Translated Opinions

Facts: The site known as Rachel’s tomb, which is situated in the outskirts of Bethlehem, is believed to be the tomb of the Biblical Matriarch Rachel and is a holy site to Jews. It is the third holiest site in Jewish tradition, after the Temple Mount and the Machpela Cave.

Because of the persistent terror attacks by Palestinians on Jewish targets since September 2000, and following the discovery of a terror cell that intended to attack a bus of worshippers on their way to the tomb, the respondent made an order to requisition land for the purpose of paving a …

Final Report: Program To Investigate Patterns Of Environmental Vs. In-Body Radioactivity Near The Brookhaven National Laboratory, Radiation And Public Health Project, Inc., Joseph J. Mangano

Radiation and Public Health Project, Inc.

The Radiation and Public Health Project (RPHP), a non profit research and education group, has collected and analyzed data on environmental and in-body radioactivity levels near the Brookhaven National Laboratories (BNL).

The work is important since BNL operated three nuclear reactors at the site in Suffolk County NY from 1950-1999. These reactors released considerable radioactivity into the air and water, contaminating the local environment. The other basis for the effort are certain patterns of health status in the local area, specifically:

- From 1979-2001, the Suffolk County cancer death rate (whites) was 12.6% above the national rate, but only 0.1% …

Radioactive Neighbor: Lawrence Livermore National Laboratory, The Radioactivist Campaign (Trac)

The RadioActivist Campaign

The Lawrence Livermore National Laboratory (LLNL) reports releases of radioactive and toxic materials into its surroundings. LLNL also monitors its environment for radioactive and toxic materials, with results published in an annual Environmental Report. LLNL’s radiological monitoring focuses on two radionuclides “often associated with LLNL operations”: hydrogen-3 (called tritium) and plutonium. Other radioactive by-products of nuclear fission and nuclear activation are not included in LLNL’s routine monitoring. Thus, neighbors of LLNL have to largely rely on LLNL to report its own sources of radioactivity (such as pipes, stacks, effluent, etc.). Livermore residents also have to rely on LLNL to report …

Reconsidering The Commission’S Treatment Of Tribal Courts, Kevin Washburn Feb 2005

Reconsidering The Commission’S Treatment Of Tribal Courts, Kevin Washburn

Faculty Scholarship

Since the U.S. Sentencing Commission first enacted the federal Sentencing Guidelines, the Guidelines have treated tribal courts in a manner that is impossible to reconcile with other modem federal policies of respect for tribal self-determination and self-governance. In refusing to count tribal convictions for purposes of routine calculation of criminal history, the Commission has disrespected tribal courts. The Commission's tribal courts policy is anachronistic and out of step with modem efforts to support tribal courts. The Commission should amend the guidelines to reflect the principle that misdemeanor convictions from tribal courts are entitled to the same level of respect as …
