Hermann Castro Zuniga Jan 2005

Export-Led Growth In Honduras And The Central American Region, Hermann Castro Zuniga

LSU Master's Theses

This thesis examines the validity of the export-led growth (ELG) hypothesis in Honduras and compares the Honduran experience to that of other Central American countries, specifically Costa Rica, El Salvador, Guatemala and Nicaragua. It further evaluates the ELG hypothesis for the agricultural sector of Honduras. The conceptual model incorporates exports into a Cobb-Douglas production function and formulates dynamic econometric models of real gross domestic product (GDP), real gross fixed capital formation (GFCF), labor and real exports for the 1970-2000 period. To test for the validity of the ELG hypothesis, Granger-causality was tested on the export coefficients of the growth equation …

Constructing Resilent Marital Relationships: A Panel Study Of Marriages Under Pressure, Amy Manning Jan 2005

Constructing Resilent Marital Relationships: A Panel Study Of Marriages Under Pressure, Amy Manning

LSU Doctoral Dissertations

In the past, much of the literature on marital quality and stability has suggested that effective communication, positive affect, and spouses’ emotional support are important to marital quality (Gottman and Levenson, 2000; Gottman and Notarius, 2000 Popenoe, 2004; Sanchez and Ganger, 2000; Whitehead and Popenoe, 2001). Other works have also suggested that “commitment,” that is feelings regarding the permanency of marriage, encourages marital quality. However, to date, few studies have empirically investigated the relationship between commitment and marital quality (Surra and Gray, 2000). This dissertation investigates the relationships between commitment, marital disruption and instability, and marital quality, utilizing the context …

A Hellenistic Masterpiece: The Medici Aphrodite, Angel D. Arvello Jan 2005

A Hellenistic Masterpiece: The Medici Aphrodite, Angel D. Arvello

LSU Master's Theses

Numerous copies of both the Medici and Capitoline Aphrodite were produced in the Roman period. Judging only from the number of copies, it is generally accepted that the Capitoline was the most popular type followed by the Knidia and finally the Medici. First an examination of the copies, variants and quotations of each type is given to provide some background on the Medici and Capitoline. Next is a discussion of the dating of the pieces which has typically ranged from the fourth to the first centuries BC. An overview of a second century trend is presented to place both pieces …

Evaluation Of Beauveria Bassiana And Host Plant Resistance For The Management Of Rice Stink Bug In Rice Agro-Ecosystem, Dilipkumar Thakorbhai Patel Jan 2005

Evaluation Of Beauveria Bassiana And Host Plant Resistance For The Management Of Rice Stink Bug In Rice Agro-Ecosystem, Dilipkumar Thakorbhai Patel

LSU Master's Theses

Isolates of Beauveria bassiana (Balsamo) Vuillemin were tested for biological control of rice stink bug, Oebalus pugnax (Fab.), in the laboratory, in small-plot field experiments compared with conventional insecticides, and in a large-plot experiment to determine the spread and persistence of the fungus. The soil-derived isolate LRC28 was more virulent to O. pugnax adults than the rice stink bug-derived isolate RSB in a laboratory experiment. The fungal isolates did not differ from one another in reducing insect numbers or in infecting rice stink bugs in the small-plot experiments. A single application of B. bassiana reduced rice stink bug nymphs on …

Problems Of Modernization In Late Imperial Russia: Maksim M. Kovalevskii On Social And Economic Reform, Evgeny Badredinov Jan 2005

Problems Of Modernization In Late Imperial Russia: Maksim M. Kovalevskii On Social And Economic Reform, Evgeny Badredinov

LSU Doctoral Dissertations

The problems of social and economic reform were at the center of academic and political activities of Maksim M. Kovalevskii (1851-1916), a prominent Russian historian and sociologist. The comparative study of rural communal institutions led him to conclude that the village commune remained a viable social and economic institution in late imperial Russia. Although he believed firmly in private agriculture, he criticized the Stolypin land reform for attempting to pressure peasants to separate from communes. Kovalevskii argued that in a country dominated by communal traditions the state must not destroy the collective economy by legislative fiat. He urged Russian policy-makers …

Illinois Legislators Revisited: A Comparison Of Legislators' Perceptions And Attitudes Toward Constituent E-Mail, Mary Louise Sheffer

LSU Doctoral Dissertations

This is a follow up study to a 2000 report, which measured and compared Illinois state legislators’ attitudes and perceptions toward constituent e-mail, and its impact on personal political agendas. Along with measuring attitudes, this study sought to measure and compare the impact of advances in e-mail technology on Illinois legislators’ use of e-mail as a political tool of communication. The panel comparison consisted of 59% of respondents who participated in both the 2000 and the 2004 study. A survey conducted in February 2000 showed that 89% of Illinois legislators had an active e-mail address, but only 65% of those …

Effect Of Estradiol-17b On The Gonadal Developemnt Of Diploid And Triploid Female Eastern Oysters, Roberto Quintana Jan 2005

