Within the past two decades, globalization has created a tremendous impact on the lives of women in developing nations. Globalization can be defined as “a complex economic, political, cultural, and geographic process in which the mobility of capital, organizations, ideas, discourses, and peoples has taken a global or transnational form (Moghadam 1999). With the establishment of international free trade policies, such as North America Free Trade Agreement (NAFTA) and GATT, transnational corporations are using the profit motive to guide their factories toward developing nations in search of “cheap” female labor. The Oak Ridge National Security Complex: Human Health And The Environment As Casualties Of Hot And Cold Wars, Global Green Usa, Jasmine Aimaq Dr.

This report reviews lingering and emerging dangers at the largest NWC site, the Oak Ridge National Security Complex in Tennessee. The Oak Ridge site is both a high- value target for terrorist attack, a source of environmental contamination, and a potential public health threat. This report examines the nexus between environment, health and security at Oak Ridge, and discusses known and potential dangers in each of these areas.

This research was completed money allocated during Round 5 of the Citizens’ Monitoring and Technical Assessment Fund (MTA Fund). Clark University was named conservator of these works.

Can Administrative Regulations Interpret Rights Enforceable Under Section 1983?: Why Chevron Deference Survives Sandoval And Gonzaga, Bradford Mank

There is a split in the circuits regarding whether and when agency regulations may establish rights enforceable through 42 U.S.C. Section 1983. In 1987, in Wright v. City of Roanoke, the Supreme Court held that a statute and regulations interpreting the statute could create enforceable rights under Section 1983, but left unclear to what extent it had relied on the regulations alone to reach this conclusion. The District of Columbia Circuit and Sixth Circuit have held that at least some valid federal regulations may create rights enforceable through Section 1983. Deep Discount Group Pass Programs: Innovative Transit Finance, Cornelius Nuworsoo

City and Regional Planning

For public transit operators in the U.S., neither fare increases nor fare reductions have been successful in boosting revenues. A different kind of strategy is needed, one that can produce more revenue for transit operators than it costs. This article argues that deep discount group pass (DDGP) programs can accomplish this goal. DDGP programs provide groups of people with unlimited-ride transit passes in exchange for a contractual payment by a group’s employer or other organizing body. While previous research on DDGP programs has ignored their impact on operator revenues, this article addresses that gap by focusing on their revenue-increasing potential. …

On The Role Of Cost-Benefit Analysis In Environmental Law: A Book Review Of Frank Ackerman And Lisa Heinzerling's Priceless: On Knowing The Price Of Everything And The Value Of Nothing, Shi-Ling Hsu

Legal scholarship on the role of cost-benefit analysis in environmental law is often stimulating, but does not seem to be changing anybody's mind. The entrenchment of a camp of detractors and a camp of advocates of cost-benefit analysis parallels the impasse that has stymied environmental law for over a decade. Professors Frank Ackerman and Lisa Heinzerling have coauthored a book that captures most of the arguments from the detractor side, and they have done so skillfully and powerfully. However, this Review criticizes the book's contribution to perpetuating this intellectual stalemate. The book does this by focusing on an environmental theory …

Public Participation In Transportation: An Emperical Test For Authentic Participation, Jorge Cesar Figueredo

This dissertation examines the public participation activities of State Departments of Transportation (SDOTs) in the United States. A review of existing literature and legal frameworks suggests that an "authentic" public participation results when dimensions of representativeness, use of public inputs, interactiveness, and quality of citizen inputs have been achieved. The study sought to identify conditions that serve as measurements that must presumably be satisfied for authenticity to exist in public participation. Participation: A Model Of Individual Willingness To Participate In The Transportation Planning Process, Michael Neidhart

This study sought to identify the key determinants that lead individuals to participate in the transportation planning process. Two models of participation, one for the short-term and another for the long-term, were developed to test whether the key internal and external determinants are responsible for influencing a person's willingness to participate. The data for this study came from a mail-back survey that was administered to a random sample of 570 individuals throughout the State of Florida for a response rate of 37.37 percent. The results indicate that the internal motivational determinants exert more influence on a person's short-term willingness to …

This comment to Dryland Democracy (Prof. Janet Neuman, in Dusting Off the Blueprint for a Dryland Democracy: Incorporating Watershed Integrity and Water Availability Into Land Use Decisions (Dryland Democracy)) will expand upon the theme of social costs, exploring how Professor Neuman's basic proposal-water basin institutions with centralized authority-might address some of these inequities. The law of nuisance has long been seen as the heart of real property law - this because of its distributive and re-distributive force in land use. In its present form, while often ad hoc in application, a nuisance is defined generally as merely some interference with the use and enjoyment of the land. The most common remedy to abate a nuisance is injunctive relief in equity. Yet, judicial creativity has been seen through the use of such remedies as awards of permanent damages and the compensated injunction.
