Spivak After Marx After Derrida, Philip Leonard Jan 2005

Spivak After Marx After Derrida, Philip Leonard

Reconstruction: Studies in Contemporary Culture

Spivak is often viewed as an unequivocally deconstructive theorist, and she frequently reinforces this impression by proclaiming her allegiance to Derrida's ideas. Recent comments by her suggest, however, that there are limits to her deconstructive convictions. This essay considers some of Spivak's debts to Derrida's work, though it is primarily concerned with those occasions when she states her misgivings about his ability to understand postcoloniality, global power, and resistance movements. Reading Marx more accurately would, she insists, have allowed Derrida both to grasp capitalism's complex logic and to consider the effects of subaltern interventions upon capitalism's global authority. Such an …

Toward A More Equitable Approach To Causation In Veterinary Malpractice Actions, Jayne De Young Jan 2005

Toward A More Equitable Approach To Causation In Veterinary Malpractice Actions, Jayne De Young

UC Law SF Journal on Gender and Justice

The legal and economic barriers to veterinary malpractice cases are significant. Potential plaintiffs are often discouraged from pursuing their claims because of the very limited potential for significant damages and the difficulty of proving causation. This Note advocates a burden-shifting approach to the causation element of veterinary malpractice. It commences with an overview of some of the different methods by which animal guardians have sought redress for the injury or death of an animal while under the care of a veterinarian. This overview is followed by a detailed look at the elements of veterinary malpractice. Next, the recordkeeping standards in …

Re-Membering Law In The Internationalizing World, Vivian Grosswald Curran Jan 2005

Re-Membering Law In The Internationalizing World, Vivian Grosswald Curran

Hofstra Law Review

This article examines some of the challenges to understanding new, non-national legal configurations as contexts of origin color understandings and evaluations of legal standards allegedly shared across legal communities. It examines a case on assisted suicide, Pretty v. U.K., decided by the European Court of Human Rights. The case illustrates mechanisms of legal integration in the European court, followed by a process of dis-integration that occurred when the decision was reported to the French legal community. The French rendition reflected a legal community's inability to process common law information through civil law cognitive grids. The article addresses both the capacity …

The Evolution Of The "Patient": Shifts In Attitudes About Consent, Genetic Information, And Commercialization In Health Care, Janet L. Dolgin Jan 2005

The Evolution Of The "Patient": Shifts In Attitudes About Consent, Genetic Information, And Commercialization In Health Care, Janet L. Dolgin

Hofstra Law Review

This paper considers the importation of the notion of autonomous individuality into the world of healthcare during the last half century; it also explores the related transformation of the patient into a consumer. These developments have many beneficial dimensions. However, this paper focuses on these developments gone awry so that the result is some sort of excess. The paper describes three such excesses. It refers to the first as the elaboration of autonomous individuality and illustrates it with reference to the involution of the informed consent doctrine. The second excess is referred to as the perversion of autonomous individuality; this is …

Lifting Our Veil Of Ignorance: Culture, Constitutionalism, And Women's Human Rights In Post-September 11 America , Catherine Powell Jan 2005

Lifting Our Veil Of Ignorance: Culture, Constitutionalism, And Women's Human Rights In Post-September 11 America , Catherine Powell

Faculty Scholarship

This Article challenges the culture clash view of human rights law, which posits a clash between Western countries' presumed respect for women's human rights and non-Western countries' presumed rejection of these rights on cultural and religious grounds. Since the September 11 terrorist attacks, this view has taken on new significance, in light of the perceived civilizational divide between the Western and Muslim worlds. The Article calls into question this view, by examining cultural stereotypes of women used to oppose U.S. ratification of the Convention on the Elimination of All Forms of Discrimination Against Women. My reading, therefore, is at odds …

Long-Term Improvement In Unsafe Injection Practices Following Community Intervention, Stephen Luby, Fawzia Hoodbhoy, Aziz Jan, Aly Shah, Yvan Hutin Jan 2005

