The Billable Hours Derby: Empirical Data On The Problems And Pressure Points, Susan Saab Fortney

This article considers the consequences of law firm use of the hourly billing method and the recent increase in billable hour requirements. Part I of this article describes the rationale and methodology of an empirical study conducted in 2005 that explored attorney work-life issues and employer efforts to assist attorneys in dealing with work-life conflicts. Part II summarizes select study findings related to billable hours requirements and pressure. Part III concludes by considering what forces and players will change the current course of conduct in which law firm leaders treat increases in billable hours expectations as a necessary evil.

The Availability Heuristic, Intuitive Cost-Benefit Analysis, And Climate Change, Cass R. Sunstein

Because risks are on all sides of social situations, it is not possible to be "precautionary" in general. The availability heuristic ensures that some risks stand out as particularly salient, whatever their actual magnitude. Taken together with intuitive cost-benefit balancing, the availability heuristic helps to explain differences across groups, cultures, and even nations in the assessment of precautions to reduce the risks associated with climate change. There are complex links among availability, social processes for the spreading of information, and predispositions. Do moral heuristics operate in the moral domain? If so, do they lead to moral errors? This brief essay offers an affirmative answer to both questions. In so doing, it responds to an essay by Gerd Gigerenzer on the nature of heuristics, moral and otherwise. While focused on morality, the discussion bears on the general debate between those who emphasize cognitive errors, sometimes produced by heuristics, and those who emphasize the frequent success of heuristics in producing sensible judgments in the real world. General claims are that it is contentious to see moral problems as ones of arithmetic, and that …

Elements Of Successful Interlocal Agreements: An Iowa Case Study , Kurt Thurmaier

This paper explores the factors that contribute to successful interlocal agreements. Success is defined in terms of achieving agreement objectives, increasing the effectiveness of the public service, and increasing the efficiency of the public service. Influential factors of interest include the reason the interlocal agreement was created, the estimated costs and benefits of participation in the agreement, and the types and levels of communication between the parties to the agreement. The paper reports results from a survey of local governments (including cities, counties, school districts) in Iowa that have filed an agreement with the state. The sample of about 1250 …

This article discusses a recent attempt by the U.S. Congress to provide for public financing of campaigns for the House of Representatives. Although a good start, this legislation would not go far enough to ensure that every voice has an opportunity to be heard in federal elections. My article discusses the strengths and weaknesses of this legislation and also provides suggested amendments to make this bill more effective should it become law.

Still Mortgaging The American Dream: Predatory Lending, Preemption, And Federally-Supported Lenders, Julia P. Forrester

This article discusses the continuing problem of predatory lending abuses in the subprime home mortgage lending market and federal and state attempts to address the problem. Over the protests of consumer advocates, federal agencies have recently issued regulations preempting state predatory lending statutes as applied to national banks and thrifts. In addition, Congress is considering legislation that would preempt state predatory lending laws for all lenders. The article considers the preemption debate, particularly in the context of federally-supported lenders–banks, thrifts, and the government-sponsored enterprises (GSEs), Fannie Mae and Freddie Mac. This article analyses the role of U.S. law schools in educating foreign lawyers and the increasingly competitive global market for graduate legal education. U.S. law schools have been at the forefront of this competition, but little has been reported about their graduate programs. This article presents original research on the programs and their students, drawn from interviews with directors of graduate programs at 35 U.S. law schools, information available on law school web sites about the programs, and interviews with graduates of U.S. graduate programs.
