2004: A Year Of Mixed Messages From The Court, Jamie Cameron Jan 2005

2004: A Year Of Mixed Messages From The Court, Jamie Cameron

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Professor Cameron provides an overview of the 2004 Supreme Court jurisprudence and states that despite the recent Chaoulli case the Court under Chief Justice McLachlin remains cautious choosing its moments of intervention under the Charter with care. Those who advocate strong judicial enforcement of Charter entitlements must have been sorely disappointed from the end of 2003 to the present. The Court dismissed a number of Charter claims though those losses were offset by the Demers, Vancouver Sun (Re), and Mann decisions. Last fall, the Court shifted to a no-nonsense style of decision-making which, spoke in one voice and resolved Charter …

Keynote Address: Law And Politics In The Canadian Constitutional Tradition, Michael Ignatieff Jan 2005

Keynote Address: Law And Politics In The Canadian Constitutional Tradition, Michael Ignatieff

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Once again we are approaching one of those moments in Canada in which constitutional law becomes central to our politics. The fundamental cost of the current political crisis is its impact on the national unity of our country. Whenever the next election comes it might result in the failure of any of the federal parties to secure national representation in all our regions, particularly in Quebec. Professor Ignatieff takes issue with those who believe that politics does not need ideas and those who would avoid constitutional discussion. He believes the challenge to federalism should be met head on saying that …

What Is Equality?: The Winding Course Of Judicial Interpretation, Peter W. Hogg Jan 2005

What Is Equality?: The Winding Course Of Judicial Interpretation, Peter W. Hogg

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

It has been 20 years since section 15 of the Charter came into force. In this paper, Professor Hogg traces the “winding course” of judicial interpretation of section 15. The Supreme Court of Canada has changed the ground rules every few years as the judges have journeyed along that winding course. It has been a serious problem for any commentator foolish enough to try and keep a treatise on constitutional law up to date. Professor Hogg discusses the difficulty of applying a guarantee of equality focusing on cases from Andrews to Law and cases subsequent to Law and states that …

Equality Rights And Social Benefit Programs, D. Geoffrey Cowper Q.C. Jan 2005

Equality Rights And Social Benefit Programs, D. Geoffrey Cowper Q.C.

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

In Auton v. British Columbia, our courts faced a perfect storm created by colliding social, political, and legal forces. The end result of the litigation in Canada was a case described by the Supreme Court as “the first case of this type to reach this court.” in the view of the Supreme Court, the unanimous findings in the lower court had been built upon an incorrect premise that the provincial medicare scheme conferred a statutory right to public funding for all medically necessary services. The Court concluded that outside these core medical services, the statute had granted administrative discretion as …

Reversal Of Fortune: Litigating Health Care Reform In Auton V. British Columbia, Christopher P. Manfredi, Antonia Maioni

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

In June 2004 the Supreme Court heard oral arguments in Chaoulli v.Quebec (Attorney General) and Auton (Guardian ad litem of) v. British Columbia (Attorney General). at issue in Chaoulli was the constitutionality of legal restrictions on the private provision of health care; at issue in Auton was the constitutionality of British Columbia’s decision not to fund a specific treatment for autism within its public health care system. Chaoulli and Auton are the most visible manifestations of an increasingly common phenomenon: The use of rights-based litigation as an instrument of health care policy reform. This paper focuses on Auton as an …

The Evolving Approach To Section 15(1): Diminished Rights Or Bolder Communities?, Roslyn J. Levine Q.C., Jonathon W. Penney Jan 2005

The Evolving Approach To Section 15(1): Diminished Rights Or Bolder Communities?, Roslyn J. Levine Q.C., Jonathon W. Penney

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Inevitably, cases of complex and far reaching constitutional issues form a dynamic platform on which earlier conflicts within the case law are resolved and new ones develop. One concern that refuses resolution, to this point, is the precise balance between the values and interests that define the right to equality under section 15 of the Charter, and those that characterize justification, under section 1. Drawing on the mes laid out in the modern communitarian movement, the authors suggest that in 2004, the Court embarked on a more communitarian approach to the values and interests considered in section 15, showing greater …

