Don't Forget About The Me In Afscme: An Analysis Of Collective Bargaining In Municipalities, Michael L. Woods Jr. Jan 2005

Don't Forget About The Me In Afscme: An Analysis Of Collective Bargaining In Municipalities, Michael L. Woods Jr.

Masters Theses

Collective bargaining in the public sector is inherently political. Public unions negotiate either directly or indirectly with elected public officials. This thesis explores the political bargaining strategies adopted by municipal public unions and the inherent factors that surround the collective bargaining process (e.g. trust, state of the economy, community interest groups, and media). The intentions of this study were to see if these variables influenced negotiated wage increases and the likelihood of experiencing bargaining impasses. The findings suggest that public union political bargaining strategies positively affect negotiated wage increases. Trust, however, seems to evolve as the most important variable. Building …

Burnout And Job Dissatisfaction Among Practicing Illinois School Psychologists: A 1994 To 2004 Comparison, Nikolaus J. Hoffman

Masters Theses

The purpose of this study was to identify the primary variables associated with burnout among practicing Illinois school psychologists. More specifically, the purpose was to determine if the same variables that correlated highly with Illinois school psychologists burnout levels in a 1994 study by Niebrugge have held constant over the last decade. Survey materials used in the 1994 study, including the Maslach Burnout Inventory, a School Psychologists Stress Inventory, and a specially designed job satisfaction questionnaire were completed by a random sample of members of the Illinois School Psychologists Association (N = 52). As in the 1994 study, results suggested …

Review Of The Book Gender In Applied Communication Contexts, Anjali Ram Jan 2005

Review Of The Book Gender In Applied Communication Contexts, Anjali Ram

Arts & Sciences Faculty Publications

The best scholarship on gender is one that translates readily into advocacy, action, and intervention without blunting its theoretical teeth. The repertoire of 14 articles and four commentaries included in the book “Gender in Applied Communication Con-texts,” edited by Patrice M. Buzzanell, Helen Sterk, and Lynn H. Turner, clearly demonstrate a commitment to feminist praxis, while retaining a focus on theoretical engagement. Topics range from sexual harassment and breast cancer to telecommuting, mothering, and feminist pedagogy, as the authors in this collection attempt to address directly how gender is constructed and implicated in varied communication contexts.

Decadal-Scale Analysis Of Coastal Landslides Along The Big Sur Coast: Rates And Processes, Cheryl J. Hapke, Krystal R. Green Jan 2005

Decadal-Scale Analysis Of Coastal Landslides Along The Big Sur Coast: Rates And Processes, Cheryl J. Hapke, Krystal R. Green

Marine Science Faculty Publications

Landslides in the coastal mountains of Big Sur in Monterey and San Luis Obispo Counties are common, especially during the winter months. These frequent landslides regularly disrupt Coast Highway 1, by blocking the highway with boulders and/or debris, or undercutting the roadway. Historical documentation of landslide activity in this area indicates slide activity closed portions of the road prior to its completion in 1937. The California Department of Transportation (Caltrans) maintains the Coast Highway 1 corridor and recently established the Big Sur Coast Highway Management Plan (CHMP) to develop management practices that will best maintain the highway while minimizing impact …

Marine Science Faculty Publications

A collaborative project between the U.S. Geological Survey's Coastal and Marine Geology Program and the National Park Service (NPS) has been developed to create an inventory of geologic resources for National Park Service lands on the Big Island of Hawai’i. The NPS Geologic Resources Inventories are recognized as essential for the effective management, interpretation, and understanding of vital park resources. In general, there are three principal components of the inventories: geologic bibliographies, digital geologic maps, and geologic reports. The geologic reports are specific to each individual park and include information on the geologic features and processes that are important to …

A Call For Change: Improving Judicial Selection Methods, Jason J. Czarnezki Jan 2005

A Call For Change: Improving Judicial Selection Methods, Jason J. Czarnezki

Elisabeth Haub School of Law Faculty Publications

Empirical data show that, despite the significant electoral success of state court judges, elections still impact judicial decision making. Using the State of Wisconsin as an example, this Essay suggests that Wisconsin and other state legislatures, with the support of bar associations and academics, should revisit the historical underpinnings of judicial elections and consider both whether electing judges conforms with the historical goals of having an elected judiciary and whether the available empirical data support the belief that elected judges can be systematically consistent and independent in the decision making process.

