Evaluating Bundled Discounts, Thom Lambert
Evaluating Bundled Discounts, Thom Lambert
Faculty Publications
This article identifies and critiques five attempts courts and commentators have made at articulating such an evaluative approach and, finding each approach lacking, proposes an alternative evaluative approach. The proposed approach would presume the legality of above-cost bundled discounts but would permit that presumption to be rebutted by a plaintiff that proved certain facts demonstrating that it had fully exhausted its competitive options and was, or was likely to become, as efficient as the discounter. The recommended approach would be easily administrable and would include clear safe harbors to ensure that procompetitive bundled discounting is not discouraged.

On-Line Training For Smes: Final Report, Beth Walker, Beverley Webster, Sue Stoney
On-Line Training For Smes: Final Report, Beth Walker, Beverley Webster, Sue Stoney
Research outputs pre 2011
This research aimed to explore the appropriateness of on-line training delivery methods for small business owner/managers.
It is widely recognised that training and education are effective ways to reduce small business failure. In Australia, small business accounts for 96 percent of Australian private sector, non-agricultural businesses and they employ 47 percent of the private sector, non-agricultural workforce. Not surprisingly then, encouraging the development of the skills of the workforce has emerged as a major priority for government policy. However, what is also recognised is that many small business owner/managers (SBOs) have limited e-competencies.
Results of this research confirmed this and …

Memory And Pluralism On A Property Law Frontier, The Contested Landscape Of New Mexico's Costilla Valley, Gregory A. Hicks
Articles
This article describes the decades-long dispute between Hispano settlers of the Costilla Valley in northern New Mexico's Sangre de Cristo Land Grant and the succession of entrepreneurial owners of the grant during the late nineteenth and early twentieth centuries. Through the U.S. Freehold Land and Emigration Company and its successors, the new Dutch and American owners sought to replace patterns of land and resource use developed during the Mexican period with patterns of use intended to support Anglo colonial settlement and intense development of the region's natural resources. The Dutch and American owners faced continuing resistance from the area's Hispano …

The 1989 Exxon Valdez oil spill caused extensive natural resource damage to the Prince William Sound. Lawsuits addressing this natural resource damage resulted in a settlement that required Exxon to pay $900 million over time to trustees charged with spending this money to restore the damaged environment of the Sound and nearby areas. The settlement included a “Reopener Clause,” which pledges Exxon to spend an additional $100 million to fund restoration or rehabilitation of resources whose injuries were not foreseeable in 1989.
This Article urges the State of Alaska and the United States to seek enforcement of the Reopener Clause, …

The ultrastructure of the Z-line, mitochondrial content and sarcotubular content differed between the 2 fiber types. In the application of 250 mg Cu/kg water, the histochemical characteristics of the IIIB fibers were clearly different from those …
Effects Of Heavy Metal Accumulation On The 96-H Lc_50 Values In Tench Tinca Tinca L., 1758, Syed Lal Shah, Ahmet Altindağ
Effects Of Heavy Metal Accumulation On The 96-H Lc_50 Values In Tench Tinca Tinca L., 1758, Syed Lal Shah, Ahmet Altindağ
Turkish Journal of Veterinary & Animal Sciences
The effects of already accumulated heavy metals (Hg, Cd, Pb) in the body of tench on the 96-h LC_50 values of the respective heavy metals were studied. The body concentration of mercury, cadmium and lead was 0.011, 0.32 and 1.59 mg/g respectively, and their 96-h LC_50 values were 1.0, 6.5 and 300.0, ppm, respectively. The general accumulation order of heavy metals and their respective 96-h LC_50 values were Hg< Cd< Pb. It was observed that the fish with lowest body concentration of heavy metal showed the lowest 96-h LC_50 value of the respective heavy metal and vice versa. This close relationship showed that the previous body accumulation of heavy metals has a direct effect on the 96-h LC_50 values of the respective heavy metals and the susceptibility of fish.
