Book Review: The Myth Of Law And Literature, Bernadette A. Meyler

In The Myth of Moral Justice, Thane Rosenbaum generates an ambitious and idealistic plan for a rapprochement between law and morality, between emotion and reason, and between law and its literary representations. Laudable and inspiring, Rosenbaum's project remains flawed in several ways that are traceable back to his reliance on aspects of law and literature scholarship. Unfortunately, Rosenbaum's attempt to replace the myth of moral justice with a truly moral legal system depends itself on a particular set of myths about law and literature. Determining the chemical structure and composition of biomass fuels using x-ray photoelectron spectroscopy XPS can provide fundamental knowledge of their structures that is useful in understanding and predicting their combustion behavior. Straw is an example of an agricultural residue byproduct of food and feed production of potential interest for biomass combustion. The XPS spectra of straw provide both its elemental composition and indications of its bonding. Traditional fuel analyses of this fuel are also provided. This article examines the legal justification and practical application of recent Florida Supreme Court decisions classifying all comprehensive plan amendments as legislative decisions and all other zoning changes as quasi-judicial. The author outlines historical trends and concerns relating to the appropriate standard of judicial review for zoning actions, followed by a review of the evolution of the statutes and case law in Florida. The article challenges the standard of deference for legislative review of zoning actions based on separation of powers and due process. This paper asks two questions connected by the fact that they both stem from the inherent incompleteness of employment contracts: in American law, how can the terms in employment handbooks be variable, but sometimes only within reasonable procedurally fair circumstances; and in English law, why doesn’t the implied term of mutual trust and confidence in employment contracts fall foul of the strict test for implication of terms into contract? Abstract This article explores the economic principles and theories underlying loss causation in the context of securities fraud litigation. It explains the difference between “investment loss” and recoverable “inflationary loss” and posits that the latter consists of the difference between inflation in stock prices caused by the fraud at the time of purchase and inflation in the price at the time of sale. It reviews scenarios in which inflationary loss due to fraud may occur and would be recognized as a matter of economic theory as well as a matter of law. It urges that Dura v. A method is provided for detecting or predicting an undesired deviation in variability of at least one parameter being monitored, wherein the variation in the parameter is incrementally recorded. The method comprises establishing the number of subsets of a dataset that have a range of the difference between any two datapoints within the dataset, and computing a control chart for the range based thereon. The method accurately detects changes in variability in real time. The true distribution of the data is reflected, and the desired result is achieved without requiring an inordinate number of computations.

High-Temperature Calcium Vapor Cell For Spectroscopy On The 4s2 1s0-4s4p 3p1 Intercombination Line, Christopher J. Erickson, Brian Neyenhuis, Dallin S. Durfee

We have demonstrated a high-temperature vapor cell for absorption spectroscopy on the Ca intercombination line. The cell uses a dual-chamber design to achieve the high temperatures necessary for an optically dense vapor while avoiding the necessity of high-temperature vacuum valves and glass-to-metal seals. We have observed over 50% absorption in a single pass through the cell. Although pressure broadening in the cell prevented us from performing saturated-absorption spectroscopy, the broadening resulted in higher signal-to-noise ratios by allowing us to probe the atoms with intensities much greater than the 0.2µW/cm2 saturation intensity of the unbroadened transition. This work examines the social practice of blaming, beginning with a prominent view of the moral philosophy of blaming, the semantics of character that support this (and related) views, and the social and cultural biases we bring to the process of attributing blame. Our penchant for blaming is too often manifest in a hyper-willingness to attribute wrongdoing solely to the character of the wrongdoer, often overlooking the salience of the varied situations in which the wrongdoer finds himself. I synthesize the wealth of data, mostly from social psychology, showing that blaming actualizes our own dispositions for over-emphasizing the actor’s wicked …

It is conventional knowledge that heterotrophic bacteria play a key role in the biogeochemical cycling of oceanic carbon. However, only recently has their role in marine iron ( Fe) biogeochemical cycles been examined. Research during this past decade has demonstrated an inextricable link between Fe chemistry and the biota, as >99% of Fe in marine systems is complexed to organic chelates of unknown but obviously biotic origin. Here we present a novel approach to assess and compare Fe bioavailability in low Fe HNLC waters using a bioluminescent bacterial reporter that quantitatively responds to the concentration of bioavailable Fe by producing …
