The fourth panel discussion at the National Forum on Judicial Independence explores the way the public thinks about judicial independence and ways in which the media and members of the bar may affect judicial independence. The third panel discussion at the National Forum on Judicial Independence explores the tension between setting up specialized, problem-solving courts and maintaining judicial independence for the judges assigned to such courts. The discussion was led by then-AJA president Michael R. McAdam, a judge on the Kansas City (Mo.) Municipal Court. Panelists were Kevin S. Burke, a district judge and past chief judge of the Hennepin County (Minn.) District Court, and Mary Campbell McQueen, president of the National Center for State Courts. The elderly, along with people with disabilities or chronic illness, are most often dependent on some kind of formal or informal care. They are forced to move to a place where they can be cared for. Automatic health monitoring allows them to maintain their independence and continue living at home longer by continuously providing key health and activity information to caregivers. In this thesis, we present a novel technique, called the Health Monitoring System (HMS), which is a data-driven automated monitoring system for detecting changes in the patterns of activities/inactivity, health data and the living environment. Agency decision makers continue to shape just about every facet of l.fe as we know it. This Article discusses the peculiar procedures for obtaining final agency decisions and the review of those decisions. The survey period for this Article is from June 1, 2004 through May 31, 2005. Only cases from the Georgia Supreme Court and Georgia Court of Appeals have been reviewed, and there has been no attempt to usurp the prerogative of other authors for this issue. This Article surveys the death penalty decisions of the Georgia Supreme Court from June 1, 2004 through May 31, 2005. The cases discussed include those heard by the supreme court on interim appeal, on direct appeal, and on review of habeas corpus decisions. Focusing on the court's decisions that affect the trial and appeal of death penalty cases, this Article, with some exceptions, does not discuss holdings in capital cases that are common to all criminal appeals.

Right Must And Will Succeed: Excerpts From The Letters Of Sergeant Edmund Burke Wylie, Company K, 31st Iowa Infantry Regiment, Dieter C. Ullrich

Faculty Research at Morehead State University

Sergeant Burke Wylie of the 31st Iowa Infantry Regiment was an eyewitness to the events and series of historic battles that occurred between Chattanooga, Tennessee and Atlanta, Georgia. His vivid descriptions of the ferocity of combat, the geographic features of battlefields and the local inhabitants he encountered are well depicted in his correspondence. Sergeant Wylie's letters begin in December 1863 near Chattanooga and conclude in September 1864 outside of Atlanta.

This dissertation sought to critically analyze the university environment by examining how the representation practices of corporations articulate with the growing obesity epidemic. For this study, existing data from one southeastern university was collected to describe the articulation between the university and obesity. The analysis examined the collected information and used the cultural studies concept of representation to expose the articulation between obesity and the university setting, including the three major theoretical works of Martin Nestle, Henry Giroux, Michel Foucault, and Paulo Freire. The present descriptive study obtained nursing education administrators perceptions about the use and effectiveness of recruitment and retention strategies for African American male nursing students as compared to those strategies used for all nursing students in their nursing programs. A survey based on a review of the literature was developed by the researcher. The survey was mailed to 241 baccalaureate degree nursing education administrators in the 16 states and District of Columbia, Southern Regional Educational Board (SREB) region with a response rate of 39.3 %. Descriptive analysis of each strategy on the survey was calculated to determine use and effectiveness. …

Underlying a key purpose of the present review is the conviction that claims about what constitute effective literacy teaching, and of reading in particular, should be grounded in findings from rigorous evidence-based research. To this end, the present review of the research literature on teaching practices for students, with and without reading difficulties, relies largely, though not exclusively, on well-designed meta analytic syntheses that: (a) partial out methodological artefacts from the effect sizes; and (b) base their analyses on the actual procedures and components of instruction used in the studies reviewed. Dynamic Growth Rates Of Microbial Populations In Activated Sludge Systems, Peter George Stroot, Pascal E. Saikaly, Daniel B. Oerther

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

Results of mathematical modeling and whole cell 16S ribosomal RNA-targeted fluorescence in situ hybridizations challenge the widely held perception that microbial populations in "steady-state" activated sludge systems share a common net growth rate that is proportional to the inverse of the mean cell residence time. Our results are significant because they encourage bioprocess engineers to appreciate the differences in growth physiology among individual microbial populations in complex mixed microbial communities such as suspended growth activated sludge bioreactor systems.

The need for inclusion of comprehensive tobacco control education/training for health care providers continues to be stressed in publications addressing cessation services. The dental appointment presents an excellent opportunity to provide tobacco interventions to basically healthy people on regular intervals. The purpose of this study was twofold: 1) to assess the need (stage of change and concomitant need for tobacco cessation intervention) of dental hygiene patients at a Midwest dental hygiene clinic, and 2) to assess and compare the level of tobacco intervention education currently being offered by dental hygiene educators in a Midwestern state. The Federal Highway Administration (FHWA) requires state transportation agencies to submit a biennial report on local highway finances. The purpose of these reports is to provide FHWA with the data it needs to capture the financing of highway activities at the local level. Based on this information, it can identify trends in revenue, expenditures, investments, and program development, and in turn make decisions about future investments. A Study Of Attrition In A Respiratory Care Associate Degree Program In A Northeast Tennessee Community College., Donna D. Lilly

The Walters State Community College's Respiratory Care (WSCC RC) Program had a 33% attrition rate during a five-year period from 1999 through 2003. This study analyzed demographic, pre-admission, and academic variables to identify reasons for attrition within the WSCC RC program. The population size was 90 students; this was the entire population of five consecutive classes graduating during a five-year period from 1999 through 2003. The criterion variables included high school attended, gender, age, college-level GPA, college-level credit hours, and developmental requirements.

Statistical tests revealed that college-level GPA, college-level credit hours, and developmental requirements influenced persistence within the population. The …
