Migration And Home Gardens In The Brahmaputra Valley, Assam, India, Rahul J. Shrivastava, Joel T. Heinen Jan 2005

Migration And Home Gardens In The Brahmaputra Valley, Assam, India, Rahul J. Shrivastava, Joel T. Heinen

Journal of Ecological Anthropology

The Brahmaputra is the largest river system in northeast India. Its valley, in the State of Assam, is home to the Assamese people, indigenous Mishing and Karbi tribes, and Kaziranga National Park. A spectacular array of wildlife shares the floodplain including the endangered Asian elephant, tiger, one-horned rhinoceros and wild buffalo. The fertile floodplain and tea estates have attracted immigrants from within India and from neighboring countries. Migration has been linked to Assam's high population density and agriculture expansion. Based on household surveys in 37 villages in the park's periphery, we compared home garden productivity and economic return among residents …

Human Services Needs Assessment - Qualitative Data: Public Forums, Mail Surveys, Focus Groups, And Interviews, Julienne Giard, Peter Gamache

Mental Health Law & Policy Faculty Publications

Researchers at the Florida Mental Health Institute, University of South Florida, under contract to the Pinellas County Human Services Department, collected data over several months in 2004 from people in Pinellas County for a human services needs assessment. Human Services was defined in collaboration with the county as including four areas: homeless services, health care, mental health and substance abuse services, and basic needs. This report details the methods and findings from data collected at public forums, focus groups, key informant interviews, and through open-ended questions on the mail surveys to providers and citizens/consumers.

Programmatic Implications Of A Cost Study Of Home-Based Care Programs In South Africa, Rick Homan, Catherine Searle Jan 2005

Programmatic Implications Of A Cost Study Of Home-Based Care Programs In South Africa, Rick Homan, Catherine Searle

HIV and AIDS

The HIV/AIDS epidemic has meant that an increasing number of chronically ill people need ongoing assistance with care and support. Programs providing home-based care (HBC) services are a key component of the response to HIV/AIDS. However, few programs are using operations research, including cost studies, to decide what services to provide and how to structure their services. In 2004, the Horizons Program undertook a study of six HBC programs from different South African provinces to provide key information to NGOs, government ministries, donors, and the programs themselves to inform decisions about service delivery. The study analyzed the cost of HBC …

Life, Liberty, And The Pursuit Of Water: Evaluating Water As A Human Right And The Duties And Obligations It Creates, Amy Hardberger Jan 2005

Life, Liberty, And The Pursuit Of Water: Evaluating Water As A Human Right And The Duties And Obligations It Creates, Amy Hardberger

Faculty Articles

The Right to Water should be an independent, explicit human right. As such, the status of the right to water would be raised to the status of customary international law (jus cogens), imposing an affirmative, obligatory duty an all nations. Historically the right to water has been included in the right to life, limiting the right; however, that approach undermines the essential importance of water and causes enforcement problems that would be avoided by regarding water as an independent right.

Landmark international agreements, treatises, and the work of various international entities and other non-governmental organizations have made tremendous strides in …

Liberty Versus Property? Cracks In The Foundations Of Copyright Law, Richard A. Epstein Jan 2005

Liberty Versus Property? Cracks In The Foundations Of Copyright Law, Richard A. Epstein

Faculty Articles

Many modern intellectual property scholars have argued that the creation of patents and copyrights, for inventions and writings, respectively, should be resisted on the grounds that these forms of property necessarily infringe ordinary forms of liberty, in contrast to property that is found in tangible things. This article rejects that claim by showing how property conflicts with liberty in both settings, but that the different configurations of rights observed in these various areas is defensible on the grounds that the loss of liberty for all persons is, to the extent that human institutions can make it, compensated by the increased …

Which Judges Write Their Opinions (And Should We Care)?, Stephen J. Choi, G. Mitu Gulati Jan 2005

Which Judges Write Their Opinions (And Should We Care)?, Stephen J. Choi, G. Mitu Gulati

