In September and October of this year, Hurricanes Katrina and Rita combined with an already-stretched world oil market to generate a spike in energy prices throughout the United States. The price spike naturally generated concern for the economy. Most recent recessions in the U.S. economy have been preceded by peaks in oil prices. Did the energy price spikes following Katrina and Rita derail the quickly-growing U.S. economy? The early evidence, and the economic outlook, suggest that the answer is no.
Despite the hurricanes, third quarter GDP growth continued to be very strong, exceeding 4%. Further, strong job growth returned to …

Comparison Of Two Surveys Of Head Injured Patients Presenting During A Calendar Year To An Urban Medical Centre 32 Years Apart, Rashid Jooma, Shahid Ahmed, Abdul Malik Zarden
Section of Neurosurgery
Objective: To study the patients presenting with head injuries to a tertiary hospital in Karachi during the year 2003.
Methods: During the calendar year 2003, a cross-sectional study was conducted of all patients presenting to the casualty department of Jinnah Postgraduate Medical Centre (JPMC) with head injury. Personal information was collected from the patient's attendants at presentation or later if the patient had been brought in by the emergency services as an unknown person. The circumstances of the injury were similarly established and the clinical features documented.
Results: During the year 2003, a total of 3008 patients reported to the …
Geochemical Evolution Of Ground Water In The Barton Springs Segment Of The Edwards Aquifer, Bradley D. Garner
Geochemical Evolution Of Ground Water In The Barton Springs Segment Of The Edwards Aquifer, Bradley D. Garner
KIP Theses and Dissertations
The water quality in a karst (limestone) aquifer changes over time, making the application of traditional hydrogeologic principles difficult or impossible. This research’s goal was to advance the understanding of the Barton Springs segment of the Edwards aquifer within and around Austin, Texas. This was accomplished by analyzing time‐series water‐quality data from long, medium, and short time scales. Analysis provided insights into direction of ground‐water flow, sources of spring discharge, and mixing of geochemically distinct waters in the aquifer. The results of this research are of interest because of the aquifers role as a drinking water supply, its role as …

The Health Status Of Southern Children: A Neglected Regional Disparity, Jeffrey Goldhagen, Radley Remo, Thomas Bryant, Peter Wludyka, Amy B. Dailey, David Wood, Graham Watts, William Livingood
Health Sciences Faculty Publications
Purpose: Great variations exist in child health outcomes among states in the United States, with southern states consistently ranked among the lowest in the country. Investigation of the geographical distribution of children’s health status and the regional factors contributing to these outcomes has been neglected. We attempted to identify the degree to which region of residence may be linked to health outcomes for children with the specific aim of determining whether living in the southern region of the United States is adversely associated with children’s health status.
Methods: A child health index (CHI) that ranked each state in the United …

Bayer Ag V. Housey Pharmaceuticals: Protection For Biotechnological Research Tools Under Section 271(G) Found Wanting, Matthew Barthalow
The University of New Hampshire Law Review
[Excerpt] "Research tools, a subset of biotechnological inventions protected by process patents, are “tools that scientists use in the laboratory, including cell lines, monoclonal antibodies, reagents, animal models, growth factors, combinatorial chemistry and DNA libraries, clones and cloning tools (such as PCR), methods, laboratory equipment and machines.” Many companies base their business models on the ability to find pharmaceutical products using their proprietary drug discovery research tools. Research tools used for drug discovery ‘include bioinformatic methods for identifying the interaction of certain proteins and their association with disease, methods for confirming protein targets, screening assays to identify molecules active against …

