A Dual Catastrophe Of Protectionism, Sungjoon Cho Jan 2005

A Dual Catastrophe Of Protectionism, Sungjoon Cho

Northwestern Journal of International Law & Business

Suppose that a consortium of wealthy and powerful local industries, acting through lawmakers captured by these industries, managed to pass a statute, damaging to the larger public welfare, purely for a protectionist purpose. Suppose further that this statute victimizes exports from a small, poor country such as Vietnam, to a large, rich country such as the United States, because these imported products are cheaper and thus pose a competitive threat to rival domestic industries. Suppose also that courts in the importing country can do little to stop this chain of events. Rational individuals might find these events objectionable, if not …

International Convergence Of Accounting Standards-Perspectives From The Fasb On Challenges And Opportunities, Robert H. Herz, Kimberley R. Petrone Jan 2005

International Convergence Of Accounting Standards-Perspectives From The Fasb On Challenges And Opportunities, Robert H. Herz, Kimberley R. Petrone

Northwestern Journal of International Law & Business

Convergence of international accounting standards is not a new initiative at the Financial Accounting Standards Board (FASB or Board); in fact, the FASB has pursued international "convergence" for almost half of its more than thirty year existence.' The FASB's international activities initially fell under the heading of harmonization, or internationalization, of accounting standards. Today those activities are referred to as convergence.Whatever the term, the Board has long held the view that a single set of high-quality international accounting standards is desirable because its use will improve international comparability of financial information; reduce costs to financial statement users, preparers, auditors, and …

Terrorism And The Laws Of War, Eric A. Posner Jan 2005

Terrorism And The Laws Of War, Eric A. Posner

Chicago Journal of International Law

My argument has three steps. First, I discuss the purposes of the laws of war, and argue that humanitarian considerations provide only an ambiguous rationale for limiting the weapons and tactics of warfare. Second, I discuss why some weapons and tactics are outlawed while others are not, and argue that humanitarian ideals cannot, by themselves, explain the pattern. The best explanation focuses on the enforceability of laws. I identify two conditions under which belligerents would agree on a law of war, and would be willing to comply with their agreement. The symmetry condition requires that the laws of war generate …

The Icj And Municipal Law: The Precedential Effect Of The Avena And Lagrand Decisions In U.S. Courts, Philip V. Tisne

Fordham International Law Journal

This Note argues that neither the framers of the Optional Protocol (“the Framers”), nor the U.S. Senate that ratified it, intended to delegate to the ICJ the authority to interpret the Vienna Convention as a matter of U.S. law. Part I of this Note describes the role and function of international law in the U.S. domestic legal system. Part I then presents the structure and history of the Permanent Court of International Justice (“PCIJ”) and the ICJ (collectively, “the World Courts”). Part I also describes the history and relevant provisions of the Vienna Convention and the Optional Protocol. Part II …

A Function-Based Approach To Establishing Standardization And Flexible Work Cells For High-Variety, Low-Volume Manufacturing, Yamkelani Moyo Jan 2005

A Function-Based Approach To Establishing Standardization And Flexible Work Cells For High-Variety, Low-Volume Manufacturing, Yamkelani Moyo

University of Kentucky Master's Theses

Certain types of high-variety, low-volume manufacturing operations employ clusters of machines to execute general classes of operations in the manufacture of their product mix, but those operations differ significantly from job to job. Consequently operations are not standardized and batch and queue operational strategies are employed with all attendant shortcomings. However, closer examination reveals that these operations largely consist of a small number of elemental machine functions that are exercised in various combinations. The functions provide a basis to for defining richly descriptive standardized work at the individual process level using parameters to distinguish the unique settings and characteristics for …

Modeling And Optimization Of Machining Performance Measures In Face Milling Of Automotive Aluminum Alloy A380 Under Different Lubrication/Cooling Conditions For Sustainable Manufacturing, Abhijit Dilip Kardekar Jan 2005

Modeling And Optimization Of Machining Performance Measures In Face Milling Of Automotive Aluminum Alloy A380 Under Different Lubrication/Cooling Conditions For Sustainable Manufacturing, Abhijit Dilip Kardekar

University of Kentucky Master's Theses

The use of cutting fluids in machining process is very essential for achieving desired machining performance. Due to the strict environmental protection laws now in effect, there is a wide-scale evaluation of the use of cutting fluids in machining. Consequently, minimal quantity lubrication (MQL), which uses very small quantity of cutting fluids and still offers the same functionality as flood cooling, can be considered as an alternative solution. This thesis presents an experimental study of face milling of automotive aluminum alloy A380 under four different lubrication/cooling conditions: dry cutting, flood cooling, MQL (Oil), and MQL (Water). Experiments were design using …

Surface Modification Of Plga Biomaterials For Site-Directed Immobilization Of Growth Factors, Jessica Bennett Lynn Sharon Jan 2005

Surface Modification Of Plga Biomaterials For Site-Directed Immobilization Of Growth Factors, Jessica Bennett Lynn Sharon

