The Elusive Balance Between Investor Protection And Wealth Creation, Barbara Black, Jill Gross
The Elusive Balance Between Investor Protection And Wealth Creation, Barbara Black, Jill Gross
Faculty Articles and Other Publications
The enactment of federal securities legislation in the 1930s codified the principle that investors should be shielded from securities fraud, but scholars and policymakers continue to debate the appropriate balance between protecting investors and encouraging capital formation. Congressional activity of the past decade reflects this tension. In the 1990s, Congress enacted two major pieces of legislation to restrict securities fraud class actions because of its belief that frivolous class actions were a drain on entrepreneurism. In 2002, after the EnronIW orldCom et al. corporate scandals, reflecting perhaps a sense that the earlier legislation had tipped the pendulum too far, Congress …

An Evidence-Based Approach To School Improvement: A Case Study Of The Victorian Catholic Education Office, Melbourne, Teresa Angelico
An Evidence-Based Approach To School Improvement: A Case Study Of The Victorian Catholic Education Office, Melbourne, Teresa Angelico
2005 - Using data to support learning
The evidence based approach is integral to efforts by the Victorian Catholic sector to continually improve its effectiveness. There has been a concerted effort in the Victorian Catholic sector to broaden the professional experience and judgement of system personnel, school leaders and teachers by locating it within the available evidence and generating research studies to continually explore and test it. Evidence generation and transfer have been instrumental in shaping the design of literacy and numeracy programs. There is an increasing emphasis on using evidence as a tool for professional learning and to inform decision making related to improving the overall performance of …

Social Support And Mental Health Outcomes In Battered Women, Alicia Kay Vallellanes, Kelley Ferris
Social Support And Mental Health Outcomes In Battered Women, Alicia Kay Vallellanes, Kelley Ferris
Theses Digitization Project
This study examined the relationship between perceived social support and negative mental health outcomes in battered women. Correlations between perceived social support and depression, anxiety, and post-traumatic stress disorder were analyzed. Perceived social support, particularly from family members, was found to be significantly related to mental health outcomes. Results indicate that agencies that work with battered women should include social support in the assessment and intervention processes. The study utilized a quantitative survey design with a sample of 120 battered women from four domestic violence agencies throughout Riverside and San Bernardino counties. Quantitative data analysis procedures, such as multivariate analysis …
The Limits Of Multiple Rights And Remedies: A Call For Revisiting The Law Of The Workplace, Ann C. Hodges
The Limits Of Multiple Rights And Remedies: A Call For Revisiting The Law Of The Workplace, Ann C. Hodges
Hofstra Labor & Employment Law Journal
Professor Hodges discusses the 2004 decision of the National Labor Relations Board in IBM Corp., and how this decision illustrates two major problems with current workplace regulation. First, there are two distinct but overlapping systems - the individual and the collective - which often collide. The result is, at best, an imperfect realization of rights under both systems, and perhaps more often, the sacrifice of rights under one to right under the other. Second, the multitude of forums available for litigation results in multiple claims arising out of the same action, as well as tribunals deciding issues outside their expertise. …

UIC John Marshall Journal of Information Technology & Privacy Law
Any discussion of European policies is a complicated one, in part because the word "Europe" means different things to different people. At the present time, the European Union has expanded to twenty-five countries and more countries may become provisional members within the next years. These countries represent a multitude of cultures, languages, and legal traditions so talking about a "European" approach to a given matter is to risk making inherently flawed generalizations about diverse peoples, cultures, and systems. However, one generalization is rather safe to assert: the traditional regulatory model in Europe has been based on a state-run monopoly structure …
