This Casenote examines the California Supreme Court's decision in Graham v. DaimlerChrysler concluding that the adoption of a stricter definition of "public interest" litigation and a comparative catalyst rule will serve to stem the flood of unproductive lawsuits in the high court's ill-conceived decision will otherwise unleash.

To accurately model metal mobility and bioavailability in soils and sediments, systematic sorption studies are needed using representative and well-characterized minerals. Two important surfaces are iron oxide and silica, which are ubiquitous and associated with one another in the environment playing important roles in metal distribution. The objectives of this research are to develop models for predicting speciation and mobility of toxic trace metal ions in groundwater, soils, and sediments when competing ions are present. The evolution of the law of the sea has been shaped largely by two notions, namely, freedom of navigation on the one hand, and restricted access on the other hand. The interaction between these two opposing notions has led to the acceptance of two compromise concepts, namely, the territorial sea and the right of innocent passage. These concepts have now been codified in the 1982 United Nations Convention on the Law of the Sea. The Nature Of Metropolitan Governance In Urban America: A Study Of Cooperation, Conflict, And Avoidance In The Kansas City Region, Curtis H. Wood

Working Group on Interlocal Services Cooperation

In this study I determine the dominant pattern of governance in the Kansas City metro based on interviews with 46 city administrative officers in cities over 2,500 in population. Consistent with theories of cooperation, I found that the dominant governance strategy is intergovernmental cooperation in the delivery of public services punctuated by conflict and avoidance/defection when intergovernmental service delivery arrangements involve infrequent interaction between the parties and when the presence and influence of the regional council of government is minimal.

Characteristics Of Service, Structure Of Networks, And Forms Of Inter-Local Cooperation In Local Service Production: Evidence From Florida, Manoj Shrestha

This paper empirically examines the interrelationships between service characteristics and the structure of networks among local jurisdictions using relational data across a set of diverse services from Pinellas County in Florida. In metropolitan areas, cities as well as counties work together to become increasingly efficient in public service delivery, and hence, engage into a variety of cooperative arrangements such as bilateral or multilateral service agreements. Increasing restraints on jurisdictions’ fiscal capacity have further forced them to look for cooperative avenues. Which Local Governments Cooperate On Public Safety?: Lessons From Michigan, Jered B. Carr, Kelly Leroux

Despite the increased interest in voluntary services cooperation, little is known about the factors that encourage local governments to enter into collaborative services arrangements with each other. This paper addresses this question through an analysis of interlocal contracting arrangements for police and fire services reported by 464 local governments in Michigan. While the contracting of public services is increasing common in local governments across the country, collaborations on police and fire services have proved far more difficult to achieve. This paper explores the factors that contribute to successful interlocal agreements. Success is defined in terms of achieving agreement objectives, increasing the effectiveness of the public service, and increasing the efficiency of the public service. Influential factors of interest include the reason the interlocal agreement was created, the estimated costs and benefits of participation in the agreement, and the types and levels of communication between the parties to the agreement. Imposes additional 71/2 cent tax on each cigarette distributed ($1.50 per pack), and indirectly increases tax on other tobacco products. Tax revenues allocated to specified purposes, including private hospital and physician emergency services, indigent healthcare, breast cancer research, tobacco use prevention, tobacco smuggling prevention and nursing education. Excludes tax revenue appropriations from constitutional appropriation limits and minimum school funding requirements (Proposition 98). Establishes criteria for receipt and use of tax revenues. Increases penalties for tobacco tax crimes. Provides that hospitals collaborating on emergency services are exempt from state antitrust laws. The purpose of the Year 2 Studies of the Midwest Child Care Research Consortium was to assess parent perceptions of child care choices and quality across four states. The states studied — Iowa, Kansas, Missouri, and Nebraska — comprise U.S. Department of Health and Human Services Region 7. The current study was conducted by asking 1,325 parents to complete a paper and pencil survey. The parents all had children receiving child care from providers who participated in an earlier telephone survey of 2,022 providers and in observations of 365 providers. Genomic Rearrangements By Line-1 Insertion-Mediated Deletion In The Human And Chimpanzee Lineages, Kyudong Han, Shurjo K. Sen, Jianxin Wang, Pauline A. Callinan, Jungnam Lee, Richard Cordaux, Ping Liang, Mark A. Batzer

Long INterspersed Elements (LINE-1s or L1s) are abundant non-LTR retrotransposons in mammalian genomes that are capable of insertional mutagenesis. They have been associated with target site deletions upon insertion in cell culture studies of retrotransposition. Here, we report 50 deletion events in the human and chimpanzee genomes directly linked to the insertion of L1 elements, resulting in the loss of ∼18 kb of sequence from the human genome and ∼15 kb from the chimpanzee genome. Our data suggest that during the primate radiation, L1 insertions may have deleted up to 7.5 Mb of target genomic sequences. While the results of …

Institutional Collective Action And Local Goverance, Richard C. Feiock

Working Group on Interlocal Services Cooperation

This paper elaborates the institutional collective action framework and its applications to cooperative interlocal service agreements among governments in metropolitan areas. It begins by outlining the information, negotiation, enforcement and agency cost that pose obstacles to cooperative interlocal arrangements. Next it identifies how these transaction costs, and the ability of local actors to overcome them, depend on: 1) characteristics of services; 2) characteristics of communities; 3) political institutions; and 4) structures of policy networks. Specific propositions regarding evolution and effectiveness of interlocal cooperation are advanced and an agenda to investigate institutional collective action among local governments is presented.