Long-Term Improvement In Unsafe Injection Practices Following Community Intervention, Stephen Luby, Fawzia Hoodbhoy, Aziz Jan, Aly Shah, Yvan Hutin

Community Health Sciences

Background: A study in 1994 identified frequent unsafe injections as the cause of widespread hepatitis C virus infection in Hafizabad, Pakistan. A simple low cost community education program was assessed to see if it improved injection safety. Methods: A local health organization developed educational materials on hepatitis C including advice on how to avoid unnecessary injections and, when injections were necessary, to use a new syringe and needle. Beginning in 1995, this advice was communicated through multiple channels including health education meetings, announcements in mosques, and via pamphlets. In 1998 study workers revisited controls from the 1994 case-control study (along with …

Shades Of Dispossession: Neoliberalism And The Social Production Of Credibility, In Machu Picchu, Peru, Pellegrino A. Luciano Jan 2005

Shades Of Dispossession: Neoliberalism And The Social Production Of Credibility, In Machu Picchu, Peru, Pellegrino A. Luciano

Dissertations, Theses, and Capstone Projects

This dissertation ethnographically examines the inconsistencies experienced by district residents in the historic and nature Sanctuary of Machu Picchu, over the Peruvian government's drive to implement neoliberal policies. Heritage conservation in the southern Peruvian Andes is increasingly shaped by current neoliberal policies. The people who live in the district of Machu Picchu live in a protected area that gives the state expropriating powers to claim the land as a public good. The central problem is that under neoliberalism, a public asset is used for private gain at the expense of residents. Inhabitants experience changing juridical relationships as a contradiction between …

Contracts In Athenian Law, Ellen Knopf Jan 2005

Contracts In Athenian Law, Ellen Knopf

Dissertations, Theses, and Capstone Projects

This dissertation investigates contracts and the contractual language of 4th century B. C. Athens. Its main source is Attic oratory although there is some discussion of inscriptions. Since no ancient Greek word has the same range of meanings as the English word 'contract', the first task is to consider the characteristics of transactions that will count as contracts in the study and to define the term. After giving criteria for identifying contracts, the study examines Greek words whose dictionary definitions include the word 'contract'. Part I surveys the terms, όμολογία, συγγραϕή, συμβόλαιον and συνθήκη, discussing their senses in oratory …

The Development And Implementation Of A Pilot Training Course In Pastoral Diagnosis For Six Pastors In The Lake Region Conference, Richard D.B. Sylvester Jan 2005

The Development And Implementation Of A Pilot Training Course In Pastoral Diagnosis For Six Pastors In The Lake Region Conference, Richard D.B. Sylvester

Doctor of Ministry Projects

Problem

This study was an examination of the counseling style of six pastors and to determine if they have a clearly defined method of informing their interventions.

Child Abuse And Crime: Testing In The "Cycle Of Violence" Theory, Melanie A. Cox Jan 2005

Child Abuse And Crime: Testing In The "Cycle Of Violence" Theory, Melanie A. Cox

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study of Child Abuse and Neglect: Testing in the "Cycle of Violence" Theory, is a demonstration of Applied Social Research in partial fulfillment of a master's degree in Sociology. It examines the Cycle of Violence theory by looking at two groups of children: an abuse/neglect group and a control group. It tests the likelihood of the abuse/neglect group to commit a crime in adulthood i.e., property crime, person crime, or public morality; while controlling for race, sex and type of abuse. Also, the odds of gender and race of the children in the abuse/neglect group, becoming a criminal offender …

The Killing Machine Of Exception: Sovereignty, Law, And Play In Agamben’S State Of Exception, Puspa Damai Jan 2005

The Killing Machine Of Exception: Sovereignty, Law, And Play In Agamben’S State Of Exception, Puspa Damai

English Faculty Research

Giorgio Agamben’s slender but profound monograph on the state of exception is an intervention into a world that is becoming more and more exceptionalist. The events of 9/11, the War on Terror, and the successive decrees and acts authorizing fingerprinting, interrogation, and indefinite detention of suspects in terrorist activities, all testify to Agamben’s prophetic portrayal of contemporary politics in which the state of exception—normally a provisional attempt to deal with political exigencies— has become a permanent practice or paradigm of government. When the exception becomes the rule, it results, argues Agamben, not only in the appropriation of the legislative or …

