Reasonable Suspicion And Mere Hunches, Craig S. Lerner Aug 2005

Reasonable Suspicion And Mere Hunches, Craig S. Lerner

George Mason University School of Law Working Papers Series

In Terry v. Ohio, Earl Warren held that police officers could temporarily detain a suspect, provided that they could articulate the “reasonable inferences” for their suspicion, and not merely allude to a “hunch.” Since Terry, the American legal system has discounted the “mere” hunches of police officers, requiring them to articulate “specific” and “objective” observations of fact to support their decision to conduct a stop and frisk. The officer’s intuitions, gut feelings and sixth sense about a situation are all disallowed.

This dichotomy between facts and intuitions is built on sand. Emotions and intuitions can be reasonable, and reasons are …

Crops, Guns & Commerce: A Game Theoretical Critique Of Gonzales V. Raich, Maxwell L. Stearns Aug 2005

Crops, Guns & Commerce: A Game Theoretical Critique Of Gonzales V. Raich, Maxwell L. Stearns

George Mason University School of Law Working Papers Series

In Gonzales v. Raich, the Supreme Court sustained an application of the Controlled Substances Act (“CSA”), banning all private use of marijuana, as applied to two women who had cultivated or otherwise acquired marijuana for the treatment of severe pain pursuant to the California Compassionate Use Act. Writing for the majority, Justice Stevens placed Raich at the intersection of two landmark Commerce Clause precedents: Wickard v. Filburn, the notorious 1942 decision, which upheld a penalty under the Agriculture Adjustment Act of 1938 applied to a local farmer who violated his wheat quota but who had used the modest excess portion …

Chasing The Track, Tony Nicholas Aug 2005

Chasing The Track, Tony Nicholas

Theses

This thesis explores the search for a creative process that satisfies my urge to combine photography with imagery and objects from personal and mass media sources, revealing the artist's hand in the work. This work also explores the use of a subject as a means to finding a working process and its importance in that discovery.

Auto racing motivated me to study photography, thus the use of automobile culture, with an emphasis on the subculture of auto racing is a key element in this work. Juxtaposing unrelated materials and imagery was a new experience. As I worked, the evolving imagery …

The Problematics Of The Pareto Principle, Daniel A. Farber Aug 2005

The Problematics Of The Pareto Principle, Daniel A. Farber

ExpressO

The Pareto Principle asserts in one form that an outcome which is unanimously preferred by individuals should be chosen by society; or in another form that an outcome should be chosen if it is preferred by at least one individual and the remaining members of society are indifferent. It is little wonder that this principle, which has the ring of a self-evident truth, has been the “gold standard” for law and economics. Despite its appeal, however, the Pareto Principle has limitations that are irrelevant in some spheres such as corporate law, but that may have serious import for fields such …

Reconceptualizing Due Process In Criminal Justice: Contributions From Law And Social Science, Christopher Slobogin Aug 2005

Reconceptualizing Due Process In Criminal Justice: Contributions From Law And Social Science, Christopher Slobogin

ExpressO

This article challenges the accepted wisdom, at least since the Supreme Court’s decision in Gault, that procedures in juvenile delinquency court should mimic the adult criminal process. The legal basis for this challenge is Gault itself, as well as the other Supreme Court cases that triggered the juvenile justice revolution of the past decades, for all of these cases relied on the due process clause, not the provisions of the Constitution that form the foundation for adult criminal procedure. That means that the central goal in juvenile justice is fundamental fairness, which does not have to be congruent with the …

Exploration Of Ideal Body Image Among African-American Women, Shannon Denise Nickens Aug 2005

Exploration Of Ideal Body Image Among African-American Women, Shannon Denise Nickens

Dissertations

Body image dissatisfaction is a pervasive problem, most notably among women, that is neither well understood nor well defined. Inconsistent and overly narrow definitions of body image make it difficult to draw conclusions regarding the degree and type of dissatisfaction across cultural and/or various ethnic groups. Thus far, research has largely focused on size, shape, and weight concerns, ignoring physical features that may be salient to women belonging to non-Caucasian ethnic groups. This study explored African-American (AA) preferences for weight, waist-to-hip ratio (WHR), and salient physical appearance attributes, as well as their identification with the ¿thin¿ ideal, racial identity salience, …

Culturally-Based Primary Prevention: An Alaskan Native Dance Group, RenéE Irene Culp Aug 2005

Culturally-Based Primary Prevention: An Alaskan Native Dance Group, RenéE Irene Culp

