Career Paths And The Superintendency: Women Speak Out, Nancy Hergenrother Seyfried, Thomas Diamantes Jan 2005

Career Paths And The Superintendency: Women Speak Out, Nancy Hergenrother Seyfried, Thomas Diamantes

Journal of Women in Educational Leadership

According to the 2000 census, women comprise nearly 51 % of the American population. Women constitute two thirds of the work force in education. Seventy-five percent of teachers are women; 41 % of principals are women, and women fill 60% of central office administration positions, yet, at the superintendent level, only 10% are women (Vail, 1999). Guthrie (1999) found that the shortage of women in top education positions mirrors other fields. Women make up 50% of the work force, yet they represent fewer than 11 % of the corporate officers of companies and 3% of the heads of companies. Women …

Review Of Closing The Leadership Gap: Why Women Can And Must Help Run The World By Marie C. Wilson., Linda L. Lyman Jan 2005

Review Of Closing The Leadership Gap: Why Women Can And Must Help Run The World By Marie C. Wilson., Linda L. Lyman

Journal of Women in Educational Leadership

Reading this book helps one place the struggle for gender equity In leadership of schools into its rightful larger context: equal numbers of women in school, district, and university leadership will contribute to transforming not only these organizations, but also American culture, and ultimately the world. Starkly stated, Wilson's premise is ''that our future depends on the leadership of women-not to replace men, but to transform our options alongside them" (p. x). Growing poverty, a broken health care system, looming environmental problems, and other human and organizational crises throughout the fabric of our society reinforce the need for new options.

Advice From The Field In Educational Leadership For Female Principals, Carole Funk, Barbara Polnick

Journal of Women in Educational Leadership

The number of female school principals in the United States continues to grow each year, and many of these women are evolving into outstanding educational leaders. Cultural and gender barriers, however, continue to limit their leadership effectiveness despite their overall achievements. Many of these women have not maximized their leadership effectiveness despite their overall achievements. Many of these women have not maximized their leadership effectiveness because they work in cultures that are not conducive to their transformational leadership styles. In addressing these issues, the authors of this article have provided a research synthesis regarding the female principal-ship in order to …

Domestic Violence And Mediation: Responding To The Challenges Of Crafting Effective Screens, Jane C. Murphy, Robert Rubinson Jan 2005

Domestic Violence And Mediation: Responding To The Challenges Of Crafting Effective Screens, Jane C. Murphy, Robert Rubinson

All Faculty Scholarship

Over the last two decades, mediation of family law cases has become well-established in American courts. As mediation has grown, experts have recognized that power imbalances between couples may interfere with mediation. This imbalance is particularly evident where one partner has been abusive to the other. Widespread consensus has developed that decisions about whether mediation is appropriate are particularly crucial and delicate when domestic violence is present. Despite this consensus, there is evidence that courts are still ordering couples who have experienced domestic violence to mediate their family law disputes with little or not particularized examination of the couples' circumstances. …

Legal Images Of Fatherhood: Welfare Reform, Child Support Enforcement, And Fatherless Children, Jane C. Murphy Jan 2005

Legal Images Of Fatherhood: Welfare Reform, Child Support Enforcement, And Fatherless Children, Jane C. Murphy

All Faculty Scholarship

This Article analyzes the issue of paternity disestablishment, an issue courts and legislatures have been struggling with over the last several years. For a variety of reasons explored in this Article, an increasing number of fathers have filed requests to set aside paternity orders seeking to be relieved of the legal obligations of fatherhood. As a result families have been destabilized and children are becoming fatherless. The implications for the future of the family are profound. Although some scholars have examined this phenomenon, none have addressed the link between paternity disestablishment and welfare reform.

This Article explores the law's evolving …

The Ministry of the Attorney General of Ontario has contracted with the University of Baltimore School of Law's Center for Families, Children and the Courts to prepare this research paper. Choosing Among Antitrust Liability Standards Under Incomplete Information: Assessments Of And Aversions To The Risk Of Being Wrong, Barbara Ann White Jan 2005

Choosing Among Antitrust Liability Standards Under Incomplete Information: Assessments Of And Aversions To The Risk Of Being Wrong, Barbara Ann White

All Faculty Scholarship

This essay analyzes the three papers presented on a panel I organized as chair of the AALS Antitrust Section entitled Evolving Antitrust Treatment of Dominant Firms for the 2005 Annual Meetings. Steve Salop’s and Doug Melamed’s papers recommend standards for government intervention while David McGowan argues why the government should not.

I create a framework within which to understand the three papers’ relationship to each other, by building on McGowan’s characterization of courts’ antitrust decisions. Since antitrust decisions are based on inherently incomplete real world information, they are subject to “error costs”: Courts are at risk of “false positives” (finding …

Beyond The Pavement: How To Take On Cross-Country Mountain Biking, Gregory M. Moore

Senior Honors Theses and Projects

Mountain biking began for me as an escape from the commotion of urban society. I was looking for a way to get out of life’s normal grind and take advantage of my love for being active and outside. Mountain biking was the perfect sport to meet my desires. I have become an advocate for mountain biking early on. I am now taking this opportunity to teach people about the sport I have come to love.

The objectives of this book are two fold. Part I serves as a comprehensive guide to cross-country mountain biking that will provide new comers with …

Caregiver Interventions For Behavioral Symptoms In Alzheimer's And Dementia Patients, Heather M. Lindner Jan 2005

Caregiver Interventions For Behavioral Symptoms In Alzheimer's And Dementia Patients, Heather M. Lindner

Senior Honors Theses and Projects

As people are living longer, the incidence of Alzheimer’s disease and other forms of dementia is rising dramatically. While preventative and treatment methods are being developed for these complicated disorders, attention also has been directed towards caregivers, because they play a vital role in the way the patients’ symptoms are handled and how well the patients adjust overall. Caregivers are almost always family members who lack formal training in caring for dementia patients. The purpose of this research was to see whether caregivers who follow interventions suggested in the literature experience fewer or less intense behavioral problems on the part …

The Story Of ‘Hoffman Plastic Compounds V. Nlrb’: Labor Rights Without Remedies For Undocumented Immigrants, Catherine Fisk, Michael J. Wishnie Jan 2005

The Story Of ‘Hoffman Plastic Compounds V. Nlrb’: Labor Rights Without Remedies For Undocumented Immigrants, Catherine Fisk, Michael J. Wishnie

Faculty Scholarship

In Hoffman Plastic Compounds v. NLRB, 535 U.S. 137 (2002), the United States Supreme Court held that undocumented workers are not entitled to remedies for violations of their rights to unionize under the National Labor Relations Act. The majority of the Court viewed enforcement of immigration policy prohibiting employment of undocumented workers as more important than protecting the labor rights of both undocumented workers and their U.S. citizen co-workers who join their efforts to improve working conditions. The chapter explores the origins of the case in a minimum-wage factory in Los Angeles, the surprising turn of events when the illegally …

Organizational Misconduct: Beyond The Principal-Agent Model, Kimberly D. Krawiec Jan 2005

Organizational Misconduct: Beyond The Principal-Agent Model, Kimberly D. Krawiec

Faculty Scholarship

This article demonstrates that, at least since the adoption of the Organizational Sentencing Guidelines in 1991, the United States legal regime has been moving away from a system of strict vicarious liability toward a system of duty-based organizational liability. Under this system, organizational liability for agent misconduct is dependant on whether or not the organization has exercised due care to avoid the harm in question, rather than under traditional agency principles of respondeat superior. Courts and agencies typically evaluate the level of care exercised by the organization by inquiring whether the organization had in place internal compliance structures ostensibly designed …