Images Of God: The Effect Of Personal Theologies On Moral Attitudes, Political Affiliation, And Religious Behavior, Christoper Bader, Paul Froese Jan 2005

Images Of God: The Effect Of Personal Theologies On Moral Attitudes, Political Affiliation, And Religious Behavior, Christoper Bader, Paul Froese

Sociology Faculty Articles and Research

Social scientists often explain religious effects in terms of religious group affiliations. Typically, researchers identify religious groups by denomination or some broader popular categorization, such as “fundamentalist” or “evangelical.” To capture religious differences more effectively, Steensland et al. (2000) propose an intricate classification of American denominations that takes into account the theology and historical development of various American religious traditions to predict individual attitudes and behaviors. We believe that equal care and attention should be devoted to the development of key measures of belief that may cross denominational lines. In this article, we propose one such measure: personal conceptions or …

Sacred Visions Of Law, Robert Tsai Jan 2005

Sacred Visions Of Law, Robert Tsai

Scholarly Articles in Law Reviews & Journals

Around the time of the Bicentennial Celebration of the U.S. Constitution's framing, Professor Sanford Levinson called upon Americans to renew our constitutional faith. This article answers the call by examining how two legal symbols - Marbury v. Madison and Brown v. Board of Education - have been used by jurists over the years to tend the American community of faith. Blending constitutional theory and the study of religious form, the article argues that the decisions have become increasingly linked in the legal imagination even as they have come to signify very different sacred visions of law. One might think that …

Attitudes Of Culturally Diverse Parents And Their Beliefs About The Role They Play In Their Children's Education, Suneetha S. De Silva, Sandra Kay Streeter Jan 2005

Attitudes Of Culturally Diverse Parents And Their Beliefs About The Role They Play In Their Children's Education, Suneetha S. De Silva, Sandra Kay Streeter

Northwest Journal of Teacher Education

This study examined parental involvement in early childhood programs through a combined lens of anthropology, sociology, and pedagogy seeking to understand the intentional and unintentional behaviors of teachers that may create barriers for parental involvement. The study gave voice to parents from culturally diverse backgrounds that are often overlooked. The study recognized the disparity and disconnectedness that seems to exist in communication between the child's most important caregivers, their parents and their teachers. The findings lead to an understanding that over the popular belief that parents are not involved in the education of their children, the lack of participation in …

Globalization And National Culture: Recent Trends Toward A Liberal Exchange Of Cultural Objects, Kurt G. Siehr Jan 2005

Globalization And National Culture: Recent Trends Toward A Liberal Exchange Of Cultural Objects, Kurt G. Siehr

Vanderbilt Journal of Transnational Law

In discussing trends toward liberal exchange of cultural objects, it must be stressed that the exchange should be a legal exchange. This, however, is not easy to define because legal systems differ with respect to the qualifications of legality of art trade. Since United States v. Schultz, there is less of a disparity between Europe and the United States as to the characterization of illegal excavations as a kind of theft in countries claiming that archaeological finds are state property. Also, with respect to export prohibitions, there is not much disagreement so far: in all countries, foreign export prohibitions are …

"Can Women Become Priests?": A Catholic Feminist Perspective, Susan A. Ross Jan 2005

"Can Women Become Priests?": A Catholic Feminist Perspective, Susan A. Ross

Journal of Hindu-Christian Studies

Can women become priests? The answer to this question depends on whom you ask. For many Protestants, the answer is both yes and no. The only priest is Jesus Christ and all Christian share in the priesthood. As Luther wrote, we are all priests to one another, but there is no special ministry of priesthood that makes one person distinct from others. There are pastors, people who are called to preach and lead worship, but they are not priests. Luther, of course, did not consider women able to be pastors, but his followers (at least the non-Wisconsin or non-Missouri Synod …
