Arresting Vaulting Pole Technology, Russ Versteeg Jan 2005

Arresting Vaulting Pole Technology, Russ Versteeg

Vanderbilt Journal of Entertainment & Technology Law

Generally speaking, sports rules perform at least six functions, many of which overlap. Sports rules: 1) define the game; 2) promote safety; 3) prohibit unfair advantage; 4) promote administrative efficiency; 5) foster good sportsmanship; and, 6) promote fairness. Presumably, as sports evolve, rule makers must seriously consider at least two important questions when deciding how to respond to any given technological innovation that affects a sport. They must consider its potential impact on the integrity of the sport (i.e., how it affects both the definition of the game as well as whether it creates an unfair advantage and/or otherwise hinders …

Race And The California Recall: A Top Ten List Of Ironies, Steven W. Bender, Keith Aoki, Sylvia Lazos Jan 2005

Race And The California Recall: A Top Ten List Of Ironies, Steven W. Bender, Keith Aoki, Sylvia Lazos

Faculty Articles

Arnold Schwarzenegger's election as governor of California in the 2003 recall campaign is rife with cruel ironies. An immigrant himself, he beat the grandson of Mexican immigrants, Lieutenant Governor Cruz Bustamante, by playing the race card, and managed to dodge allegations of his praise for Hitler as a strong leader. While the pundits say that the California recall was about angry voters lashing back at faithless, self-dealing politicians, more lurks beneath the surface. In California, racial and ethnic minorities now comprise a majority of the population, and the recall election brought barely concealed and seething schisms to the surface. Californians, …

Leveling The Playing Field: A New Theory Of Exclusion For A Post-Patriot Act America, Christian Halliburton Jan 2005

Leveling The Playing Field: A New Theory Of Exclusion For A Post-Patriot Act America, Christian Halliburton

Faculty Articles

This article takes the position that, although the PATRIOT Act is superficially unrelated to the specifics of the exclusionary rule, such a drastic departure from constitutional norms would not have been possible had the Court not conditioned the Fourth Amendment exclusionary rule's operation on pursuit of the inherently unstable target of institutional deterrence. Part I of this article will trace the development of the Fourth Amendment's exclusionary rule from its origins in federal court through its incorporation against the states, paying particular attention to the underlying purpose of the exclusionary rule as announced by the Court, and concluding with a …

Toward Reconciliation In The Middle East: A Framework For Christian-Muslim Dialogue Using Natural Law Tradition, Russell Powell Jan 2005

Toward Reconciliation In The Middle East: A Framework For Christian-Muslim Dialogue Using Natural Law Tradition, Russell Powell

Faculty Articles

In this paper, Professor Powell argues that the thinking of Bernard Lonergan in light of the natural law insights of St. Thomas Aquinas, Ali Ezzati and Abdullahi Ahmed An-Na'im provides a framework for Christian-Muslim dialogue. Lonergan's transcendental method moves from the individual subject to universal insights rather than presuming to deduce universals a priori, without regard for history, culture and individual experience. Professor Powell asserts that the most fruitful starting place for meaningful dialogue is to address questions of human rights and social justice using natural law theory, rather than focusing on theological concerns. If Muslims and Christians mutually acknowledge …

Walking While Muslim, Margaret Chon, Donna E. Arzt Jan 2005

Walking While Muslim, Margaret Chon, Donna E. Arzt

Faculty Articles

In the post-9/11 era, what exactly is meant by race? This essay claims that both domestic civil rights law and international human rights law simultaneously create and obscure racial identity increasingly constructed through Muslim religious identity. The argument unfolds in several parts. First, by analogy to the racial formation process that occurred with the Japanese American community after World War II, we argue that a group's religious identity can contribute to the perception of a group as a racially different and inferior "other." Second, among other elements, religious identity is under-analyzed as a key element of racial formation. Third, post-9/11 …

Faculty Articles

In this review, the author expresses praise for DHSC 7, a document that covers court cases from 1796 to 1797. It highlights various particular cases while noting how effectively they are examined. Ultimately, the review advocates that students of legal history should consider the DHSC 7.