University of Kentucky Master's Theses

Biodegradable polymer materials, specifically poly(lactic-co-glycolide) (PLGA) can be used as bone replacements for bone regeneration. Scaffolds can be prepared to be porous to induce bone growth into a scaffold so that it is replaced with natural tissue as the polymer degrades. However, simply using PLGA will result in formation of scar tissue rather than regeneration of natural bone. Therefore focus has turned to attaching growth factors to the PLGA molecules to elicit a specific cellular response when the implant is placed in the body. Site-directed immobilization utilizes specific groups on both the biomaterial and biomolecule so that growth factors can …

Development Of Protein-Imprinted Polysiloxane Biomaterials: Protein Selectivity And Cellular Responses, Kyoungmi Lee Jan 2005

Development Of Protein-Imprinted Polysiloxane Biomaterials: Protein Selectivity And Cellular Responses, Kyoungmi Lee

University of Kentucky Master's Theses

Surface modification is an extensively researched approach in order to overcomethe limitations, and improve the performance of orthopedic and dental implants. It is atthe surface of the implant materials that the initial interactions of tissues or body fluidstake place. Therefore, surface properties of biomaterials are the important factors that cancontrol these biological responses. Molecular imprinting is a surface modificationtechnique that creates specific recognition sites on the surface of biomaterials. Todevelop the recognition sites, a functional monomer is assembled with templatebiomolecule and then crosslinked. After removal of the template, the surface can rebindthe molecules. Therefore, desired reactions can be initiated at …

Fabrication And Characterization Of Schottky Diode And Heterojunction Solar Cells Based On Copper Phthalocyanine (Cupc), Buckminster Fullerene (C60) And Titanium Dioxide (Tio2), Subhash C. C. Vallurupalli Jan 2005

Fabrication And Characterization Of Schottky Diode And Heterojunction Solar Cells Based On Copper Phthalocyanine (Cupc), Buckminster Fullerene (C60) And Titanium Dioxide (Tio2), Subhash C. C. Vallurupalli

University of Kentucky Master's Theses

Organic solar cells are cheaper and much easier to fabricate than the conventional inorganic solar cells, but they suffer from low efficiencies due to low carrier mobilities in organic films. In this study Copper Phthalocyanine (CuPc) and Buckminster Fullerene (C60) based Schottky diodes were fabricated on ITO coated glass substrates to study their performance and a study of the effect of thickness on the cell parameters of CuPc Schottky diodes was made. Also, TiO2 based devices were studied to see the effect of TiO2 layer on the cell parameters. The J-V curves were analyzed for series resistance, diode ideality factor …

Fabrication And Characterization Of Cupc Based Organic Solar Cells, Balaji Parthasarathy Jan 2005

Fabrication And Characterization Of Cupc Based Organic Solar Cells, Balaji Parthasarathy

University of Kentucky Master's Theses

In this work, organic solar cells of the configuration ITO/Pedot:PSS/CuPc/PTCBI/Al (Indium tin oxide/poly(3,4-ethylenedioxythiophene): polystyrene sulfonic acid/copper phthalocyanine/3,4,9,10-perylenetetracarboxylic bisbenzimidazole/aluminum) were investigated. A high open-circuit voltage (Voc) of 1.15 V was obtained when the PTCBI layer was 7 nm thick. Lower Voc values were observed for the same structure with silver, copper and gold electrodes instead of aluminum. However, short-circuit current density (Jsc) with these electrodes was much higher (4 mA/cm2) than in the case of aluminum (0.12 mA/cm2). Results were interpreted in terms of a modified CuPc/Al Schottky diode for the thin PTCBI case and a CuPc/PTCBI heterojunction for the thick …

Effects Of Stochastic (Random) Surface Roughness On Hydrodynamic Lubrication Of Deterministic Asperity, Prerit Vyas Jan 2005

Effects Of Stochastic (Random) Surface Roughness On Hydrodynamic Lubrication Of Deterministic Asperity, Prerit Vyas

University of Kentucky Master's Theses

In order to achieve enhanced and cost-effective performance of engineering components, Surface Engineering embraces traditional and innovative surface technologies which modify the surface properties of metallic and non-metallic engineering components for specific and sometime unique engineering purposes. The surface roughness of an engineered surface may be classified as: the random surface roughness which is a product of surface finishing and the deterministic surface roughness which is engineered to increase the lubrication characteristics of the hydro dynamically lubricated thrust ring. The effect of stochastic/random roughness can not be ignored when the roughness is of the same amplitude as that of fluid …

Experimental And Analytical Study Of Friction Stir Processing, Basil M. Darras Jan 2005

Experimental And Analytical Study Of Friction Stir Processing, Basil M. Darras

University of Kentucky Master's Theses

Friction stir processing (FSP) has recently become an effective microstructural modifications technique. Reported results showed that for different alloys, FSP produces very fine equiaxed and homogeneous grain structure. FSP is considered to be a new processing technique and more experimental and analytical investigations are needed to advance the industrial utilization of FSP. Most of the work that has been done in the friction stir processing field is experimental and limited modeling activities have been conducted. Attempts to develop a predictive model to correlate the resulting microstructure with process parameters are scarce. In this work, commercial 5052 Aluminum alloy sheets are …
