Numerical Simulation Of Double‐Diffusive Finger Convection, Joseph D. Hughes, Ward E. Sanford, H. L. Vacher Jan 2005

Numerical Simulation Of Double‐Diffusive Finger Convection, Joseph D. Hughes, Ward E. Sanford, H. L. Vacher

School of Geosciences Faculty and Staff Publications

A hybrid finite element, integrated finite difference numerical model is developed for the simulation of double‐diffusive and multicomponent flow in two and three dimensions. The model is based on a multidimensional, density‐dependent, saturated‐unsaturated transport model (SUTRA), which uses one governing equation for fluid flow and another for solute transport. The solute‐transport equation is applied sequentially to each simulated species. Density coupling of the flow and solute‐transport equations is accounted for and handled using a sequential implicit Picard iterative scheme. High‐resolution data from a double‐diffusive Hele‐Shaw experiment, initially in a density‐stable configuration, is used to verify the numerical model. The temporal …

The Social Foundations Of Law, Martha Albertson Fineman Jan 2005

The Social Foundations Of Law, Martha Albertson Fineman

Faculty Articles

There are several important questions to ask both our politicians and ourselves as we seek to refine and further define an otherwise abstract commitment to substantive equality with which to replace our current formal version. As with many concepts of historic magnitude, some of the most significant questions to pose about equality have to do with how we should respond to evolutions in understanding and changes in aspiration for the term: ls a mere commitment to formal equality sufficient for a humane and modem state? How should the state respond to the fact that our society is increasingly one in …

Deterrence Versus Brutalization: Capital Punishment's Differing Impacts Among States, Joanna M. Shepherd Jan 2005

Deterrence Versus Brutalization: Capital Punishment's Differing Impacts Among States, Joanna M. Shepherd

Faculty Articles

Recent empirical studies by economists have shown, without exception, that capital punishment deters crime. Using large data sets that combine information from all fifty states over many years, the studies show that, on average, an additional execution deters many murders. The studies have received much publicity, and death penalty advocates often cite them to show that capital punishment is sound policy.

Indeed, deterrence is the central basis that many policymakers and courts cite for capital punishment. For example, President Bush believes that capital punishment deters crime and that deterrence is the only valid reason for capital punishment. Likewise, the Supreme …

Low-Income Taxpayers And The Modernized Irs: A View From The Trenches, Nancy Abramowitz, Janet Spragens Jan 2005

Low-Income Taxpayers And The Modernized Irs: A View From The Trenches, Nancy Abramowitz, Janet Spragens

Scholarly Articles in Law Reviews & Journals

This article examines the continuing effects on low-income taxpayers of the 1998 Internal Revenue Service reorganization and computer modernization of the agency. Specifically, the article highlights the severe hardships that have been experienced by that segment of the taxpayer population resulting from agency efforts to streamline resolution of postfiling disputes. Those efforts include acceleration of the administrative process, centralization of agency function, elimination of local contracts, and increasing reliance on computer-generated correspondence. The authors believe that the net result for many taxpayers has been the trading of fairness for administrative efficiency and the contraction - and often denial - of …

Coordinating Multijurisdiction Class Actions Through Existing Certification Processes, Janet Walker Jan 2005

Coordinating Multijurisdiction Class Actions Through Existing Certification Processes, Janet Walker

Articles & Book Chapters

With legislative regimes permitting multijurisdiction class actions on an opt-out basis, it is increasingly likely for persons to be subject to conflicting determinations of their rights and for defendants to be confronted with claims on behalf of plaintiff classes of uncertain size and scope. This comment outlines means by which competition between multijurisdiction class actions in Canada may be regulated through existing certification process.

