It is difficult to imagine that others do not perceive and react to the cultural stimuli as I do when dealing with everyday sensory situations. Unlike most, I have struggled with many different responses to commonplace sensory events during my life. A recent diagnosis of certain symptoms has helped to explain not only my lifelong reactions to sensory stimuli, but also the resulting environments I have created for myself in which I live and work. The four terms I use that most fully describe the affects of this condition are; too fast, too tight, too loud and too bright. Although …

Problems Of Modernization In Late Imperial Russia: Maksim M. Kovalevskii On Social And Economic Reform, Evgeny Badredinov

The problems of social and economic reform were at the center of academic and political activities of Maksim M. Kovalevskii (1851-1916), a prominent Russian historian and sociologist. The comparative study of rural communal institutions led him to conclude that the village commune remained a viable social and economic institution in late imperial Russia. Although he believed firmly in private agriculture, he criticized the Stolypin land reform for attempting to pressure peasants to separate from communes. Kovalevskii argued that in a country dominated by communal traditions the state must not destroy the collective economy by legislative fiat. He urged Russian policy-makers …

At the turn of the twentieth century, the U.S. system of public finance underwent a dramatic, structural transformation. The late nineteenth-century system of indirect taxes, associated mainly with the tariff, was eclipsed in the early decades of the twentieth century by a progressive income tax. This shift in U.S. tax policy marked the emergence of a new fiscal polity - one that was guided not simply by the functional and structural need for government revenue but by concerns for equity and economic and social justice. Exile is a phenomenon probably as ancient as humanity itself, and one of the oldest topics in universal literature. The great majority of its variants (political, economical, social,) are founded on the idea of "forced displacement." Consequently, most often exile is reflected in literary creations in discourses dominated by a sentiment of loss. However, in some cases exile is not seen as a tragic event, but rather as an opportunity for intellectual growth - as attested by a number of authors who have chosen voluntarily to exile themselves. German Legal Culture And The Globalization Of Competition Law: A Historical Perspective On The Expansion Of Private Antitrust Enforcement, Hannah Buxbaum

One trend developing in international competition regulation is the expansion of private antitrust litigation as an enforcement mechanism. This article examines Germany's response to that trend, investigating the extent to which it has roots in the country's legal and economic history. It begins by tracing the development of German competition law post-World War II - focusing in particular on the patterns of pressure and resistance within the transatlantic relationship - and identifies the emergence of an indigenous regulatory enforcement philosophy. A Crisis Of Opportunity: The Example Of New Orleans And Public Education In Antebellum Louisiana, Sarah Elisabeth Lipscomb

The purpose of this study is to explore the development of public education in antebellum Louisiana. Using primarily public records, I found that despite the successful system instituted in New Orleans in the early 1840s, the rest of Louisiana faltered in its attempts to establish free public schools. Notwithstanding the requirement contained in the 1845 Constitution that each parish must organize public schools, the lack of guidance, supervision, and funding from the state legislature all coalesced to condemn public education in most of the rest of the state. Complaints of ADHD symptoms in college students are not uncommon and college students frequently self-refer for assessment of ADHD. Some may seek out a diagnosis to obtain academic accommodations and/or stimulant medication. Diagnosing ADHD in college students is largely reliant on self-report measures, and to a lesser extent, objective measures of attention. The typical college student has easy access to information about ADHD, potentially facilitating efforts to simulate self-reported symptoms. The present study examined the ability of college students to effectively simulate ADHD on objective and self-report measures of attention, and examined the relationship between knowledge of ADHD and ability …

This ethnographic study explores the risk perceptions of a small unincorporated coastal community in southeastern Louisiana. This community has experienced social and environmental change due to events including tropical storms and hurricanes, erosion, subsidence, oil and gas activities, development, and the impact of global seafood markets. Many global risk perception studies have focused on the perception of risk to human health and property connected with natural and technological disasters, but few have explored the issue of minorities and small at-risk communities. This Article addresses the ongoing-and, indeed, accelerating process of sporadic, piecemeal, and unnecessary legislation leading to increasing inconsistencies and irrationalities in American criminal law. After a wave of modernization in the I960s and 1970s, the past generation has not witnessed further advances, but rather a serious and growing degradation of most criminal codes.
This Article offers several insights regarding criminal code degradation. First, it provides specific and concrete examples of degradation and its harmful effects. Second, drawing on their experiences as participants in the recent reform efforts of Illinois and Kentucky, the authors offer an insider's view of how the …