Freedom Of Expression And The Law Of The Democratic Process, Colin Feasby Jan 2005

Freedom Of Expression And The Law Of The Democratic Process, Colin Feasby

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The author considers the Harper v. Canada case concerning spending limits on individuals and groups other than candidates and political parties in the context of the larger landscape of Canadian campaign finance jurisprudence. The paper begins by reviewing the vibrant academic debate over law of the democratic process issues and noting the Canadian legal academy's surprising lack of attention to this subject area. The egalitarian the ory of election regulation that figures prominently in Harper is reviewed and it is suggested that the the ory led the Court to be insufficiently rigorous in its review of the spending limits in …

Selective Field Effects On Intracellular Vacuoles And Vesicle Membranes With Nanosecond Electric Pulses, Ephrem Tekle, Hammou Oubrahim, Sergey M. Dzekunov, Juergen F. Kolb, Karl H. Schoenbach Jan 2005

Selective Field Effects On Intracellular Vacuoles And Vesicle Membranes With Nanosecond Electric Pulses, Ephrem Tekle, Hammou Oubrahim, Sergey M. Dzekunov, Juergen F. Kolb, Karl H. Schoenbach

Bioelectrics Publications

Electric pulses across intact vesicles and cells can lead to transient increase in permeability of their membranes. We studied the integrity of these membranes in response to external electric pulses of high amplitude and submicrosecond duration with a primary aim of achieving selective permeabilization. These effects were examined in two separate model systems comprising of 1), a mixed population of 1,2-di-oleoyl-sn-glycero-3-phosphocholine phospholipid vesicles and in 2), single COS-7 cells, in which large endosomal membrane vacuoles were induced by stimulated endocytosis. It has been shown that large and rapidly varying external electric fields, with pulses shorter than the charging time of …

Simulations Of Nanopore Formation And Phosphatidylserine Externalization In Lipid Membranes Subjected To A High-Intensity, Ultrashort Electric Pulse, Q. Hu, R. P. Joshi, K. H. Schoenbach Jan 2005

Simulations Of Nanopore Formation And Phosphatidylserine Externalization In Lipid Membranes Subjected To A High-Intensity, Ultrashort Electric Pulse, Q. Hu, R. P. Joshi, K. H. Schoenbach

Bioelectrics Publications

A combined MD simulator and time dependent Laplace solver are used to analyze the electrically driven phosphatidylserine externalization process in cells. Time dependent details of nanopore formation at cell membranes in response to a high-intensity (100kV∕cm), ultrashort (10ns) electric pulse are also probed. Our results show that nanosized pores could typically be formed within about 5ns. These predictions are in very good agreement with recent experimental data. It is also demonstrated that defect formation and PS externalization in membranes should begin on the anode side. Finally, the simulations confirm that PS externalization is a nanopore facilitated event, rather than the …

The Problem Of Reallocation In A Regulated Riparian System: Examining The Law In Georgia, Wilson Barmeyer Jan 2005

The Problem Of Reallocation In A Regulated Riparian System: Examining The Law In Georgia, Wilson Barmeyer

Georgia Law Review

There has been considerable debate over creating a market for water withdrawal permits in Georgia. Water market proponents argue that Georgia currently lacks the tools to reallocate water efficiently and to sustain continued economic growth. Opponents argue that a market is an inappropriate way for Georgia to introduce economic incentives into water management. This Note rejects the dichotomous choice between market and non market institutions. Instead, it presents a range of water reallocation mechanisms and argues that water supply solutions should be tailored to meet specific problems and objectives. Such an approach emphasizes the need for regional planning and management …

Spatial Distribution Of Land Type In Regression Models Of Pollutant Loading Jan 2005