Faculty Articles

Common wisdom holds that many federal judges do not write their own opinions. While their degree of input into opinion writing varies, almost all rely to some extent on law clerks, typically recent law school graduates, to research and draft substantial sections of the opinion. Why should we care which judges write their opinions? We posit that determining the actual input of federal judges into the authorship of opinions provides useful information in a number of contexts, including judicial promotion decisions, the allocation of scarce judicial resources, and the judicial clerkship market for law students. We start with generic tests …

Thinking Like A Lawyer, Peggy C. Davis, Aderson Belgard Francois Jan 2005

Thinking Like A Lawyer, Peggy C. Davis, Aderson Belgard Francois

Faculty Articles

In this article the authors explain what it means to train lawyers for intellectual versatility. The authors then describe, and attempt to explain, the resistance this kind of training can engender. Next, they draw on post-realist legal thought to explain why training for intellectual versatility is necessary to capable and responsible legal practice. The authors conclude with suggestions about how continued engagement with the work of Carol Gilligan can deepen their analysis of why training for intellectual versatility is resisted, and why it is nonetheless profoundly important.

Do States Socialize?, José E. Alvarez Jan 2005

Do States Socialize?, José E. Alvarez

Faculty Articles

The article presents the author's comments on the views expressed by professors Ryan Goodman and Derek Jinks in their article "How to Influence States: Socialization and International Human Rights Law." He believes that the article offers insights on a field still dominated by an emphasis on black letter doctrine. He suggests that the professors, who relied on socialization as a theory of compliance, need case studies to provide context and further nuance.

Contractual Principle Versus Legislative Fixes: Coming To Closure On The Unending Travails Of Medical Malpractice, Richard A. Epstein Jan 2005

Contractual Principle Versus Legislative Fixes: Coming To Closure On The Unending Travails Of Medical Malpractice, Richard A. Epstein

Faculty Articles

I start from the simple premise that on balance the gains from the provision of medical services are strongly positive, so that it should be possible to fashion a legal regime from which both patients and physicians gain. But the magnitude of the current impasse, as well as the contraction and withdrawal of vital services in the face of those positive benefits, is a sign of deep disorder within the health care system, a point which neither side in the debate has grasped. Before I analyze the four articles that address important aspects of this recurrent problem, it is useful …

Justified Monopolies: Regulating Pharmaceuticals And Telecommunications, Richard A. Epstein Jan 2005

Justified Monopolies: Regulating Pharmaceuticals And Telecommunications, Richard A. Epstein

Faculty Articles

Ordinary discourse, then, recognizes that a limited number of exceptions are consistent with the articulation of our basic rules on force and fraud. I shall argue that this same approach fruitfully carries over to our thinking about monopoly, even state-sponsored monopoly. Here, I hope to explain the basic logic of the term "justified monopoly" and then show the stunning ways in which it plays out when dealing with the pharmaceutical and telecommunications industries.

3m'S Bundled Rebates: An Economic Perspective, Daniel L. Rubinfeld Jan 2005

3m'S Bundled Rebates: An Economic Perspective, Daniel L. Rubinfeld

Faculty Articles

This article reports that bundling and tying arrangements are widespread in the U.S. economy. These practices have come under scrutiny by the courts, which have on occasion concluded that particular arrangements are anticompetitive. One particular form of bundling, the bundling of rebates, has received a great deal of attention recently in light of the jury's decision and the ensuing en banc opinion by the Third Circuit in LePage's Inc. v Minnesota Mining and Manufacturing Co. (3M). This article analyzes the bundled rebate programs that were among the monopolizing practices asserted by LePage's. It focuses on the jury's finding of liability …

Rape In The Twilight Zone: When Sex Is Unwanted But Not Illegal, Stephen J. Schulhofer Jan 2005

Rape In The Twilight Zone: When Sex Is Unwanted But Not Illegal, Stephen J. Schulhofer

Faculty Articles

Throughout the law, it is a familiar problem that there can be a large gap between the law in the books and the law in action. In the area of rape law, that gap is really more of a chasm. That is probably our most important problem. But here I want to focus on a different part of the problem; one that is a bit more esoteric but also may ultimately be more fundamental. That is, many very serious abuses still are not covered by the law at all. Many unambiguous abuses are not covered, even in theory. This topic …