Determination Of Safe Buffer Width Of Roadway To Protect Human Health Form Harmful Nox Exposure, Hetal H. Bhatt
Civil Engineering Theses - Archive
According to the 2004 EPA Trends Report, US on-road transportation sources emit 36% of nitrogen oxides (NOx), 63% of carbon monoxide (CO), and 29% of volatile organic compounds (VOCs). This research determines a safe roadway buffer width to protect human health from air pollutant (NOx) exposure. The method was used to determine a buffer width for NOx along Great Southwest Parkway in Grand Prairie, Texas. NOx health effects include eye, nose, throat, and lung irritation; cough; shortness of breath; tiredness and nausea. In the Dallas Fort Worth region, where Grand Prairie is located, on-road vehicles contribute over 50 % of …
The "New Judicial Federalism" Before Its Time: A Comprehensive Review Of Economic Substantive Due Process Under State Constitutional Law Since 1940 And The Reasons For Its Recent Decline, Anthony B. Sanders
American University Law Review
The coming of the New Deal may have spelled the end of the Lochner era in the federal courts, but in the state courts Lochner's doctrine of economic substantive due process lives on. Since the New Deal, courts in almost every state have rebuffed the United States Supreme Court and have interpreted their own state constitutions' due process clauses to provide substantive protections to economic liberties. This Article presents a comprehensive survey of state court use of economic substantive due process since the New Deal. It includes an enumeration of every instance since 1940 of a state court of highest …
Disposal Of Bridge Paint Residue, Theodore Hopwood Ii, Sudhir Palle
Disposal Of Bridge Paint Residue, Theodore Hopwood Ii, Sudhir Palle
Kentucky Transportation Center Research Report
Paint residue generated by bridge maintenance painting commonly contains lead requiring the residue to be disposed of as a hazardous waste. Several alternatives are being investigated in this study, chemical stabilization and recycling as options for the Kentucky Transportation Cabinet (KYTC) to consider in addressing the waste stream generated by bridge maintenance painting operations.
In the initial portion of this study, four chemical stabilization materials were identified as candidates for xperimental/demonstration projects entailing maintenance painting. A recycling option was also provided. An experimental bridge painting project was let by KYTC to investigate the use of two chemical stabilizers and the …

It's As Clear As Mud: A Call To Amend The Federal Trademark Dilution Act Of 1995, Matthew C. Oesterle
Chicago-Kent Law Review
The Federal Trademark Dilution Act ("FTDA") has failed to protect, in the manner intended by Congress, the subset of trademarks that have achieved a high threshold of fame from subsequent uses that dilute or tarnish those trademarks. Courts have applied inconsistent measures of fame to the trademarks of the litigants before them and a poor wording choice in the drafting of the FTDA has led the Supreme Court to conclude that famous trademarks must sustain actual harm to their distinctiveness before their owners can receive the equitable remedy provided under the Act. Based on the legislative history of the Act, …

Solomon Huebner And The Development Of Life Insurance Sales Professionalism, 1905-1927, Drew Vandecreek
Faculty Articles, Papers, and Other Scholarship
In 1927 the National Association of Life Underwriters collaborated with Professor Solomon Huebner of the University of Pennsylvania to found the American College of Life Underwriters, an institution devoted to establishing and maintaining professional standards for the nation's life insurance salesmen. Their work sheds light on the new politics of expertise and associations that emerged in the 1920s. While many historians have portrayed the period's experts as purveyors of new, technical knowledge and apolitical agents of an inevitable modernity, Huebner in fact brought little real knowledge of insurance to his work. Instead, he introduced the industry's prevailing ideology of public …

Does Today's International Trade Agreement Bind Tomorrow's Citizen?, Gopal Sreenivasan
Does Today's International Trade Agreement Bind Tomorrow's Citizen?, Gopal Sreenivasan
Chicago-Kent Law Review
Focusing on the example of the General Agreement on Trade in Services (GATS), this Article begins by describing an important analogy between domestic Bills of Rights and enforceable international trade agreements. Both effectively disable the majority in later generations from certain exercises of its domestic legislative power. While there is some kind of democratic presumption against disabling the majority in any generation from exercising domestic legislative power, various argumentative strategies have been employed to defeat this presumption in the domestic constitutional case. This Article reviews these strategies and argues next that they cannot be generalized to the case of international …

Effect Of Gender On Lower Extremity Kinematics During Rapid Direction Changes: An Integrated Analysis Of Three Sports Movements, S. G. Mclean, K. B. Walker, Antonie J. Van Den Bogert
Mechanical Engineering Faculty Publications
Anterior cruciate ligament (ACL) injury is a common sports injury, particularly in females. Gender differences in knee kinematics have been observed for specific movements, but there is limited information on how these findings relate to other joints and other movements. Here we present an integrated analysis of hip, knee and ankle kinematics across three movements linked to non-contact ACL injury. It was hypothesised that there are gender differences in lower extremity kinematics, which are consistent across sports movements. Ten female and ten male NCAA basketball players had three-dimensional hip, knee and ankle kinematics quantified during the stance phase of sidestep, …

Medicaid Third-Party Liability And Claims For Restitution: Defining The Proper Role For The Tort System In Regulating The Food Industry, Coby Warren Logan
Journal of Food Law & Policy
This comment contends that tort liability can complement legislative and administrative government regulation of the food industry, providing sellers and manufacturers of food with an incentive to prevent consumers from over-consumption and becoming obese. Specifically, this comment supports the proposition that after government regulations are promulgated by Congress, claims should be allowed by state attorneys general to recoup Medicaid costs incurred in treating health conditions and illnesses caused by obesity.