Fear And Loathing In Constitutional Decision-Making, Christina E. Wells Jan 2005

Fear And Loathing In Constitutional Decision-Making, Christina E. Wells

Faculty Publications

National security crises are particularly difficult on the judiciary. Faced with a threat to the country's integrity, such cases require judges rationally and fairly to weigh this hefty interest against the rights of persons suspected of posing that very threat. Not surprisingly, judges have rarely lived up to this task as many have fallen sway to the same fear and prejudice that gripped the county during these times. Scholars have written extensively about judicial capitulation to fear and prejudice in such well-known cases as Schenck v. United States, Korematsu v. United States, and Dennis v. United States, with some lamenting …

Inner Work: Teaching and Learning (from) Within

”There lives the dearest freshness deep down things,” Gerald Manley Hopkins writes in God’s Grandeur, capturing in this line, as he sought to reveal through the marvelously unique sounds and rhythms of his poetry, the “inscape” or the unique inner essence of all natural things. “The dearest freshness deep down things” is also Parker Palmer’s focus in The Courage to Teach, where he argues for a teacher’s and a learner’s inner work: exploring “the inner landscape of the teaching self” because “[t]he more familiar we are with our inner …

Legal "Black Hole"? Extraterritorial State Action And International Treaty Law On Civil And Political Rights, Ralph Wilde Jan 2005

Legal "Black Hole"? Extraterritorial State Action And International Treaty Law On Civil And Political Rights, Ralph Wilde

Michigan Journal of International Law

This Article considers the significant role that extraterritorial activity is playing in the post-9/11 foreign policy of some States and the idea that this activity somehow takes place "outside" the law or, at least, outside an arena where legal norms apply as a matter of course rather than only when and to the extent that the State involved decides these norms will apply. It begins in Section II by mapping out the extraterritorial state activities conducted since 9/11, covering activities with a personalized object-such as the military action taken in Afghanistan against Al Qaeda-and activities with a spatial (territorial) object-such …

Transgovernmental Networks Vs. Democracy: The Case Of The European Information Privacy Network, Francesca Bignami Jan 2005

Transgovernmental Networks Vs. Democracy: The Case Of The European Information Privacy Network, Francesca Bignami

Michigan Journal of International Law

The perspective offered by this Article is twofold. The emergence of transgovernmental networks gives rise to two questions, one causal and the other normative. First, how do we explain transnational cooperation through networks? Why do governments and regulators choose to establish networks rather than retain virtually limitless discretion over policymaking, conditioned only by international legal obligations? Based on the author’s examination of the records of the intergovernmental negotiations on the Data Protection Directive, this Article concludes that one precondition for fettering national discretion through networks is common preferences among governments on the substance of the policy to be administered. Compared …

Corporate Responsibility: Ensuring Independent Judgment Of The General Counsel - A Look At Stock Options, Z. Jill Barclift

Faculty Scholarship

Recent corporate scandals and allegations of corporate fraud in public companies have most people asking how things went so wrong. When looking to assess blame for corporate malfeasance, many ask, “Where were the lawyers?” In several high-profile corporate fraud investigations, outside and in-house lawyers were criticized for not doing more to prevent corporate executives from violating the law, and several general counsels were charged with criminal misconduct by state and federal authorities. Why would the general counsel of a public corporation risk his or her career, reputation, and criminal prosecution to assist executives in perpetuating corporate fraud? The answer may …
