Intellectual Property Implications In A Virtual Reality Environment, 4 J. Marshall Rev. Intell. Prop. L. 483 (2005), Timir Chheda Jan 2005

Intellectual Property Implications In A Virtual Reality Environment, 4 J. Marshall Rev. Intell. Prop. L. 483 (2005), Timir Chheda

UIC Review of Intellectual Property Law

What will become of intellectual property interests in a world where virtual reality is a fact of life? To ponder this question we must step back from the sophisticated judicially created tests built around a framework of policy suited for modern reality and first consider whether such policy is viable given a virtual reality environment. Only then may we consider if the tests appropriately further such policy, and if not, modify the tests accordingly. This comment considers the policy and tests implicated when copyright, trademark, and patent law pass through the looking-glass and enter the realm of virtual reality.

"As The Federal Circuit Turns": The Supreme Court's Consideration Of Merck V. Integra And The Safe Harbor Provision, 4 J. Marshall Rev. Intell. Prop. L. 368 (2005), Blair M. Jacobs, Christina A. Ondrick Jan 2005

"As The Federal Circuit Turns": The Supreme Court's Consideration Of Merck V. Integra And The Safe Harbor Provision, 4 J. Marshall Rev. Intell. Prop. L. 368 (2005), Blair M. Jacobs, Christina A. Ondrick

UIC Review of Intellectual Property Law

The Hatch-Waxman Act was enacted to balance the competing interests in the pharmaceutical marketplace between brand name and generic drug manufacturers. In the twenty years since its inception, the safe harbor provision contained in § 271(e)(1), has been interpreted to provide broad protection to those involved in research activities. However, in 2003, the Federal Circuit narrowly interpreted the safe harbor provision in a move that could potentially frustrate future research and improvements on patented technologies. Merck v. Integra is currently before the United States Supreme Court, who has the challenge of unraveling the competing interests involved. In order to encourage …

Patent Tying Agreements: Presumptively Illegal?, 5 J. Marshall Rev. Intell. Prop. L. 94 (2005), Alison K. Hayden Jan 2005

Patent Tying Agreements: Presumptively Illegal?, 5 J. Marshall Rev. Intell. Prop. L. 94 (2005), Alison K. Hayden

UIC Review of Intellectual Property Law

On January 25, 2005, the CAFC decided the case of Independent Ink, Inc. v. Illinois Tool Works, Inc., holding that market power will be presumed in a tying agreement whenever a tying product is patented. This rule puts patent holders at a disadvantage, and will increase the amount of antitrust lawsuits brought against patent holders and holders of other exclusive intellectual property rights. Indeed, this rule conflicts with the intended effect of antitrust law. This comment proposes that tying agreements involving a patented product be evaluated the same way as all other tying agreements, and that the presumption of market …

Claim Preambles And The Unassailable Patent Claim, 5 J. Marshall Rev. Intell. Prop. L. 121 (2005), Kyle D. Petaja Jan 2005

Claim Preambles And The Unassailable Patent Claim, 5 J. Marshall Rev. Intell. Prop. L. 121 (2005), Kyle D. Petaja

UIC Review of Intellectual Property Law

In order to diminish the extensive confusion surrounding claim preambles, one must not consider what a preamble should do; rather, it is helpful to consider what a preamble should not do. Traditionally, a preamble is defined as an introduction to a statute or deed stating the document’s basis, purpose, aim, justification, and objective. However, in patents, a claim preamble does not serve this purpose. While a preamble undeniably functions as an introduction to the rest of the claim, that claim is limited in scope and therefore, so too, is the preamble. The basis, purpose, aim, justification, and objective of the …

Policies And Procedures Manual For The Niu Atep, Lisa-Marie Shewalter Jan 2005

Policies And Procedures Manual For The Niu Atep, Lisa-Marie Shewalter

Honors Capstones

The purpose of this project was to create uniform communication between the NIU Athletic Training Education Program (ATEP) students and faculty at the ATEP clinical sites. Students involved in the ATEP are placed at various schools in the area as part of their clinical education and supervise all sports practices and activities. There is a potentially dangerous communication gap that currently exists between these allied health faculty and students. This creates a need for consistent and open communication so that in case of emergency, all ATEP members will know what to do. To solve this problem, the process included three …

Truth Or Consequences In Legal Scholarship?, David R. Barnhizer Jan 2005

Truth Or Consequences In Legal Scholarship?, David R. Barnhizer

Law Faculty Articles and Essays

There has been an erosion of the ideal of truth as a guiding force for what we do. This includes a dishonoring of the tradition of the truth-seeking function of scholars. For the university-based intellectual, including legal scholars, the problem with commitments to ends other than truth-seeking is that once we accept a mission distinct from the pursuit of truth and honest discourse, most of the remaining options are suspect - including falseness, hypocrisy, self-deception, subordination of self to a collective, profit, dogmatism, devotion to tradition, and propaganda.