Comparison Of Accuracy Captured By Different Controlled Languages In Oral Pathology Diagnoses, Jung-Wei Chen, Catherine Flaitz, Todd Johnson Jan 2005

Comparison Of Accuracy Captured By Different Controlled Languages In Oral Pathology Diagnoses, Jung-Wei Chen, Catherine Flaitz, Todd Johnson

Faculty, Staff and Student Publications

This project was comparing the accuracy of capturing the oral pathology diagnoses among different coding systems. 55 diagnoses were selected for comparison among 5 coding systems. The results of accuracy in capturing oral diagnoses are: AFIP (96.4%), followed by Read 99 (85.5%), SNOMED 98 (74.5%), ICD-9 (43.6%), and CDT-3 (14.5%). It shows that the currently used coding systems, ICD-9 and CDT-3, were inadequate, whereas the AFIP coding system captured the majority of oral diagnoses. In conclusion, the most commonly used medical and dental coding systems lack terms for the diagnosis of oral and dental conditions.

The Labor Dimension Of The Emerging Free Trade Area Of The Americas, Steve Charnovitz Jan 2005

The Labor Dimension Of The Emerging Free Trade Area Of The Americas, Steve Charnovitz

GW Law Faculty Publications & Other Works

This study explores a potential labor dimension for the FTAA. The study is divided into four parts: Part 1 provides context by reviewing the history of Inter-American economic cooperation, especially on labor and trade. Part 2 examines how labor has been addressed in the major free trade agreements of the Americas. Part 3 looks at the normative basis for international labor cooperation. Part 4 makes specific recommendations for addressing labor issues in the FTAA. The ideas in Part 4 seek to stimulate practical, concerted action to address labor and employment problems of regional economic integration. My recommendations for the FTAA …

Spectacle Of Self In Medieval Romance: Pagentry, Performance, And Clothing, Crady Yerger Bobo Jan 2005

Spectacle Of Self In Medieval Romance: Pagentry, Performance, And Clothing, Crady Yerger Bobo

Honors Theses

My thesis focuses on young knights finding their identity. I concentrate on six works, The Story of the Grail, Havelok the Dane, Sir Gareth of Orkeney, Guigemar, Sir Launfal, and Sir Gawain and the Green Knight, and how the various romancers define identity thematically. This occurs in three dififerent ways: with Perceval it is through education, Havelok and Gareth start out as kitchen boys, prove their inherent identity, and are thus self-inventing knights, and for Guigemar, Launfal, and Perceval it is about having their sexuality challenged. I also try in each chapter to give some historical background on the reason …

Should Lawyers Participate In Rigged Systems: The Case Of The Military Commissions, Mary M. Cheh Jan 2005

Should Lawyers Participate In Rigged Systems: The Case Of The Military Commissions, Mary M. Cheh

GW Law Faculty Publications & Other Works

Lawyers often represent clients when the odds are long or a catastrophe likely. The facts might be harmful, the evidence overwhelming, or the law clearly on the side of the opponent. Still, we do the best we can. But what if the system is rigged? What if the system has the trappings of a fair fight, but is, in fact, skewed to one side and, by design, the lawyer cannot fully defend the client? What if the lawyer can only lend legitimacy to a process that at its core is biased, slanted in favor of the other side, or fundamentally …

H-1b Worker Visas: Past, Present, And Future, Keith Gaines Drago Jan 2005

H-1b Worker Visas: Past, Present, And Future, Keith Gaines Drago

Honors Theses

The purpose of this thesis is to overview the past, present, and future of the H-IB temporary non-immigrant specialty workers visa and to identify what events have caused and continue to cause significant changes in its policies. These significant changes entail the implications the H-IB visa has for employers and managers when deciding a long term recruiting policy. The information used in this study was gathered from multiple statistical government internet sites, such as the Bureau of Labor Statistics and the United States Citizenship and Immigration Service. The data was also made available through immigration web sites and testimony at …

Perfect Order: A Collection Of Short Stories, Virginia Lyons Shields Jan 2005

Perfect Order: A Collection Of Short Stories, Virginia Lyons Shields

Honors Theses

The stories in this collection have been written over the course of the past school year. I participated in a writing workshop in the fall semester that was instructed by Tom Franklin, and in which I was able to learn the importance of peer revision in the writing process. Over the spring semester, I have worked on several new stories, which are included here, as well as the stories from the writing workshop. My purpose in writing this thesis is to explore the creative process of writing and to produce original works of fiction.
