Geosciences Faculty Publications

Aim: Among the various possible approaches to assess whether a species is native or introduced, the analysis of subfossil pollen and spores from natural archives is a valuable tool. Requirements include a sufficiently high taxonomic resolution of the pollen morphology, as well as sufficient temporal and spatial resolution. The aim of this study is to show the usefulness of this method in solving whether the taxon is native or introduced.

Location: The results are derived from two islands of the Azores: Flores and Pico. Methods: Analysis of pollen and spores in lake sediments; radiocarbon dating of the studied sediments.

Results: …

Nature/Culture Clash: The Transnational Trade In Gmos, Dayna Scott Jan 2005

Nature/Culture Clash: The Transnational Trade In Gmos, Dayna Scott

All Papers

This paper aims to offer a fresh perspective into what is at stake in the cross-cultural trade dispute over genetically-modified organisms (GMOs) by subjecting a particular discursive sample, the parties’ submissions to the WTO panel, to critical scrutiny. The first step involves a survey of the rhetorical strategies deployed by the parties’ in the presentation of their arguments to the Panel. Next, I embark on the task of ‘disassembling the double helix’. My use of the term ‘double helix’ in this analysis refers to the close coupling of scientific and legal discourses in the trade regime: science and law are …

Teaching Enron, Milton C. Regan

Georgetown Law Faculty Publications and Other Works

What follows is a discussion of several transactions that the Examiner analyzed for the Enron bankruptcy court. These represent only a portion of the many transactions that the Examiner analyzed, but constitute a large number of the transactions with respect to which he focused on the conduct of attorneys. In most of these cases, the Examiner found that Enron's lawyers potentially could be liable to the company under various causes of action. In some instances, the Examiner did not find potential liability. These transactions are included in my discussion, however, because they can be used to explore certain ethical issues …

Interspecific Competition For Pollination Lowers Seed Production And Outcrossing In Mimulus Ringens, John M. Bell, Jeffrey D. Karron, Randall J. Mitchell Jan 2005

Interspecific Competition For Pollination Lowers Seed Production And Outcrossing In Mimulus Ringens, John M. Bell, Jeffrey D. Karron, Randall J. Mitchell

Biology Faculty Research

Sympatric plant species with similar flowering phenologies and floral morphologies may compete for pollination, and as a consequence potentially influence each other's reproductive success and mating system. Two likely competitors are Mimulus ringens and Lobelia siphilitica, which co-occur in wet meadows of central and eastern North America, produce blue zygomorphic flowers, and share several species of bumble bee pollinators. To test for effects of competition for pollination, we planted experimental arrays of Mimulus ringens, each consisting of genets with unique combinations of homozygous marker genotypes. In two arrays we planted mixtures of Mimulus and Lobelia. and in two additional arrays …

Albany In The Life Trajectory Of Robert H. Jackson, John Q. Barrett

Faculty Publications

We recall Supreme Court Justice and Nuremberg prosecutor Robert Houghwout Jackson (1892-1954) for many reasons, but certainly a leading one is the striking contrast between his humble origins and his exalted destinations. Jackson's life began literally in the deep woods, on a family farm in the gorgeous rural isolation of Spring Creek Township in northwestern Pennsylvania's Warren County. He spent his boyhood and obtained his basic public school education in Frewsburg, a small town in southwestern New York State. While still a teenager, Jackson spent one additional year as a high school student in nearby Jamestown, New York, but he …

Resolving Treaty Conflicts, Christopher J. Borgen Jan 2005

Resolving Treaty Conflicts, Christopher J. Borgen

Faculty Publications

The viability of international law rests largely on the viability of treaties as a source of law. In the second half of the twentieth century, the international state system was supported by the development of treaties. States focused the majority of their regime-building efforts on three sets of concerns: restraining interstate conflict, securing human rights, and managing the economic system. States used treaties as the primary tool in the construction of these international institutions and in the codification of these norms. Moreover, treaties shift issues from the political arena into a juridical, rule-based, forum.

The very success of treaties as …

Effects Of Glial Cell Line-Derived Neurotrophic Factor (Gdnf) On Stem/Progenitor Cell Proliferation And Differentiation, Yan Chen Jan 2005

Effects Of Glial Cell Line-Derived Neurotrophic Factor (Gdnf) On Stem/Progenitor Cell Proliferation And Differentiation, Yan Chen

University of Kentucky Doctoral Dissertations

Stem/progenitor cells are present in the adult brain; they undergo constantproliferation and differentiate into mature neurons in certain brain areas, a phenomenoncalled neurogenesis. This study investigated the effects of GDNF, a potent trophic factorof dopaminergic neurons, on neurogenesis in the brain. Nestin and 5-Bromo-2'-deoxyuridine (BrdU) were used as stem/progenitor cells markers.First, we observed extensive bilateral increases of stem/progenitor cells in thedentate gyrus and substantia nigra after continuous infusion of GDNF into the normal ratbrain. However, none of the BrdU+ cells showed neuronal features in the substantia nigraas characterized by immunocytochemical procedures. Next, we identified themorphology of BrdU+ cells after infusing …

Morphometric, Karyotypic And Electrophoretic Analysis Of The Genus Apodemus Kaup, 1826 (Mammalia: Rodentia) In Thrace, Reyhan Çolak, Ercüment Çolak, Nuri̇ Yi̇ği̇t

Turkish Journal of Zoology

Thirty-two specimens of Apodemus in Thrace were evaluated. Ten specimens of A. flavicollis and A. sylvaticus were karyotyped. Eighteen specimens were electrophoresed to determine patterns of the esterase enzyme system. Morphometric analysis showed that A. flavicollis and A. sylvaticus were the closest species in a comparison between A. agrarius. A. flavicollis and A. sylvaticus with the same karyotypic values of 2n = 48, Nfa = 46, and NF = 48. Patterns of the esterase enzyme system clearly separated A. flavicollis, A. sylvaticus and A. agrarius.