Although what we intend by the idea of truth - legal, scientific, …

What You Don't Know Can Hurt You: The Importance Of Information In The Battle Against Environmental Class And Racial Discrimination, Browne C. Lewis Jan 2005

What You Don't Know Can Hurt You: The Importance Of Information In The Battle Against Environmental Class And Racial Discrimination, Browne C. Lewis

Law Faculty Articles and Essays

People across the country have witnessed the quality of their local environment decline in the name of progress but Lewis argues that tow-income and minority persons have observed the disproportionate placement of environmental hazards in their communities. That disparity has partially resulted from environmental discrimination based upon class and race. Acknowledging unequal treatment of low-income and minority persons has led to the development of the concept of "environmental justice. "

The premise of this Article is that, in order to effectively combat environmental discrimination, people must have access to quality information. Information may be used as a remedial measure. This …

The Role Of Connective Tissue Growth Factor (Ctgf) In Fibrosis Associated With Intestinal Neuroendocrine Tumors, Michael David Shapiro Jan 2005

The Role Of Connective Tissue Growth Factor (Ctgf) In Fibrosis Associated With Intestinal Neuroendocrine Tumors, Michael David Shapiro

Yale Medicine Thesis Digital Library

Carcinoid tumors of the small bowel often present with fibrosis in the peritumoral tissues, distant in the heart or lungs, and locally in the peritoneal cavity. The mechanism of the fibroblastic lesions in patients with small bowel carcinoids is unclear and their timely diagnosis impossible. There exists no test to determine the risk of fibrosis, detect its presence, or monitor its progression once discovered. Furthermore, no current therapy protects against such fibrosis. We have proposed that CTGF, a mediator of the profibrotic activities of TGFâ1 (a known regulator of fibrosis)is directly involved in the genesis of ileal carcinoid-related fibrosis. The …

Identifying Attitudes And Deterring Factors Toward Continuing Education Among Certified Athletic Trainers, Brian J. Hughes Jan 2005

Identifying Attitudes And Deterring Factors Toward Continuing Education Among Certified Athletic Trainers, Brian J. Hughes

Internet Journal of Allied Health Sciences and Practice

Objective: To explore the perceived attitudes toward continuing education and the deterrents to continuing education for certified athletic trainers (ATCs). Design and Setting: Data were collected using the Adults Attitudes Towards Continuing Education Scale (AATCES) instrument, Deterrents to Participation Scale-General (DPS-G) instrument, and self-reported demographics. Subjects: An imbedded on-line questionnaire was e-mailed three times in a 6-week period to ATCs who subscribe to the athletic trainers listserv at Indiana State University and the professional athletic trainers education listserv at Findlay University. The sample of this study consisted of approximately 1,200 ATCs of which 268 answered and returned the survey, a …

Concurrent Validity Of Borg’S Rating Of Perceived Exertion In African-American Young Adults, Employing Heart Rate As The Standard, Spiridon G. Karavatas, Kamran Tavakol Jan 2005

Concurrent Validity Of Borg’S Rating Of Perceived Exertion In African-American Young Adults, Employing Heart Rate As The Standard, Spiridon G. Karavatas, Kamran Tavakol

Internet Journal of Allied Health Sciences and Practice

Borg’s Rating of Perceived Exertion (RPE) is a simple and convenient method of monitoring exercise intensity; however, the correlation between RPE and heart rate (HR) is not always consistent. This pilot study examined the criterion-based validity of RPE versus heart rate. Twelve fasting, healthy African-American volunteers at ages of 21-41 years performed a supervised, 45-minute brisk walk test on a treadmill over three consecutive days. Throughout the test, each subject was asked the RPE every five minutes. The subjects' heart rates were monitored continuously and recorded every minute. The overall correlation coefficient, r, between RPE and HR for all data …

The Predictive Value Of Gross Motor Development, Posture And Upper Quadrant Stability For Tmd In Children And Young Adults: A Preliminary Study, Leah Nof, Rebecca S. Rosenthal Jan 2005

The Predictive Value Of Gross Motor Development, Posture And Upper Quadrant Stability For Tmd In Children And Young Adults: A Preliminary Study, Leah Nof, Rebecca S. Rosenthal

Internet Journal of Allied Health Sciences and Practice

Purpose: This study investigated the relationship of onset of independent walking, upper quadrant stability and head posture and their value as predictors of temporomandibular dysfunction (TMD). Method: Quasiexperimental nonequivalent posttest design study of forty-seven subjects, ages 9 to 29, who were symptomatic or asymptomatic for TMD. Age of independent walking was recorded; temporomandibular joint (TMJ) function was examined; strength of upper quadrant musculature was tested; scapulae distances from corresponding spinous processes were measured; and standing posture was assessed. Results: Significant differences in age of onset of walking, rhomboid strength, scapulae distance from the spinous processes, and head posture were found …

Renal Ischemia And Reperfusion Activates The Eif2 Alpha Kinase Perk, Heather L. Montie, Foaz Kayali, Adam J. Haezebrouck, Noreen F. Rossi, Donald J. Degracia

PCOM Scholarly Works

Inhibition of protein synthesis occurs in the post-ischemic reperfused kidney but the molecular mechanism of renal translation arrest is unknown. Several pathways have been identified whereby cell stress inhibits translation initiation via phosphorylation of the alpha subunit of eukaryotic initiation factor 2 (eIF2a, phospho-form eIF2a(P)]. Here, we report a 20-fold increase in eIF2a(P) in kidney homogenates following 10 min of cardiac arrest-induced ischemia and 10 min reperfusion. Using immunohistochemistry, we observed eIF2a(P) in tubular epithelial cells in both cortex and medulla, where the greatest eIF2a(P) staining was found in epithelial cells of the so-called watershed area at the corticomedullary junction. …

Intelligent Sensors: An Integrated Systems Approach, Ajay Mahajan, Sanjeevi Chitikeshi, Pavan Bandhil, Lucas Utterback, Fernando Figueroa

Mechanical Engineering Faculty Research

The need for intelligent sensors as a critical component for Integrated System Health Management (ISHM) is fairly well recognized by now. Even the definition of what constitutes an intelligent sensor (or smart sensor) is well documented and stems from an intuitive desire to get the best quality measurement data that forms the basis of any complex health monitoring and/or management system. If the sensors, i.e. the elements closest to the measurand, are unreliable then the whole system works with a tremendous handicap. Hence, there has always been a desire to distribute intelligence down to the sensor level, and give it …
