Improving Fairness And Accuracy In Food Stamp Fraud Investigations: Advocating Reform Under Food Stamp Regulations, David A. Super
Improving Fairness And Accuracy In Food Stamp Fraud Investigations: Advocating Reform Under Food Stamp Regulations, David A. Super
Faculty Scholarship
Some state food stamp agencies are overly aggressive in pursuing charges that claimants have committed intentional program violations. Just as failure to pursue allegations of fraud can undermine the Food Stamp Program’s goals, so can intimidation of claimants. States should take care to follow appropriate procedures in their investigations, and Food and Nutrition Service regulations offer ample grounds to advocate fair treatment of clients. Four key principles should guide states’ antifraud efforts.

Toward A New Federalism In State Civil Justice: Developing A Uniform Code Of State Civil Procedure Through A Collaborative Rule-Making Process, Glenn S. Koppel
Vanderbilt Law Review
There is a sense of "deja vu" to the vision of a uniform body of state procedural law applicable in every state court throughout the nation. "Swift v. Tysons'" dream of a nationally uniform body of state substantive common law that mirrored an evolving body of uniform federal common law never materialized because state courts refused to defer to federal common law, which was applied only in federal court. Swift itself was overturned in 1938 by the Supreme Court's ruling in "Erie Railroad v. Tompkins" that federal courts must defer to the substantive lawmaking authority of state courts. But almost …

Juvenile Delinquency Prevention Through The Alive Center (A Local Information And Volunteer Exchange), Stacia Wolf
Masters Theses & Specialist Projects
Risk and protective factors for juvenile delinquency are identified and addressed at national and local levels. A need for an information, referral, and volunteer center to reduce risk factors and promote protective factors in youth was identified in Warren County. The ALIVE Center (A Local Information and Volunteer Exchange) was founded to address this need. Qualitative research of services and programs offered by information, referral, and volunteer centers and a survey to specific local agencies as regards their use of the ALIVE Center was conducted to guide the development of services at the ALIVE Center. Information, resource, and referral centers …

In 2000, the authors published a book titled Elders, Crime, and the Criminal Justice System: Myth, Perceptions, and Reality in the 21st Century, in which several chapters were devoted to older adults’ interactions with the court system.1 Those chapters revealed that these interactions could be highly problematic for elders. In follow-up, this article is based on a project designed to address the overarching issue of whether and how judicial systems in the United States ensure that older adults (60 and older) are provided effective access to the courts, including both civil and criminal jurisdictions.2 In order to accomplish this …
Administrative Law Goes To War, Cass R. Sunstein
Administrative Law Goes To War, Cass R. Sunstein
Coase-Sandor Institute for Law & Economics Research Paper Series
What are the President's war-making powers? This essay, a brief reply to an article by Curtis Bradley and Jack Goldsmith, contends that the answer lies in administrative law, at least in the first instance. The President's authority often depends on what Congress has said, and under established principles, the President has a great deal of power to interpret ambiguities in congressional enactments – in war no less than in peace. The principal qualifications involve interpretive principles, also found in administrative law, that call for a narrow construction of presidential authority to invade constitutionally sensitive interests. The relevant arguments are illustrated …

An Integrated Conflict Management System For The Private Sector Workplace, Jessica Kettle
An Integrated Conflict Management System For The Private Sector Workplace, Jessica Kettle
Theses, Dissertations and Culminating Projects
This thesis begins with an examination inside the private sector workplace and the manner in which the corporate environment currently manages conflict. Upon defining the methods that seem to be best practices, this thesis will analyze what is valuable and what changes should be implemented for a more effective system. The model that is projected serves as a preliminary proposal of the content of an integrative conflict management system. It does not discuss in detail the cost / benefit analysis of a current structure versus what the costs the new system would assume. Also, its purpose is not to yet …

Since the turn of the century it has become undeniably apparent that many corporations, regardless of their size, have resorted to falsifying financial records in an attempt to mask the true financial health of the company. The reasons for such actions vary from attempts to shore up investor confidence to ensuring perks for corporate executives. These scandalous acts are not a characteristic of a certain type of business. They have occurred across a wide array of businesses including, but not limited to, power and energy, insurance, and telecommunications.
The most common form of record falsification comes in the form of …

'Treaties', 'Agreements', 'Contracts' And 'Commitments' - What's In A Name? The Legal Force And Meaning Of Different Forms Of Agreement Making, David Llewelyn, Maureen Tehan
Research Collection Yong Pung How School Of Law
The multi-dimensional nature of treaty and agreement making has assumed a central focus in the conduct of relations between Indigenous peoples and settlers in Australia and elsewhere. Whether as a means of resolving disputes, delivering government programmes, or establishing common understandings, agreement making, however defined and named, has become the key tool for engagement between Indigenous and non-Indigenous Australians. Agreements come in all shapes and sizes ranging from registered Indigenous Land Use Agreements (ILUA) to Statements of Commitment, Memorandums of Understanding and Regional Agreements. In other jurisdictions these may be called 'treaties'. This paper examines the plethora of agreements in …

For the past three decades, scholars have carefully considered the scope of the right of involuntarily committed psychiatric patients to refuse the administration of medication from a rich array of perspectives, including, but not limited to, clinical perspectives, civil libertarian perspectives, philosophical perspectives, and political perspectives. Yet, virtually all of this - remarkably - passes over what I believe is the single most important issue in real life. This issue is the most relevant to the actual (as opposed to paper) existence of the right and the actual (as opposed to paper) implementation of that right: the availability and adequacy …

Navigating Troubled Waters: Dealing With Personal Values When Representing Others, Mitchell M. Simon
Law Faculty Scholarship
Legal academics have long struggled to define the appropriate role a lawyer's moral judgment ought to play in client representation. In its simplest terms, the question is: Must a lawyer be a "hired gun," seeking all lawful objectives sought by a client, or may a lawyer act independently to avoid the harm a client's actions will cause innocent parties? Following disclosure of lawyer involvement in the Savings and Loan, Enron and WorldCom failures, many in society joined those scholars calling for greater moral responsibility.
In this article, I provide an analytical approach consistent with existing law and practice that seeks …