The Unforgiven Sources Of International Law: Nation-Building, Violence And Gender In The West(Ern), Ruth Buchanan, Rebecca Johnson

Articles & Book Chapters

In his classic work, ‘Nomos and Narrative,’ Cover reminds us that legal traditions form part of a complex normative world – a ‘nomos’ – a world of language and myth. Because precept and narrative operate together to ground meaning, one cannot truly inhabit any given nomos without a rich understanding of its narratives. The very intelligibility of behaviour within the nomos inheres in the communal nature of common scripts or narratives for that behaviour. International law is also supplied with ‘history and destiny, beginning and end, explanation and purpose’ in and through narratives. In contrast with conventional approaches, new scholarship …

The Rule In Hodge's Case: Rumours Of Its Death Are Greatly Exaggerated, Benjamin Berger Jan 2005

The Rule In Hodge's Case: Rumours Of Its Death Are Greatly Exaggerated, Benjamin Berger

Articles & Book Chapters

Certain academic commentators and Canadian courts have announced the death of the rule in Hodge's Case. The author challenges this proclamation of death, observing that Hodge's rule is a particular manifestation of the epistemology that informs our law of evidence. He argues not only that the rule is doctrinally intact, but that the principles and spirit that animate Hodge's rule have broad influence in our law of evidence and have utility in the appellate review of unreasonable verdicts. Hodge's rule, Hodge-like reasoning, and the associated epistemology, are alive and well in Canada.

Through The Looking Glass: Mediator Conceptions Of Philosophy, Process And Power, Colleen M. Hanycz Jan 2005

Through The Looking Glass: Mediator Conceptions Of Philosophy, Process And Power, Colleen M. Hanycz

Articles & Book Chapters

While a number of civil reforms using mediation have emerged across Canada in recent years, of particular interest is the Ontario Mandatory Mediation Program that was first piloted in 1999, deemed successful and then made a permanent feature of the Rules of Civil Procedure in 2001. This article suggests that before we can evaluate the outcomes of mandatory mediation, we must first look more closely at the process being implemented by the mediators in this context. With that in mind, this article considers the ways in which the mediators themselves perceive of the mediation process. It reports on a qualitative …

Narratives Of Adolescent Students: The Integration Of Health And Learning Through Application Of Nursing Theory, Marjean Huber

Dissertations

Problem. There are few resources to show educators how to help students improve learning by improving health and mental well-being. There is a lack of integration in the literature in terms of how practitioners can reach these students in order to help them learn effectively and develop into successful, productive adults with meaningful lives. This study has three major sections. First, I examine my experiences within education to determine what values, truths, and principles mold my practice. Second, I identify my teaching practice in relationship to nursing theory integrating it with learning theory, thus highlighting the relationship between the health …

Policing The Border Between Trademarks And Free Speech: Protecting Unauthorized Trademark Use In Expressive Works, Pratheepan Gulasekaram Jan 2005

Policing The Border Between Trademarks And Free Speech: Protecting Unauthorized Trademark Use In Expressive Works, Pratheepan Gulasekaram

Faculty Publications

Artists and other creators of expressive works often include trademarks and trademarked products as part of their works. They do so for a number of reasons, including lighthearted humor, critical cultural commentary, parody, or even simply to shock. In instances where such use is both unauthorized by and perceived as disparaging to the mark owner or the trademarked product, owners have attempted to sue under trademark law to enjoin the expressive use. This Article argues that, under a proper analysis of trademark law, precedent, and the free expression ideal enshrined in the First Amendment, mark owners should rarely, if ever, …

Does The Charter Matter?, Harry W. Arthurs, Brent Arnold

Articles & Book Chapters

This article investigates whether Canada has changed in ways the ways that proponents of the Charter desired and anticipated. We examine the progress of groups that the Charter was intended to benefit (Aboriginal peoples, women, visible minorities, and immigrants); areas of state action that the Charter was intended to regulate (the criminal process and bureaucratic behaviour); and aspects of our communal and public life that the Charter was intended to animate and enhance (politics and inter-group cultural relations). We rely on a significant number of studies of Canadian social development during the period from 1982 to the present. Available evidence …