Psychology

This study investigated a culturally-based primary prevention program in Alaska. This program is a Native dance group that focuses on increasing the number of developmental assets within each member. Previous research has indicated that involvement in activities, such as the program described, may work to instill developmental assets, decreasing the likeliness of youths engaging in risk behaviors and increasing engagement in healthy behaviors. Findings from this study did not support the notion that youths who participate in a culturally-based primary prevention program demonstrate more assets of clinical significance than those youths who do not participate in such a program. Further, …

Imagining Ityoppia: Ethiopian Diaspora And Rastafarianism, Esther Sellassie Antohin Aug 2005

Imagining Ityoppia: Ethiopian Diaspora And Rastafarianism, Esther Sellassie Antohin

Anthropology

On a very general level, this thesis explores why Ethiopians and Rastafarians - who share Ityoppi, as a general point of reference - have historically been at odds. More specifically, however, I am interested in whether the rather recent emergence of Ethiopian communities in the United States - which share experiences of diaspora and processes of "imagining from afar" with Rastafarians - has resulted in a change of Ethiopian Americans' attitude toward adherents to Rastafarianism. The main aim of this study is to give an accurate account of the Ethiopian perspective of Rastafari, which has not been articulated till the …

Monitoring Stress Hormones In Rehabilitated And Captive Otariids, Lisa Petrauskas Aug 2005

Monitoring Stress Hormones In Rehabilitated And Captive Otariids, Lisa Petrauskas

Marine Biology

Cortisol and corticosterone are the primary mammalian stress hormones released in response to a perceived stressor. Cortisol is rapidly metabolized in the blood, while corticosterone is the dominant product in fecal material. Radioimmunoassay procedures to measure fecal corticosterone and serum cortisol in California sea lions were validated, and adrenal response to surgical and non-surgical procedures was assessed. Other objectives included seasonal and behavioral variability in fecal corticosterone concentrations in captive Steller sea lions, as well as adrenal response to various stressors of a rehabilitated Steller sea lion. There was a significant (P ... 0.05) adrenal response for rehabilitated California sea …

Content Analysis Of Undergraduate Courses And Course Content On The Armenian Genocide In United States Higher Education, Christina Berian Pelosky

Graduate Student Dissertations, Theses, Capstones, and Portfolios

The purpose of this study was to determine how many courses exist, or how much course content exists in Division IA colleges/universities regarding the Armenian Genocide in undergraduate higher education throughout the United States. Armenians throughout the world commemorate the genocide of 191 5 on April 24 each year to remember the slaughter and displacement of the thousands of Armenians during the rule of the Ottoman Empire (Balakian, 2003; Hovannisian, 1986; Melson, 1992; Miller & Miller, 1993). The Ottoman Empire succeeded in killing an estimated 1.5 million Armenians and eliminated the possibility of their living as a group in the …

The Development Of Professional Expertise Through Reflection In The Principalship, Eric Mclaren Aug 2005

The Development Of Professional Expertise Through Reflection In The Principalship, Eric Mclaren

Publications & Research

The study of principals as learners is important because the landscape of public education is changing. Schools are becoming more diverse and the demands on schools more varied and complex. The role of the principal is increasingly ambiguous, complex, and varied. Principals must adapt and develop'their professional practice. Effective principals learn from experience to meet the shifting expectations of the role and the needs of the school.

Multiple learning experiences help principals become more proficient in their jobs. Initial certification, induction into the role, continuing professional education, and learning from experiences are means to the development of expertise. This study …

Cultural Constraints In The Workplace: An Experiential Exercise Utilizing Hofstede’S Dimensions, Karen Kniep Blanton, John E. Barbuto Jr. Aug 2005

Cultural Constraints In The Workplace: An Experiential Exercise Utilizing Hofstede’S Dimensions, Karen Kniep Blanton, John E. Barbuto Jr.

Department of Agricultural Leadership, Education, and Communication: Faculty Publications

This article describes an original exercise developed to apply Hofstede’s cultural dimensions. The exercise creates simulated subcultures within a multinational organization. Managers are required to function in various subcultures as they work to develop an incentive plan with salespeople. Hofstede’s dimensions are reviewed, followed by the exercise. We provide purpose, preparation requirements, instructions for facilitating and processing the exercise, student reactions, and strategies for understanding and applying the concepts. The authors also assessed content retention derived from participating in the exercise. In preliminary tests, three independent studies demonstrate significant improvements in content knowledge.