Effect Of Estradiol-17b On The Gonadal Developemnt Of Diploid And Triploid Female Eastern Oysters, Roberto Quintana

LSU Master's Theses

Declines in annual oyster landings and problems associated with seasonal reduction of oyster meat yields have increased interest for development of techniques to produce oysters with enhanced growth characteristics. Research interest has been focused on developing improved lines by induction of polyploidy. The goal of the present study was to evaluate the enhancement of gonadal development of triploid oysters, by the use of the hormone estradiol 17-â (E2) to produce viable eggs for the development of tetraploid broodstocks. Previous studies with the Pacific oyster, Crassostrea gigas, have shown: (1) the need to use the larger eggs of triploid females to …

Envisioning The Modern American Fiscal State: Progressive-Era Economists And The Intellectual Foundations Of The U.S. Income Tax, Ajay K. Mehrotra Jan 2005

Envisioning The Modern American Fiscal State: Progressive-Era Economists And The Intellectual Foundations Of The U.S. Income Tax, Ajay K. Mehrotra

Articles by Maurer Faculty

At the turn of the twentieth century, the U.S. system of public finance underwent a dramatic, structural transformation. The late nineteenth-century system of indirect taxes, associated mainly with the tariff, was eclipsed in the early decades of the twentieth century by a progressive income tax. This shift in U.S. tax policy marked the emergence of a new fiscal polity - one that was guided not simply by the functional and structural need for government revenue but by concerns for equity and economic and social justice. This Article explores the paradigm shift in legal and economic theories that undergirded this dramatic …

Exile As Severance, Alexandru Boldor Jan 2005

Exile As Severance, Alexandru Boldor

LSU Doctoral Dissertations

Exile is a phenomenon probably as ancient as humanity itself, and one of the oldest topics in universal literature. The great majority of its variants (political, economical, social,) are founded on the idea of "forced displacement." Consequently, most often exile is reflected in literary creations in discourses dominated by a sentiment of loss. However, in some cases exile is not seen as a tragic event, but rather as an opportunity for intellectual growth - as attested by a number of authors who have chosen voluntarily to exile themselves. The rationale behind this occurrence is a mental process I called "severance." …

Feed Sack Fashions In South Louisiana, 1949-1968: The Use Of Commodity Bags In Garment Construction, Jennifer Lynn Banning

LSU Doctoral Dissertations

In the first part of this study, 37 commodity bag garments made and worn by one woman in rural South Louisiana between the years 1949-1968 were analyzed. The garments are currently in the collection of the Louisiana State University Textile and Costume Museum. A material culture study model, originally developed by Fleming and adapted from Severa and Horswill, was used to identify, evaluate, culturally analyze and interpret the design, construction, and fabric characteristics of garments. Access to this collection provided a rare opportunity to examine the attributes of a related group of commodity bag garments. In the second part of …

Migrating Towards Minority Status: Shifting European Policy Towards Roma, Timothy W. Waters, Rachel Guglielmo Jan 2005

Migrating Towards Minority Status: Shifting European Policy Towards Roma, Timothy W. Waters, Rachel Guglielmo

Articles by Maurer Faculty

During the 1990s, European policy towards Roma evolved from concern about migration toward rhetoric about rights. In this article we trace that shift across two OSCE reports. Following rhetorical-action models, we show how the EU's commitment to enlargement and "common values" compelled it to elaborate an internal approach to minority protection. Concerns about migration persist, but Europe now has to consider how to integrate Roma as minorities.

German Legal Culture And The Globalization Of Competition Law: A Historical Perspective On The Expansion Of Private Antitrust Enforcement, Hannah Buxbaum Jan 2005

German Legal Culture And The Globalization Of Competition Law: A Historical Perspective On The Expansion Of Private Antitrust Enforcement, Hannah Buxbaum

Articles by Maurer Faculty

One trend developing in international competition regulation is the expansion of private antitrust litigation as an enforcement mechanism. This article examines Germany's response to that trend, investigating the extent to which it has roots in the country's legal and economic history. It begins by tracing the development of German competition law post-World War II - focusing in particular on the patterns of pressure and resistance within the transatlantic relationship - and identifies the emergence of an indigenous regulatory enforcement philosophy. It then turns to two recent developments that indicate the expansion of private enforcement in ways relevant to Germany's domestic …

A Crisis Of Opportunity: The Example Of New Orleans And Public Education In Antebellum Louisiana, Sarah Elisabeth Lipscomb Jan 2005

A Crisis Of Opportunity: The Example Of New Orleans And Public Education In Antebellum Louisiana, Sarah Elisabeth Lipscomb

LSU Master's Theses

The purpose of this study is to explore the development of public education in antebellum Louisiana. Using primarily public records, I found that despite the successful system instituted in New Orleans in the early 1840s, the rest of Louisiana faltered in its attempts to establish free public schools. Notwithstanding the requirement contained in the 1845 Constitution that each parish must organize public schools, the lack of guidance, supervision, and funding from the state legislature all coalesced to condemn public education in most of the rest of the state. As public schools in New Orleans thrived throughout the decades leading up …