Spatial Distribution Of Land Type In Regression Models Of Pollutant Loading

Journal of Spatial Hydrology

This paper proposes a method to improve landscape-pollution interaction regression models through the inclusion of a variable that describes the spatial distribution of a land type with respect to the pattern of runoff within a drainage catchment. The proposed index is used as an independent variable to enhance the strength, as quantified by R2 values, of regression relationships between empirical observations of in-stream pollutant concentrations and land type by considering the spatial distribution of key land-type categories within the sample point’s drainage area. We present an index that adds a new dimension of explanatory power when used in conjunction …

Early Mormon And Shaker Visions Of Sanctified Community, J. Spencer Fluhman Jan 2005

Early Mormon And Shaker Visions Of Sanctified Community, J. Spencer Fluhman

BYU Studies

Polly Knight's health was failing as she and her family trudged toward western Missouri. Having accepted Joseph Smith Jr. as God's prophet on earth, the Knights left heir Colesville, New York, farm and joined with other Mormon converts at Kirtland, Ohio, in 1831. Finding a brief respite there, they again set out, this time for the city of "Zion" that Joseph Smith said they would help build in Jackson County, Missouri. Worried that Polly was too ill to complete the trek, her family considered stopping in hopes she might recover. But "she would not consent to stop traveling," recalled her …

Novoselov, Mario Albrecht, Deame Hua, Alain Lescure, Thomas Lengauer, Alain Krol, Vadim N. Gladyshev, Roderic Guigó

Department of Biochemistry: Faculty Publications

Selenoproteins are a diverse group of proteins that contain selenocysteine (Sec), the 21st amino acid. In the genetic code, UGA serves as a termination signal and a Sec codon. This dual role has precluded the automatic annotation of selenoproteins. Recent advances in the computational identification of selenoprotein genes have provided a first glimpse of the size, functions, and phylogenetic diversity of eukaryotic selenoproteomes. Here, we describe the identification of a selenoprotein family named SelJ. In contrast to known selenoproteins, SelJ appears to be restricted to actinopterygian fishes and sea urchin, with Cys homologues only found in cnidarians. SelJ shows significant …

Computer-Assisted Docking Of Flavodoxin With The Atp:Co(I)Rrinoid Adenosyltransferase (Coba) Enzyme Reveals Residues Critical For Protein-Protein Interactions But Not For Catalysis, Nicole R. Baun, Jorge C. Escalante-Semerena Jan 2005

Escalante-Semerena

Department of Biochemistry: Faculty Publications

The activity of the housekeeping ATP:co(I)rrinoid adenosyltransferase

(CobA) enzyme of Salmonella enterica sv. Typhimurium

is required to adenosylate de novo biosynthetic intermediates

of adenosylcobalamin and to salvage incomplete and complete

corrinoids from the environment of this bacterium. In vitro,

reduced flavodoxin (FldA) provides an electron to generate the

co(I)rrinoid substrate in the CobA active site. To understand how

CobAand FldA interact, a computer model of aCobA-FldA complex

was generated. This model was used to guide the introduction of

mutations into CobA using site-directed mutagenesis and the synthesis

of a peptide mimic of FldA. Residues Arg-9 and Arg-165 of

CobA …

The Structure Of A T=169d Algal Virus, Pbcv-1, At 15Å Resolution, X. Yan, V. Bowman, N. H. Olson, James Gurnon, James L. Van Etten, Michael G. Rossmann, T. S. Baker

James Van Etten Publications

Paramecium bursaria chlorella virus 1 (PBCV-1) (genus Chlorovirus, family Phycodnaviridae), infects certain unicellular, exsymbiotic, chlorella-like green algae [1]. The PBCV-1 virion (~1x109 Da) has a linear dsDNA genome (330kbp) and contains at least 100 different proteins [1, unpublished data]. A published cryo-electron microscopy and three-dimensional (3D) image reconstruction of PBCV-1 (26Å resolution) revealed that the outer icosahedral glycoprotein capsid, with a maximum diameter of 1,900Å along the five-fold axis, consists of 1680 trimeric capsomers (trimer) and 12 pentameric capsomers (pentamer) [2]. These capsomers are arranged on a T=169d (h=7, k=8) quasi-equivalent lattice. The trimers and pentamers are organized into 20 …
