This is an edited, annotated transcript of a conference panel discussion on feminism, sex, and gender in law, legal education, and legal scholarship. The transcript reflects widely divergent views of the place of feminism, sex, and gender in the law and legal scholarship. Moreover, the panelists differ as to the role feminism has played in the lives of women as law students and practicing attorneys. Weaver’S Cove Energy Versus The City Of Fall River, Massachusetts: An Experience In The Concepts Of Stakeholders, Economic Impact, And Social Obligation/Social Responsibility, Susan M. Bosco, W. Brett Mckenzie, Kathleen S. Micken

This experiential exercise, designed for our introductory business course, uses a classroom debate to teach the concepts of stakeholders, social obligation/social responsibility, and ethical frameworks for decision-making. The basis for the debate is the request by Weaver’s Cove Energy to construct and operate a liquefied natural gas (LNG) facility in Fall River, Massachusetts. Weaver’s Cove has proposed the facility for an abandoned industrial site on the waterfront. The exercise addresses the three learning goals listed above through readings, position construction, and the debate itself. The rationale for the assignment and the chosen pedagogy are presented. This report provides an overview of the fundamentals and field applications of in situ bioremediation in contaminated soil and groundwater. Bioremediation has been presented to the impacted communities as a technology that is currently being used and tested at the Savannah River Site (SRS). The primary focus this report explain bioremediation as a clean-up technology and analyze what role the technology will play in the new accelerated clean up strategy at SRS as approved by Environmental Management at the U.S. Department of Energy (DOE). The objective is to understand how bioremediation is being used at SRS for clean up.

This report analyzes key policy decisions, as well as actions and inaction under health, safety, and environmental laws, that could have better protected New Orleans from the effects of Katrina before the hurricane and those that could have improved the emergency response in its wake. In the area of public health, safety, and the environment, the paper explores the implementation of wetlands law and policy, bad decisions regarding the construction and maintenance of the levee system designed to protect New Orleans, pollution prevention and clean-up laws, and energy policy. ABSTRACT: This article aims to forward the dialogue about transnational corporate regulation by mapping the power dynamics that infuse litigation over energy production’s externalities and their implications for sovereign regulatory authority. The piece’s core argument is that appropriately constraining the externalities of energy production demands a nuanced, spatial understanding of the relationship among governmental regulatory entities, corporations, and the other actors that influence them. In this paper I argue that the goal of “democratizing technology” (as espoused by Feenberg, Winner, Sclove and others) must be linked to some kind of overarching norm or objective. That by itself, the apparently worthwhile aim of democratizing technological design is nebulous. [Is it the case that democratizing technology will necessarily lead to an overall improvement in the built environment? Obviously, this question raises a host of additional questions: How does one define “improvement”? Or, better for whom? Despite Alarmists, 'Kelo' Decision Protects Property Owners And Serves The General Good, John R. Nolon, Jessica A. Bacher

The United States Supreme Court’s decision in Kelo v. City of New London, has spurred national debate, as many people portray the court’s decision as a damaging blow to private property rights. In Kelo, the court confirmed local government’s ability to condemn property in an area designated as blighted by the state, in order to encourage economic development. This article highlights several positive examples of this sort of condemnation in New York case law, where the public interest was served by economic redevelopment. In this paper, I posit that the Miranda ruling from the infamous case Miranda v. Arizona, when poorly applied, results in profound and blatant Eracism. The Miranda Rule was created to protect the citizens of America; it was to protect suspects from coercion during custodial interrogations. Wagadu: A Journal of Transnational Women's & Gender Studies

The United Nations Millenium Development Goals (MDG) focus on key social, economic and political issues; gender and environment are just some of the areas noted. What are the lessons learnt from Kenya’s Green Belt Movement (GBM), spearheaded by Wangari Maathai? MDG analysts might benefit from understanding an NGO’s strategies, like GBM. It will be argued that GBM’s consensus movement mobilized urban and rural women around tree planting income-generating activities, consciousness raising, women’s rights, and political empowerment. GBM’s harambee spirit has the potential of replication across the continent.

No Good Deed Goes Unpunished: The Cercla Liability Exposure Unfortunately Created By Pre-Acquisition Soil Testing, Jennifer L. Scheller

Michigan Law Review

This Note argues that CERCLA, as it is currently written, requires courts to hold parties liable for pre-purchase soil investigations that spread or mix contamination because to conclude otherwise would stretch CERCLA beyond its breaking point. Part I argues that both those who order pre-acquisition soil testing and those who conduct the tests are PRPs if the testing spreads existing contamination. Part II argues that the statute does not allow for the judicial creation of a soil testing liability exception. Part III acknowledges the policy problems created by testing liability and advocates a legislative solution to exempt pre-purchase soil testing …
