Die Perle: A 1920s German Trade Journal, Anita Von Kahler Gumpert, Karlis Karklins

BEADS: Journal of the Society of Bead Researchers

Though short lived, the German trade journal, Die Perle, contains a wealth of information concerning the European bead and jewelry industry of the 1920s. Short articles provide insight into new machinery and apparatus for producing beads, natural and artificial materials for the production of beads and other ornaments, fashion trends, market reports, and numerous other topics. As well, there are several departments which deal with specific themes such as technical questions and sources of supplies. As the journals are in German, English summaries are provided for a representative sample of the articles to give the reader an idea of their …

Legal Realism, Common Courtesy, And Hypocrisy, Keith J. Bybee Jan 2005

Legal Realism, Common Courtesy, And Hypocrisy, Keith J. Bybee

College of Law - Faculty Scholarship

In the United States, courts are publicly defined by their distance from politics. Politics is said to be a matter of interest, competition, and compromise. Law, by contrast, is said to be a matter of principle and impartial reason. This distinction between courts and politics, though common, is also commonly doubted - and this raises difficult questions. How can the courts at once be in politics yet not be of politics? If the judiciary is mired in politics, how can one be sure that all the talk of law is not just mummery designed to disguise the pursuit of partisan …

Pluralizing International Criminal Justice, Mark A. Drumbl Jan 2005

Pluralizing International Criminal Justice, Mark A. Drumbl

Scholarly Articles

This Review Essay of Philippe Sands' (ed.) From Nuremberg to the Hague (2003) explores a number of controversial aspects of the theory and praxis of international criminal law. The Review Essay traces the extant heuristic of international criminal justice institutions to Nuremberg and posits that the Nuremberg experience suggests the need for modesty about what criminal justice actually can accomplish in the wake of mass atrocity. It also explores the place of one person's guilt among organic crime, the reality that international criminal law may gloss over criminogenic conditions in its pursuit of individualized accountability, the possibility of group sanction …

Grounding Normative Assertions: Arthur Leff's Still Irrefutable, But Incomplete, "Sez Who?" Critique, Samuel W. Calhoun Jan 2005

Grounding Normative Assertions: Arthur Leff's Still Irrefutable, But Incomplete, "Sez Who?" Critique, Samuel W. Calhoun

Scholarly Articles

The late Professor Arthur Leff believed that standard methods for grounding normative assertions fail to provide a solid foundation for moral judgment because none provides a satisfactory answer to what Leff called the grand 'sez who?' - a universal taunt by which a skeptic may challenge the standing/competency of the speaker to make authoritative moral assessments. Leff argued that as a matter of logic no system of morals premised in mankind alone ever could withstand the taunt. His provocative conclusion was that the only unchallengeable response to the grand 'sez who?' is God sez.

This Article demonstrates the continued relevance …

The 19th Century Excavation Of Kent's Cavern, England, Donald A. Mcfarlane, Joyce Lundberg Jan 2005

The 19th Century Excavation Of Kent's Cavern, England, Donald A. Mcfarlane, Joyce Lundberg

WM Keck Science Faculty Papers

Between 1858 and 1880, William Pengelly developed revolutionary new techniques for the archeological and paleontological excavation of cave deposits. His work at Brixham Cave and Kent’s Cavern, England, yielded tens of thousands of specimens from the mid-Pleistocene to the Holocene, settled the intellectual debate over the co-existence of humans and extinct mammals, and accumulated an unparalleled resource for continued study. Although the Brixham Cave work was thoroughly summarized in print, Pengelly never published the plans of his much more thorough and extensive excavations at Kent’s Cavern. Here we present a reconstructed plan of the Pengelly excavations that we hope will …

Medical, Racist, And Colonial Constructions Of Power In Anne Fadiman's The Spirit Catches You And You Fall Down, Monica E. Chiu Jan 2005

Medical, Racist, And Colonial Constructions Of Power In Anne Fadiman's The Spirit Catches You And You Fall Down, Monica E. Chiu

English

This essay looks at the values attributed or denied to "culture" (medical culture, history, Southeast Asian refugees, Asian American cultural citizenship) in the care surrounding a Hmong child diagnosed with spirit loss, according to Hmong interpretation, or epilepsy, as defined by Western medicine. In my reading of Anne Fadiman's The Spirit Catches You and You Fall Down: A Hmong Child, Her American Doctors, and the Collision of Two Cultures, medical, colonial, and authorial knowledge often converge in devastating ways, linking the seemingly disparate discourses of war, refugee medicine, and the model minority through colonial representations. I also look at the …

Two Simple Resistant Regression Estimators, David J. Olive Jan 2005

Two Simple Resistant Regression Estimators, David J. Olive

Articles and Preprints

Two simple resistant regression estimators with OP(n−1/2) convergence rate are presented. Ellipsoidal trimming can be used to trim the cases corresponding to predictor variables x with large Mahalanobis distances, and the forward response plot of the residuals versus the fitted values can be used to detect outliers. The first estimator uses ten forward response plots corresponding to ten different trimming proportions, and the final estimator corresponds to the “best” forward response plot. The second estimator is similar to the elemental resampling algorithm, but sets of O(n) cases are used instead of randomly …

Community And Democracy: Syracuse Reflections, Richard E.D. Schwartz Jan 2005

Community And Democracy: Syracuse Reflections, Richard E.D. Schwartz

Syracuse Journal of International Law and Commerce

How does the American experience with democracy contribute to our understanding of the prospects for, and paths to, democracy worldwide?" Another half of the papers prepared for the Conference deal with the experience of other countries, many of them moving toward rule-of-law democracy. Taken together, they represent a sample of our present knowledge-and they suggest new directions for future research. Communities with certain qualities contribute to the development and sustaining of democracy. The qualities to which I refer include: mutual respect across lines of division and the creative composition of differences. At Syracuse, we saw two kinds of community: local …

Genre Across The Curriculum, Anne Herrington, Charles Moran Jan 2005

Genre Across The Curriculum, Anne Herrington, Charles Moran

All USU Press Publications

American first-year college writing courses operate without a powerful context: they are designed to teach academic writing, but what kind of academic writing? Which of the many particular discourses, and, within those discourses, which recurring social situations? Lacking a clear context to refer to, textbook authors inevitably privilege form. Genre across the Curriculum will function as a "good" textbook, one not for the student, but for the teacher, and one with an eye on the context of writing. Here you will find models of practice, descriptions written by teachers who have integrated the teaching of genre into their pedagogy in …