From Laird v. Tatum to Bush v. Gore, the refusal of some Supreme Court Justices to recuse themselves in controversial cases has caused reactions ranging from confusion to disgust. The latest "duck hunting" recusal controversy, and the Court's seemingly callous response to the public outcry, seemed to suggest a deliberate indifference to the recusal standard. This Article examines the recusal provisions applicable to the Supreme Court. There is little doubt that Congress drafted the federal recusal statute broadly and intended to encompass Supreme Court Justices within the statute's reach. This paper looks into the inner workings of Michael Almereyda's Hamlet (2000). Even though Almereyda updates the setting and cuts many of the lines, sometimes entire scenes, from the source text, he is able to convey the some of the themes through his use of technology and media. While some themes do transfer into the postmodern setting, the places of discord are most interesting. Of particular interest is his use of modern technologies to display the corruption found in Shakespeare's play. This thesis explores how arguments about gender and labor roles have determined women's exclusion from or acceptance to the academy throughout the history of the United States. Race, gender, and class are identified as interlocking identities that shape experiences and women's gendered relationship to labor is demonstrated through the use of a materialist feminist framework. By tracing the distinct eras of colonial and United States history, the thesis illustrates the debates and public mindset of each time period and how they relate to women and higher education. This thesis explores what can happen when planners and designers allow local narratives to inspire and inform all stages of community planning and design processes. Specifically, this paper suggests how local narratives can contribute to the ongoing revitalization efforts underway in Old South Baton Rouge, a historically significant, low-income, African-American community in Baton Rouge, Louisiana. This dissertation examines the political significance of the two leading strains of common sense thought in the history of American philosophy—Scottish Common Sense and Pragmatism—as suggested in the writings of John Witherspoon and James McCosh in the Scottish Common Sense line, and of the more famous co-founder of Pragmatism, William James. These two strains of American common sense are placed in context of the larger Western common sense tradition. Each is shown to aim at finding a solid middle ground epistemologically between skeptical doubt and idealistic certitude that could serve as a stable basis for moral and political life. The study of southern rhetoric and public address remains important to the study of American rhetoric and public address. However, recent years indicate a decline in the amount and variety of scholarship in this area of study. This project provides a meta-critical analysis of the history of southern rhetorical scholarship, focusing mainly on southern public address. In this article, I argue that those who believe that Americans can successfully export their visions of law and legal research to other countries need to consider - in addition to Japan and Germany, two countries that are often touted as exemplars - the case of India. India gained its independence from the British in 1947, and soon thereafter many American experts traveled to India in an effort to foster a culture of Western legal intellectualism. The purpose of this study was to explore and determine the degree of client satisfaction with utilization of primary healthcare services delivered by a nurse practitioner in the Employee Health Services department of a not for profit hospital in the Southern United States. The Nurse Practitioner Satisfaction Survey (NPSS), a 28-item Likert-type survey instrument was specifically developed for this study and administered to a sample of 300 clients. Overall high levels of patient satisfaction with nurse practitioner delivered health care services were demonstrated. The tsunami in the Indian Ocean at the end of 2004 has produced heightened scrutiny of how international disaster relief is supplied and governed. This scrutiny connects to arguments by the International Federation of Red Cross and Red Crescent Societies that more effective and efficient disaster relief requires the significant development of international law on disaster relief. This commentary analyses the historical and current relationship between international law and disaster relief and challenges the arguments that more international law on disaster relief is needed.

As change is an inevitable part of organizational life, this study explores one aspect of communication in organizational change: the creation and use of meaning during the change process. The implementation of a new, higher education admissions criteria framework of a state master plan is the specific change under study. University administrators, contracted consultants, and board staff members participated in the study. Researchers have developed and demonstrated the effectiveness of a number of interventions to manage disruptive behavior in the dental setting. However, these treatments vary in terms of their effectiveness, invasiveness, effort to implement, and acceptability to families. This study evaluated the effects of noncontingent escape for reducing disruptive behavior in a pediatric dental setting. Within a multiple baseline design across subjects, five children were provided response-independent breaks via an automated cuing device. Results demonstrated reductions in escape-related behaviors (e.g., crying, body movements) for all children. Additionally, the intervention was implemented with high integrity and was favorably rated by the dental …

A theory-based perspective is essential to a full understanding of infinitive clauses in early Latin. Some previous work focusing on syntactic theory has failed to include appropriate Latin data or has not explained it adequately. More recent theoretical perspectives have taken the approach of Functional Grammar, dismissing much of the variation in word order and embedded clause types as driven merely by pragmatics. The practice of Catholicism extended across racial boundaries in colonial Louisiana, and interracial worship continued to characterize the religious experience of Catholics throughout the antebellum period. French and Spanish missionaries baptized natives, settlers, and slaves, and the Catholic Church required Catholic planters to baptize and catechize their slaves. Most slaveholders outside New Orleans, however, were lax in the religious education of slaves. Work holidays did not always correspond to religious holy days, and the number of slave baptisms and confirmations on Catholic plantations often depended on the willingness of the local priest, or the slaves themselves, to attend the parish …

The drawbacks of active magnetic bearings are arousing interest in the adaptation of mechanical bearings for active use. A promising mechanical bearing candidate for active operation is the tilting-pad bearing. In this research, we introduce an active tilting-pad bearing with linear actuators that translate each pad. The use of feedback in determining the actuator forces allows for the automatic, continuous adjustment of the pad position during the machine operation. Parallel molecular dynamics (MD) simulations are performed to investigate pressure-induced solid-to-solid structural phase transformations in cadmium selenide (CdSe) nanorods. The effects of the size and shape of nanorods on different aspects of structural phase transformations are studied. Simulations are based on interatomic potentials validated extensively by experiments. Simulations range from 105 to 106 atoms. These simulations are enabled by highly scalable algorithms executed on massively parallel Beowulf computing architectures. Pressure-induced structural transformations are studied using a hydrostatic pressure medium simulated by atoms interacting via Lennard-Jones potential. Radical transformations came about in Vienna during the 1780s, as intellectuals in the city embraced the Enlightenment and explored ways in which the movement could be spread. In 1781, Joseph II and his state reformed censorship. In an instant, the Viennese had access to the great scholarly works of seventeenth- and eighteenth-century Europe. In an instant, Vienna spawned a multitude of writers, publishing houses, reading rooms and all the accoutrements of a culture of print. The primary purpose of this study was to determine the influence of level of participation in services provided by the Student Support Services (SSS) Program on the grade point average, retention, and the six-year graduation rate of first-time entering freshmen who also entered the SSS program at a research extensive university in the South. Participants in the study were one hundred, fifty-two (152) SSS students who entered this university in the fall of 1996 and fall of 1997.
