Destabilizing The Normalization Of Rural Black Land Loss: A Critical Role For Legal Empiricism, Thomas W. Mitchell Mar 2005

Destabilizing The Normalization Of Rural Black Land Loss: A Critical Role For Legal Empiricism, Thomas W. Mitchell

Faculty Scholarship

Mitchell's study exemplifies the New Legal Realist goal of combining qualitative and quantitative empirical research to shed light on important legal and policy issues. He also demonstrates the utility of a ground-level contextual analysis that examines legal problems from the bottom up. The study tracks processes by which black rural landowners have gradually been dispossessed of more than 90% of the land held by their predecessors in 1910. Mitchell points out that despite the continuing practices that contribute to this problem, there has been very little research on the issue, and what little attention legal scholars have paid to it …

Court Reviews: The Takings Doctrine And Exactions, John R. Nolon, Jessica A. Bacher Feb 2005

Court Reviews: The Takings Doctrine And Exactions, John R. Nolon, Jessica A. Bacher

Elisabeth Haub School of Law Faculty Publications

Exactions occur when applications to develop parcels of land require governmental permission, and that permission is conditioned upon dedicating part of the land to public use. Exactions have long been challenged as regulatory takings, and both federal and state courts look at these types of regulations with a heightened level of scrutiny due to the nature of exactions to remove a crucial element from the bundle of property rights associated with ownership of real property: the right to exclude. This column discusses a recent example of exactions jurisprudence applied in New York and goes on to compare that decision in …

Impact Of The Synthesis Process On Structure Properties For Afci Fuel Candidates, Thomas Hartmann, Kenneth Czerwinski Feb 2005

Impact Of The Synthesis Process On Structure Properties For Afci Fuel Candidates, Thomas Hartmann, Kenneth Czerwinski

Fuels Campaign (TRP)

Transmutation work at Los Alamos National Laboratory is currently focused on mono-nitride ceramic fuel forms, and consists of closely coordinated “hot” actinide and “cold” inert and surrogate fuels work. Matrix and surrogate materials work involves three major components: (1) fuel matrix synthesis and fabrication, (2) fuel performance, and (3) fuel materials modeling. The synthesis and fabrication component supports basic material studies, as well as actinide fuel fabrication work through fuel fabrication process development. Fuel performance studies are examining the tolerance of nitride-type fuel to heavy irradiation damage. The fuel materials simulation work involves both atomistic and continuum scale modeling employing …

Exact Bounds For Interval And Fuzzy Functions Under Monotonicity Constraints, With Potential Applications To Biostratigraphy, Emil Platon, Kavitha Tupelly, Vladik Kreinovich, Scott A. Starks, Karen Villaverde

Departmental Technical Reports (CS)

The age of fossil species in samples recovered from a well that penetrates an undisturbed sequence of sedimentary rocks increases with depth. The results of biostratigraphic analysis of such a sequence consist of several age-depth values -- both known with interval (or fuzzy) uncertainty -- and we would like to find, for each possible depth, the interval of the possible values of the corresponding age. A similar problem of bounding an intervally (fuzzily) defined function under monotonicity constraint occurs in many other application areas. In this paper, we provide an efficient algorithm for solving this problem.

To Properly Reflect Physicists' Reasoning About Randomness, We Also Need A Maxitive (Possibility) Measure, Andrei M. Finkelstein, Olga Kosheleva, Vladik Kreinovich, Scott A. Starks, Hung T. Nguyen

Departmental Technical Reports (CS)

According to the traditional probability theory, events with a positive but very small probability can occur (although very rarely). For example, from the purely mathematical viewpoint, it is possible that the thermal motion of all the molecules in a coffee cup goes in the same direction, so this cup will start lifting up.

In contrast, physicists believe that events with extremely small probability cannot occur. In this paper, we show that to get a consistent formalization of this belief, we need, in addition to the original probability measure, to also consider a maxitive (possibility) measure.

Morphology Of Methane Hydrate Host Sediments, Keith W. Jones, Huan Feng, Stanmire Tomov, William J. Winters, Michael Eaton, Devinder Mahajan

Department of Earth and Environmental Studies Faculty Scholarship and Creative Works

The morphological features including porosity and grains of methane hydrate host sediments were investigated using synchrotron computed microtomography (CMT) technique. The sediment sample was obtained during Ocean Drilling Program Leg 164 on the Blake Ridge at water depth of 2278.5 m. The CMT experiment was performed at the Brookhaven National Synchrotron Light Source facility. The analysis gave ample porosity, specific surface area, mean particle size, and tortuosity. The method was found to be highly effective for the study of methane hydrate host sediments.
