Corporate Human Rights Responsibilities, David Weissbrodt
Corporate Human Rights Responsibilities, David Weissbrodt
Articles
This article begins with a discussion of why one should be concerned or at least interested in the human rights conduct of corporations. Hence, the first part of the article presents a couple of historical and current situations which require attention and standard-setting. The second part focuses on past efforts of international law and particularly international human rights law to deal with such non-state actors as corporations. The third part discusses five major attributes of the U.N. Human Rights Norms which built upon the previous efforts to deal with the human rights conduct of corporations. The fourth part traces the …
Evaluation Of A Mechanical System For Reconstructing Soil On Surface Mined Land, John P. Fulton, Larry G. Wells
Evaluation Of A Mechanical System For Reconstructing Soil On Surface Mined Land, John P. Fulton, Larry G. Wells
Biosystems and Agricultural Engineering Faculty Publications
The existence of excessive soil compaction has hindered the surface mining industry from returning land to pre−mining productivity after reclamation, especially on prime farmland soils. Heavy earthmoving equipment used during reclamation tends to generate root−limiting bulk densities that adversely affect plant growth thereby decreasing yields. Therefore, the purpose of this study was to evaluate a mechanism, called the ‘Soil Regenerator,’ which reconstructs soil media at minimum bulk density during surface mine reclamation. The prototype soil forming mechanism was mounted on the front of a conventional bulldozer. Soil was placed in long narrow windrows by a scraper or bulldozer. As the …

Florida Statute 63.042(3): A Policy Of Exclusion, Melissa Cusack
Florida Statute 63.042(3): A Policy Of Exclusion, Melissa Cusack
USF St. Petersburg campus Honors Program Theses (Undergraduate)
Nearly thirty years ago the state of Florida launched a campaign against homosexual adoptions. What began in Miami with a public debate over a referendum to make discrimination based on sexual orientation unlawful ended with a community divided and a welfare system taxed even further. "In 1977, Florida became the first state to statutorily ban adoption by gay or lesbian adults by enacting the homosexual adoption provision. Currently, it is the only state with such a prohibition."
He Hath A Heart For Harping: Stephen Harper And Election Spending In A Spendthrift Age, Richard Haigh
He Hath A Heart For Harping: Stephen Harper And Election Spending In A Spendthrift Age, Richard Haigh
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
The decision by the Supreme Court of Canada in Harper v. Canada was not favourable to Stephen Harper. In a split decision, the Court held that the latest federal campaign spending limits were acceptable. This paper briefly examines the recent history of election financing laws in Canada and looks briefly at three distinct aspects of the Harper decision: The irony of Stephen Harper’s position in the case, evidential and conceptual problems associated with equating commercial speech with political speech, and an examination of whether financial restraints are of declining importance in an era where political influence is more subtly obtained. …

When Open Courts Meet Closed Government, David M. Paciocco
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
The law largely controls the degree to which the open court principle is respected. “Legal culture,” however, has as much to do with the fortunes of the “open court principle” as does the law. The law often provides only standards — not clear answers. The extent to which the open court principle is respected the refore comes down to attitude or the commitment to it among justice system participants. We are fortunate that this is a country with a long and demonstrated commitment to the open court principle. The terrorist attacks of 2001 have ushered in a heightened sense of …

Search And Seizure In 2004: Dialogue Or Dead-End?, Alan Young
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper explores recent judicial treatment of section 8 of the Charter of Rights and Freedoms and reaches the conclusion that judicial activism and judicial inactivity have created an ineffective incorporation of constitutional norms within Canadian police culture. A proper understanding of activism would dictate that the Supreme Court of Canada should seize the available opportunities to clarify the boundaries of police power and not issue narrow rulings under the guise of allowing the power to evolve incrementally under the common law. It is best to leave the question of police empowerment through new technology for Parliament and if, and …
Is There A Perfect Diet? A Comparison Between The Atkins, South Beach, And Metabolic Typing Diets., Neil Habgood
Is There A Perfect Diet? A Comparison Between The Atkins, South Beach, And Metabolic Typing Diets., Neil Habgood
USF St. Petersburg campus Honors Program Theses (Undergraduate)
This thesis will seek to answer the often perplexing question: "How should I eat in order to lose weight and feel better?" Is your goal to lose 10 pounds? Is your goal to lose 100 pounds? Or is your goal simply to live a healthy, pain-free lifestyle? In this paper I will examine two of the most popular diets today, The South Beach Diet and the Atkins Diet. I will compare these two diets to another diet known as The Metabolic Typing Diet. I will also explore the psychological impact of positive thinking and goals setting. Ultimately, I will be …

China's Nuclear Force Modernization, Lyle Goldstein
Newport Papers
Relations between Washington and Beijing improved swiftly in the wake of the 9/11 terrorist attacks, especially in comparison to the nadir that had been reached during the April 2001 EP-3 incident. This new tide of cooperation has included counterterrorism initiatives, regional partnership in such complex situations as Afghanistan and North Korea, and even some modest agreement on the importance of maintaining the status quo with respect to Taiwan's status.

The Elusive Ellen: Reconstructing The Life Of Ellen Dawson And The World Around Her., David Lee Mcmullen
USF St. Petersburg Campus Faculty Publications
This thesis is a life and times biography of Ellen Dawson (Kanki), 1900-1967, a working class Scottish woman who became a leading communist labor activist in the United States. As a young textile worker in Barrhead, she was influenced by the events of Red Clydeside, perhaps the most turbulent period of labor unrest in Scottish history. After World War I, she and her family migrated to Lancashire, where she worked first as a spinner and then as a weaver. In 1921, she lead her family to the United States, where she went to work in a textile mill on the …

Sentencing Guidelines In Minnesota, 1978-2003, Richard Frase
Sentencing Guidelines In Minnesota, 1978-2003, Richard Frase
Articles
This article examines the origins, purposes, evolution, and impact of Minnesota's pioneering sentencing guidelines reform. The Guidelines, related sentencing laws, and charging and sentencing practices have evolved considerably since 1980, and so have Minnesota's reform goals. Most of these goals have been achieved: sentences are more uniform and proportionate; policy formulation is more systematic and informed by data; sentencing has been coordinated with available correctional resources, avoiding prison overcrowding and ensuring that space is available to hold the most serious offenders; "truth in sentencing" has been achieved; custodial sanctions have been used sparingly; and the Guidelines remain fairly simple to …
