There were very few problems with preemption of the state right of publicity by the Copyright Act; that is, until the Seventh Circuit changed everything in Toney v.L’Oreal U.S.A., Inc. This article focuses on the Toney case, the Baltimore Orioles,Inc. v. Major League Basball Players Association case that spawned Toney, and the devastating effect the law from these cases will have on the right of publicity, the entertainment industry as a whole, and many other areas of civil and criminal law, if Toney is allowed to stand.

Spatial Ecology Of Swift Fox Social Groups: From Group Formation To Mate Loss, Ann M. Kitchen, Erik M. Gese, Seija M. Karki, Edward R. Schauster

We examined social group formation, movements and denning relative to other group members, home-range use, and the response to social group disruption among 188 radiocollared swift foxes (Vulpes velox) in Colorado. We found that during the initial stages of pair formation mated foxes shared dens more frequently than during the remainder of their pair-bond. The average distance between mated pairs was influenced by season and time of day, with the greatest proximity in the breeding season (727.2 m 6 42.3 SE), and during diurnal hours (463.7 6 34.7 m). In order to place this article in context, I will first describe Tennessee's practice rule for attorneys representing children as Guardians ad Litem. It is an example of the "Elephant," the many component parts of a child's life that the child's lawyer is required to bring together to represent the child holistically. To better frame this discussion, I will first describe the immigration process and its anti-therapeutic effects on immigrants in some detail. I will then proceed to discuss the use of community presentations and contextual representation practices to preserve a client's voice and validation in the immigration process. Throughout this article, and more specifically in my conclusion, I will examine how students who understand the need to address "psycho-legal soft spots" naturally gravitate to client-centered representation, thereby becoming empathetic and competent practitioners.

In this paper, I propose to focus on three stages in the Divine Comedy that represent three stages of the spiritual journey. First, being lost. The poem opens with Dante lost in a dark wood, corresponding to the spiritual situation of many lawyers today. Recall the title of Dean Kronman's book: The Lost Lawyer. Second, taking the journey. Dante moves from the dark wood through hell and purgatory on his journey of self-discovery. The lessons he learns can help anyone setting out on the spiritual journey. Third, arriving home. This paper will examine the psychological effects associated with filing for consumer bankruptcy and techniques that can be learned by law students and young lawyers to help soften the blow for those who will inevitably experience those effects. For more than thirty years I've spent a lot of time reading bad writing. By bad writing, I mean writing that fails of its essential purpose-so flawed in concept or execution that it can hardly inform, much less persuade. The writing is the sort that lawyers are routinely expected to produce: briefs, judicial opinions, essays dealing with law-related subjects, and the like. These Uniform Methods and Rules (UM&R) are the minimum standards adopted and approved by the Deputy Administrator, Veterinary Services (VS), Animal and Plant Health Inspection Service (APHIS), on January 20, 2005. They were established for the maintenance of tuberculosis-free accredited herds of cattle and bison and the maintenance of State or zone status in the U.S. Department of Agriculture’s (USDA) tuberculosis eradication program.

These minimum standards do not preclude the adoption of more stringent standards by any State or zone.

Coyote's Tale On The Old Oregon Trail: Challenging Cultural Memory Through Narrative At The Tamástslikt Cultural Institute, Jackson B. Miller

This essay examines the oppositional narratives presented in a Native American museum in order to explore the efficacy of narrative as both a strategy for resistance to hegemonic narratives of the settling of the West and a medium for sharing culture. The positioning of the museum visitor as co-participant in the museum’s narratives is also considered, with a particular focus on the relationships among narrator, story, and audience. Finally, the narrative of tribal life presented in the museum is evaluated for its potential as a vehicle for both cultural change and continuity.

What Do Freshmen Really Know About Research? Assess Before You Teach, Jean Caspers, Steven Mark Bernhisel

The article describes an effort to assess the information literacy skills of entering first-year college students. An instrument was developed and information was gathered on students' experience and comfort in conducting library research as well as their perceived competence with specific information literacy skills. In addition, students completed a skills test to assess specific knowledge and skills relating to information literacy. Entering first-year students generally self-reported their skills to be less than "excellent." This finding was supported by the results of the skills test. Long term ecological research sites within the U.S. date to 1911 when the Priest River Experimental Forest was set aside as a research center. By 1980 when the Long Tenn Ecological Research program was established, 78 experimental forests and> 10 rangeland research stations had been conducting research, in most cases for > 40 years. Within the last 20 years, several meat-borne pathogenic microorganisms have emerged in the United States, causing numerous outbreaks of disease and death, as well as drastic economical losses.

Guidelines in this NebGuide are suggested for controlling temperature of meat and meat products in fabrication rooms so as to prevent detrimental growth of meat-borne pathogens.
