This Environmental Assessment (EA) documents results of an analysis of proposed changes to the current management of wildland fire and hazardous fuels for the Bureau of Land Management (BLM) Vernal Field Office. Proposed revisions of the Vernal Fire Management Plan (FMP) serve as the Proposed Action for this EA. The revised FMP incorporates current planning requirements associated with fire management on public lands, including wildland fire suppression and fuel treatments. At a time when many are worried that the United States is experiencing a general decline in civic and political engagement, volunteering appears particularly strong among today’s young people. While volunteering is just one form of community involvement, research has shown that it is often connected to other forms of engagement, and, among youth, volunteering plays a valuable role in shaping how youth learn to interact with their community and develop the skills, values, and sense of empowerment necessary to become active citizens.

A Refutation Of Racial Differentials In The Juvenile Recidivism Rate Hypothesis, Jospeter M. Mbuba

African Journal of Criminology and Justice Studies

It has repeatedly been argued that race is an important predictor of juvenile recidivism, invariably with black offenders having significantly higher odds of recidivating than white offenders (DeComo, 1998; Strom, 2000; Benda, 2001; Langan & Levin, 2002; Harms, 2003; Pope and Snyder, 2003; Puzzanchera, 2003; Stahl, 2003). This study refutes that assertion. Using data from the Department of Public Safety and Corrections in the state of Louisiana, a total of 2,810 juvenile offenders released in the 1999/2000 fiscal year were examined and a socio-demographic profile of those who were returned into the correctional system one year post release was established. …

Edict V. Dicta: Rolling Back Rights In The Second Circuit Under The Clearly Established Clause Of The Aedpa Amended Habeas Statute, Aron E. Goldschneider

This article, through a close critical analysis of two recent habeas corpus decisions by the Second Circuit Court of Appeals, shows how appellate courts, under § 2254 of the AEDPA amended habeas statute, are methodically erasing venerable and well-considered federal habeas precedents that formerly protected state defendants' rights. In the process of examining these Second Circuit decisions' impact on two discrete areas of criminal trial procedure, the article exposes the way in which habeas review under the AEDPA too often becomes a formalistic yet un-disciplined exercise that turns away from the crucial question that should be at the heart of …

Attention Felons: Evaluating Project Safe Neighborhood In Chicago, Andrew V. Papachristos, Tracey L. Meares, Jeffrey Fagan

Coase-Sandor Institute for Law & Economics Research Paper Series

This research uses a quasi-experimental design to evaluate the impact of Project Safe Neighborhood (PSN) initiatives on neighborhood level crime rates in Chicago. Four interventions are analyzed: (1) increased federal prosecutions for convicted felons carrying or using guns, (2) the length of sentences associated with federal prosecutions, (3) supply-side firearm policing activities, and (4) social marketing of deterrence and social norms messages through justice-style offender notification meetings. Using an individual growth curve models and propensity scores to adjust for non-random group assignment, our findings suggest that several PSN interventions are associated with greater declines of homicide in the treatment neighborhoods …

Kentucky Transportation Center Research Report

In order to extend commercial vehicle enforcement coverage to routes that are not monitored by fixed weigh stations, Kentucky has developed and implemented a Remote Monitoring System (RMS) and a Virtual Weigh Station (VWS). The RMS captures images of passing trucks (from the side) and transmits those images to a nearby weigh station. Station personnel can view the images, read the USDOT number, and check the number against Kentucky’s Clearinghouse of motor carrier data. When a problem is detected with the carrier’s registration, taxes, or safety record, an officer can be dispatched to intercept the truck, perform the necessary checks, …

Proportionality As A Principle Of Limited Government, Alice Ristroph

This Article examines proportionality as a constitutional limitation on the power to punish. In the criminal context, proportionality is often mischaracterized as a specifically penological theory-an ideal linked to specific accounts of the purpose of punishment. In fact, a constitutional proportionality requirement is better understood as an external limitation on the state's penal power that is independent of the goals of punishment. Proportionality limitations on the penal power arise not from the purposes of punishment, but from the fact that punishing is not the only purpose that the state must pursue. The Nature Of Metropolitan Governance In Urban America: A Study Of Cooperation, Conflict, And Avoidance In The Kansas City Region, Curtis H. Wood

Working Group on Interlocal Services Cooperation

In this study I determine the dominant pattern of governance in the Kansas City metro based on interviews with 46 city administrative officers in cities over 2,500 in population. Consistent with theories of cooperation, I found that the dominant governance strategy is intergovernmental cooperation in the delivery of public services punctuated by conflict and avoidance/defection when intergovernmental service delivery arrangements involve infrequent interaction between the parties and when the presence and influence of the regional council of government is minimal.

The range of interlocal contractual arrangements in the realm of public safety in Florida provides a research site to examine the extent to which these arrangements have been used by local governments. We developed a contractual perspective on interlocal contractual arrangements as relational contracts by arguing that their institutional designs are partly an effort of involved parties to reduce transaction costs that are the product of the properties of the services themselves; and partly by state statutes that allowed mix approaches to contractual arrangements. This paper empirically examines the interrelationships between service characteristics and the structure of networks among local jurisdictions using relational data across a set of diverse services from Pinellas County in Florida. In metropolitan areas, cities as well as counties work together to become increasingly efficient in public service delivery, and hence, engage into a variety of cooperative arrangements such as bilateral or multilateral service agreements. Increasing restraints on jurisdictions’ fiscal capacity have further forced them to look for cooperative avenues. Despite the increased interest in voluntary services cooperation, little is known about the factors that encourage local governments to enter into collaborative services arrangements with each other. This paper addresses this question through an analysis of interlocal contracting arrangements for police and fire services reported by 464 local governments in Michigan. While the contracting of public services is increasing common in local governments across the country, collaborations on police and fire services have proved far more difficult to achieve. This paper explores the factors that contribute to successful interlocal agreements. Success is defined in terms of achieving agreement objectives, increasing the effectiveness of the public service, and increasing the efficiency of the public service. Influential factors of interest include the reason the interlocal agreement was created, the estimated costs and benefits of participation in the agreement, and the types and levels of communication between the parties to the agreement. Institutional Collective Action And Local Goverance, Richard C. Feiock

Working Group on Interlocal Services Cooperation

This paper elaborates the institutional collective action framework and its applications to cooperative interlocal service agreements among governments in metropolitan areas. It begins by outlining the information, negotiation, enforcement and agency cost that pose obstacles to cooperative interlocal arrangements. Next it identifies how these transaction costs, and the ability of local actors to overcome them, depend on: 1) characteristics of services; 2) characteristics of communities; 3) political institutions; and 4) structures of policy networks. Specific propositions regarding evolution and effectiveness of interlocal cooperation are advanced and an agenda to investigate institutional collective action among local governments is presented.
