Regulation By Adaptive Management--Is It Possible?, J.B. Ruhl Dec 2005

Regulation By Adaptive Management--Is It Possible?, J.B. Ruhl

Vanderbilt Law School Faculty Publications

Today's voluminous literature on adaptive management traces its roots to Professor C.S. Holling's seminal work, Adaptive Environmental Assessment and Management. Although almost thirty years have passed since he and his colleagues first described the adaptive management methodology, no work on the topic has improved on their core theory. Its essence is an iterative, incremental decisionmaking process built around a continuous process of monitoring the effects of decisions and adjusting decisions accordingly. It is in other words, far more suited to the needs of future regulatory challenges than is prescriptive regulation. My focus, however, is not on what adaptive management should …

Share Price As A Poor Criterion For Good Corporate Law, Lynn A. Stout Dec 2005

Share Price As A Poor Criterion For Good Corporate Law, Lynn A. Stout

Cornell Law Faculty Publications

Academics, reformers, and business leaders all yearn for a single, objective, easy-to-read measure of corporate performance that can be used to judge the quality of public corporation law and practice. This collective desire is so powerful that it has led many commentators to grab onto the first marginally plausible candidate: share price.

Contemporary economic and corporate theory, as well as recent business history, nevertheless warn us against unthinking acceptance of share price as a measure of corporate performance. This Essay offers a brief reminder of some of the many reasons why stock prices often fail to reflect true corporate performance, …

The Election Cycle, And The U.S. Withdrawal From Vietnam, Steven Thomas Stoddard Dec 2005

The Election Cycle, And The U.S. Withdrawal From Vietnam, Steven Thomas Stoddard

Undergraduate Honors Capstone Projects

Few events in American history have proved to be as divisive and controversial as U.S. involvement in the Vietnam War. Although U.S. policy in Indochina has its roots in the Truman Administration, the two presidents most closely associated with the conflict are Lyndon B. Johnson, and Richard M. Nixon. These two are particularly important because they both occupied the White House during the highest levels of direct U.S. involvement in the war. In terms of troop deployments to Southeast Asia, the level and intensity of U.S. involvement peaked under the Johnson Administration and it was at this time that the …

Professional Role Complexities And Job Satisfaction Of Collegiate Certified Athletic Trainers, Kirk Brumels Dec 2005

Professional Role Complexities And Job Satisfaction Of Collegiate Certified Athletic Trainers, Kirk Brumels

Dissertations

This study examined whether professional role complexities existed for certified athletic trainers (ATCs) employed at the collegiate level, and if so, what impact these role complexities had upon job satisfaction and intent to leave a current position or the profession. The amount and sources of role complexities were examined for collegiate ATCs who were employed in clinical, faculty, or joint appointment positions.

Potential for professional role complexities exist in any situation where multiple role obligations are present in the workplace. Professional role complexities for health care employees often manifest into tension, dissatisfaction, lack of energy or ambition, and decreased attention …

Automotive Service Technology Intersectional Skills Proficiency Assessment, David L. Macquarrie Dec 2005

Automotive Service Technology Intersectional Skills Proficiency Assessment, David L. Macquarrie

Dissertations

This dissertation focused on the creation and validation of a criterion referenced credentialing assessment of automotive service technicians' intersectional skills (ASTIS) proficiency. These intersectional skills are prerequisite and common to multiple job level tasks that an automotive service technician (AST) performs on the job. An assessment of the ASTIS was created to aid automotive technician employers in the evaluation of hiring prospective technician employees and is not duplicated by current certifications (e.g. ASE) as they do not uniquely assess these skills.

This dissertation focused on the ASTIS skills and the information an employer can obtain pertaining to a prospective employee's …

Microfinance Institutions In Transition: Fonkoze In Haiti Moves Toward Regulated Banking Status, Michael Tucker, Winston Tellis Dec 2005

Microfinance Institutions In Transition: Fonkoze In Haiti Moves Toward Regulated Banking Status, Michael Tucker, Winston Tellis

Journal of Microfinance / ESR Review

Microfinance institutions (MFIs) established to provide the poor with access to capital have typically operated outside of their countries' regulated banking environments. Many have relied on donor grants and low-interest funds to support loan portfolios and social programs. As MFIs mature they aspire to become more efficient and attain economic sustainability because hey understand that greater numbers of the poor can be serviced by economically sustainable institutions. Many MFIs collect savings deposits but are often barred from using them for loans by their countries' laws. Fonkoze, an MFI in Haiti, has sought regulated status, which would provide access to deposit …

Archeological Trends And Book Of Mormon Origins, John E. Clark Dec 2005

Archeological Trends And Book Of Mormon Origins, John E. Clark

BYU Studies

Had circumstances permitted a marked grave for the slain prophet, a fitting headstone could have read, “By Joseph Smith, Junior, Author and Proprietor.” Such an epitaph, taken from the title page of the Book of Mormon, captures the enduring bond between the man and the book, and also the controversy which coalesced around both with the book’s publication and the organization of The Church of Jesus Christ of Latter-day Saints in 1830. In the ensuing and continuing “war of words” (Joseph Smith–History 1:10) and prejudice, redemption may hang on the single preposition “by.” What hand did Joseph have in producing …

Joseph Smith's Christology: After Two Hundred Years, Robert L. Millet Dec 2005

Joseph Smith's Christology: After Two Hundred Years, Robert L. Millet

BYU Studies

During the last decade, a recurring question has been posed to members of The Church of Jesus Christ of Latter-day Saints: Is the church “changing?” In addition, it is asked, Is there some effort on the part of church leadership to have the church and its teachings, particularly those concerning Jesus Christ, become more acceptable to and thus more accepted by other Christians? The natural Latter-day Saint inclination is to react sharply that the church’s doctrines concerning Jesus Christ are intact and even eternal, that the doctrines of Joseph Smith’s day and the doctrines of our own day are one …

Testing Stark's Thesis: Is Mormonism The First New World Religion Since Islam?, Gerald R. Mcdermott

BYU Studies

I n 1984, Rodney Stark startled the academic world with a claim that has kept sociologists and religion-watchers scratching their heads ever since. “The Church of Jesus Christ of Latter-day Saints, the Mormons,” he predicted, “will soon achieve a worldwide following comparable to that of Islam, Buddhism, Christianity, Hinduism, and the other dominant world faiths.”¹ Stark claimed that Mormonism has grown faster than any other new religion in American history. Between 1840 and 1980, it had averaged a growth rate of 44 percent per decade; in the four decades 1940 through 1980, growth zoomed to an astonishing 53 percent. If …

Joseph Smith And The Making Of A Global Religion, Jan Shipps

BYU Studies

In regard to the other “worlds” of the first Mormon prophet, Joseph Smith was certainly “in that world and of it.” He was clearly in attendance “in his own time;” he attempted to recover past worlds; he was and is present in his own and in the personal worlds of others; and he challenged the theological world of his day.

Can A Community Of Practice Be Established At Org X?, Kasturi Golla Dec 2005

Can A Community Of Practice Be Established At Org X?, Kasturi Golla

Student Work

Communities of Practice (CoP's) can preserve the knowledge of an organization by pooling together individuals who share the same goals and are determined to build their level of knowledge through 'innovative interaction'(Wenger, 1998). CoP's help organizations pool together their knowledge of value, keeping in mind the organization's business processes. This study was conducted in order to establish a CoP in the I/S department at Org X, by first identifying knowledge sharing barriers and the measures that could be taken to eliminate these barriers. This research is aimed at answering three primary questions: 1. What are the barriers that prevent employees …