Characterization Of Black Deposit Associated With Rock Paintings In Little Lost River Cave, Idaho Using Pyrolysis Gc, Sarah Therese Fezzey Jan 2005

Characterization Of Black Deposit Associated With Rock Paintings In Little Lost River Cave, Idaho Using Pyrolysis Gc, Sarah Therese Fezzey

Master's Theses and Doctoral Dissertations

A black, shiny coating overlies rock paintings in Little Lost River Cave no. 1, located in southeastern Idaho. If this coating is the result of human activity within the cave – a condensate from cooking fires, for example – then a radiocarbon date on the coating would provide a minimum age for the underlying paintings. The work reported here was undertaken to test the assumption that the coating has an anthropomorphic origin. Using pyrolysis-gas chromatography-mass spectrometry (py-GC-MS) and thermally-assisted hydrolysis/methylation-GC-MS, we have compared samples of the black coating from Idaho to humic acid, a geologic material; an experimental cooking residue; …

Trademark Law And The Social Construction Of Trust: Creating The Legal Framework For Online Identity, Beth Simone Noveck Jan 2005

Trademark Law And The Social Construction Of Trust: Creating The Legal Framework For Online Identity, Beth Simone Noveck

Articles & Chapters

Trust is the foundation of society for without trust, we cannot

cooperate. Trust, in turn, depends upon secure, reliable, and persistent

identity. Cyberspace is thought to challenge our ability to build trust

because the medium undermines the connection between online

pseudonym and offline identity. We have no assurances of who stands

behind an online avatar; it may be one person, it may be more, it may be a

computer. The legal debate to date has focused exclusively on the question

of how to maintain real world identity in cyberspace. But new "social

software" technology that enables communities from eBay to …

And My Best Friend, My Doctor, Won't Even Say What It Is I'Ve Got: The Role And Significance Of Counsel In Right To Refuse Treatment Cases, Michael L. Perlin

Articles & Chapters

For the past three decades, scholars have carefully considered the scope of the right of involuntarily committed psychiatric patients to refuse the administration of medication from a rich array of perspectives, including, but not limited to, clinical perspectives, civil libertarian perspectives, philosophical perspectives, and political perspectives. Yet, virtually all of this - remarkably - passes over what I believe is the single most important issue in real life. This issue is the most relevant to the actual (as opposed to paper) existence of theright and the actual (as opposed to paper) implementation of that right: the availability and adequacy ofcounsel …

Bad Writing: Some Thoughts On The Abuse Of Scholarly Rhetoric, Jethro K. Lieberman Jan 2005

Bad Writing: Some Thoughts On The Abuse Of Scholarly Rhetoric, Jethro K. Lieberman

Articles & Chapters

Like most kinds of writing, academic writing rarely shines, but far more often than ordinary writing scholarly prose is murky and impenetrable. This brief jeu d'esprit considers several forms of bad writing, rejecting the claim, increasingly made in academic quarters, that "difficult writing" is necessary to the scholarly enterprise. Bloated, foggy, and enigmatic prose masquerades as profundity that escapes conventional mental grooves. In fact it is useless, unethical, and taken far enough, evil.

Theory Saved My Life, Kris Franklin Jan 2005

Theory Saved My Life, Kris Franklin

Articles & Chapters

In part a tribute to the groundbreaking work of legal theorist Ruthann Robson, this article argues that theory and theorizing are under-examined yet basic skills which must be taught to all beginning law students. Positing that in order to be effective in law school and legal culture law students must learn to see, construct, deconstruct and use legal theories, the article articulates several common approaches to basic legal pedagogy and asks how they might be enhanced if pedagogy is embedded in a theoretical comprehension of thestudents' roles as interpreters of law. The article offers as examples artwork far removed from …

Flinging The Museum Guide Far Outside The Doctrinal Window, Larry M. Taylor

Reconstruction: Studies in Contemporary Culture

[First paragraph]

It may very well be easier to learn rather than to unlearn. Modes of learning quickly become habit forming; habits tend to become deeply ingrained and die hard. In the visual art world the roles that curator and viewer play can become routine and effectively cloud one's aesthetic vision like so much residue on the Sistine Chapel ceiling. Reorienting the viewer's visual experience and taming the curator's heavy hand are among the aims of Barbara Kendrick and Timothy van Laar in Losing the Instructions, a two person installation at the Sheldon Memorial Art Gallery in Lincoln, Nebraska. …
